An Act to continue feveral Laws relating to the granting a Bounty on the Importation into Great Britain of Hemp, and rough and undreffed Flax, from His Majefty's Colonies in America; and to the more effectually encouraging the Manufacture of Flax and Cotton in Great Britain until the Twenty-fifth Day of March One thousand eight hundred and ten; and for granting a Bounty upon certain Species of British and Irish Linens exported from Great Britain, and taking off the Duties on Importation into Great Britain, of Foreign Raw Linen Yarns made of Flax, until the Twenty-fifth Day of March One thoufand eight hundred and eleven.

An Act for granting to His Majefty, until the End of the next Seffion of Parliament, Duties of Cuftoms on the Goods, Wares, and Merchandize therein enumerated, in furtherance of the Provifions of certain Orders in Council. [28th March 1808.]

Moft Gracious Sovereign,

WHEREAS Meafures which have been taken by powers at

War with Your Majefty, prohibiting in Violation of the 'Law of Nations all Intercourfe with this Kingdom, and all Trade in any Articles of its Growth or Manufacture, have rendered it ne'ceflary for Your Majefty to iffue Orders in Council to counteract 'the Difadvantages which were thereby impofed upon the Trade of Your Majesty's Subjects, and to retaliate upon the Enemy the Evils 'which he intended to inflict upon this Kingdom: And whereas it is 'expedient and neceffary in order effectually to accomplish the Object of fuch Orders, that Duties of Cuftoms fhould be granted upon cer'tain Goods exported from Great Britain; We, Your Majefty's mot 'dutiful and loyal Subjects, the Commons of the United Kingdom, in Parliament affembled, do moft humbly befeech Your Majefty that it may be enacted;' and be it enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after the paffing of this Act, there shall be raised, levied, collected, and paid unto His Majefty, His Heirs and Succeffors, upon all Goods, Wares, and Merchandize, enumerated or described in the Tables (A.) (B.) and (C.) annexed to this Act, exported from Great Britain, the feveral Duties of Cuftoms, as the fame are refpectively defcribed and fet forth in Figures in the faid Tables.

II. And be it further enacted, That the Duties granted and impofed by this A, and made payable according to the Weight, Tale, Gauge, Measure, or Value of any Goods, Wares, or Merchandize charged with fuch Duties, fhall be charged and payable upon any greater or lefs Weight, Number, Quantity, or Value thereof than the Weight, Number, Quantity, or Value particularly inferted, defcribed, and fet forth in the Tables hereunto annexed, marked (A.) (B.) and (C.) in proportion to the actual Weight, Number, Quantity, or Value of fuch Goods, Wares, or Merchandize.

III. And be it further enacted, That where any Goods, Wares, and Merchandize, which are allowed to be, or which fhall have been warehoufed, or otherwife fecured, at the Time of the Importation thereof, without Payment of the Duties due thereon, fhall be taken out or entered Inwards for Home Confumption, and the Duties of Cuftoms and Excife then due thereon shall have been paid, and the fame shall afterwards be entered for Exportation, then and in every fuch Cafe the Duties of Cuitoms by this Act impofed fhall be paid on the Exportation of the faid Goods, Wares, and Merchandize, notwithstanding the Payment of any Diawbacks to which the Exporter thereof may in tuch Cafe under any Law or Laws then in force be entitled.

IV. And whereas by an Order in Council dated the Twenty-fifth of November One thonfand eight hundred and feven, it was ordered and declared, that Information of a certain other Order in Council of the Eleventh of November One thousand eight hundred and feven, fhould be taken and held to have been received in the Places ⚫ herein-after mentioned at the Periods refpectively affigned to them; namely, Ports and Places within the Baltic on the Twenty-firft of December One thousand eight hundred and feven; other Ports and Places to the Northward of Amflerdam on the Eleventh of De• cember

