Half title inscription to Edward Everett from J. Eliot Thayer. Good+. Fitch was allegedly the chief conspirator in a plot to sabotage the Michigan Central Railroad. William Seward participated prominently in the defense of his case. "This tragicomedy resulted largely from the killing by the newly built and unfenced Michigan Central Railroad in the 1840s of cattle and other livestock straying onto its right of way, and refusal by the railroad to pay farmers the full value for this livestock. There developed a fierce feud between the operators of the railroad and the farmers and others living along its line, particularly in Jackson County, where there was much sabotage against the railroad. The railroad, instead of trying to mitigate the controversy, acted in a high-handed manner" [Greenly] and brought suit after the burning of its freight house in Detroit. Fitch and others, arrested for the crime, were denied bail; he died in jail during his trial, which is reported here in full, with long sections devoted to the defendants' testimony and the arguments of counsel. The situation in Michigan in the mid-1840's foreshadowed a struggle which became more prominent - and more inequitable - after the Civil War. The Michigan Central Railroad opened the fertile area up for agricultural development by providing transportation, but it also put the farmers at the mercy of the line as far as freight rates. In an era before any regulatory control, the line played favorites to friends and squeezed the small farmers. The latter responded with sabotage, and it was the agrarian vs. technology. An early and important case suggesting much of what was to come on the American landscape.

Condition: Very Good. 8.5 x 5.25", polished calf with red leather spine label, 283pp + 399pp + 8pp index, covers rubbed and spotted, extremities lightly chipping, outer hinges a bit rough, inner hinges cracked, missing prelims, eps darkened from glue underneath, title page browned around the edges, scattered spotting and finger soiling; still a good, complete copy. 50 men were arrested for conspiring to burn down the Michigan Central Depot in Detroit; Abel Fitch died before the verdict, but 12 defendants were sentenced to jail time. Note fro the publisher, in part: "In the eyar 1849 a series of assaults and depradations were committed on the property.of the Central Railroad Company.in Jackson County. This continuted until the autumn of 1850, when the freight depot of the Company in Detroit.was burned and totally destroyed". SCARCE.

Shelfworn, corners worn, some scuffing/scraping to spine, front outer hinge starting to crack, inner hinges cracked, spotting to page edges, spotting and a few small tears, lacking title page. "In the year 1849, a series of assaults and depedations were committed upon the property and business of the Central Railroad Company (Michigan Central Railroad), in and about the villages of Leoni and Michigan Centre, in Jackson County . . . This continued until the autumn of 1850, when the freight depot of the company in Detroit, together with all its contents was burned and totally destroyed." The Michigan Central Railroad compensated farmers for the total value of their livestock when their animals were killed on the tracks. However, in 1849 the railroad had a new policy which would only reimburse the farmers for half the value. This was the beginning of "The Great Railroad Conspiracy" in which the enraged farmers engaged in acts of vandalism and terror against the railroad and its employees. Detectives were hired and suspects arrested and all were found guilty. The lawyer for the defendants was Sen. William H. Seward of New York who later became Secretary of State under Abraham Lincoln.