'cember One thoufand eight hundred and feven; from Amfterdam to Ubant on the Fourth of December One thousand eight hundred and feven; from Ufhant to Cape Finisterre on the Eighth of December One thoufand eight hundred and feven; from Cape Finisterre to Gibraltar inclufive, on the Thirteenth of December One thousand 'eight hundred and feven; Madeira the Thirteenth of December One thoufand eight hundred and feven; Ports and Places within the Streights of Gibraltar to Sicily and Malta and the Weft Coafts of Italy inclufive, on the Firft of January One thoufand eight hundred and eight; all other Ports and Places in the Mediterranean beyond Sicily and Malta on the Twentieth of January One thousand eight hundred and eight; Ports and Places beyond the Dardanelles on the First of February One thoufand eight hundred and eight; any Part of the North and Western Coaft of Africa or the Islands adjacent, except Madeira, on the Eleventh of January One thousand eight hundred and eight; the United States and British Poffeffions in North America and the West Indies on the Twentieth of January One thoufand eight hundred and eight; Cape of Good Hope and the Eaft Coaft of South America on the First of March One thousand eight hundred and eight; India on the First of May One thousand eight hundred and eight; China and the Coast of South America on the Firft of June One thousand eight hundred and eight;' be it therefore enacted, That nothing in this A&t contained fhall extend to pre. vent any Veffel which fhall have failed from any fuch Port or Place before the Period above specified as aforefaid, and which shall have been brought into or fhall have come into any Port in Great Bri of Council, may tain under any Warning given in purfuance of any of the faid Orders proceed from in Council, from proceeding on her Voyage to any Port or Place Great Britain whatever, without entering or landing any Part of her Cargo in Great Britain (except Cotton Wool or Yarn, or Jefuits Bark) and without the Payment of any Duty granted by this Act upon any Part of the Cargo (except Cotton Wool or Yarn, or Jefuits Bark): Provided always, that if the Port or Place to which fuch Veffel fhall proceed, fhall belong to a Country in Amity with His Majefty, and from which the British Flag is not excluded, fuch Veffel fhall in that Cafe be permitted to proceed without being compelled to land any Part of her Cargo, or to pay any Duty imposed by this Act in refpect of the fame.

V. Provided always, and be it further enacted, That nothing in this Act contained fhall extend to charge with any of the Dutics granted by this Act, any Goods, Wares, or Merchandize (except Cotton Wool or Yarn, and Jefuits Bark) imported into Great Britain in any Veffel, under any Licence bearing Date before the Eleventh Day of November laft, or in any Veffel which shall have been cleared out from the Port or Place from which fuch Goods, Wares, or Merchandize were imported before the Period in this A&t fpecified, as to fuch Port or Place, as the Period at which the faid Orders in Council fhall be taken and held to have been received, in any Cafes in which the faid Goods, Wares, or Merchandize fhall, upon their Importation, have been or fhall be warehoufed for Exportation only.

VI. Provided always, and be it further enacted, That nothing in this Act contained fhall extend to charge with any of the Duties granted by this A&, any Goods, Wares, or Merchandize on the Exportation from Great Britain (except Cotton Wool or Yarn, and Je

faits Bark) which shall have been or fhall be imported into Great Britain prior to the first Day of June One thoufand eight hundred and eight, from any free Port in any of His Majesty's Plantations in the Weft Indies or any other Port or Place, under any Licence from the Governor of any of His Majefty's Plantations duly authorized for that Purpose, bearing Date prior to the Twenty-firft Day of January laft, in cafe fuch Goods, Wares, or Merchandize fhall, on their Importation into Great Britain, have been or shall be warehoused for Exportation only.

VII. Provided alfo, and be it further enacted, That no Goods, Wares, or Merchandize described in the faid Tables (A.) and (B.) of the Growth and Produce of Saint Domingo, which fhall have been or fhall be imported into Great Britain by Licence in return for Goods exported to the faid Ifland, bearing Date prior to the Fifth of February One thoufand eight hundred and eight, and which fhall have been or fhall be warehoufed for Exportation, fhall be liable, on the Exportation thereof, to any of the Duties of Cuftoms granted by this Act; and all fuch Goods, Wares, and Merchandize, the Growth and Pieluce of Saint Domingo, which fhall have been or fhall be imported into Great Britain under any Licence bearing Date fubfequently to the faid Fifth Day of February, fhall, upon the Exportation thereof from Great Britain, be chargeable with and fubject and liable to One-half Part only of the Duties of Cuftoms granted by this Act upon Goods, Wares, and Merchandize of the like Description, upon their Exportation from Great Britain.

VIII. And be it further enacted, That all Goods, Wares, or Merchandize, which have been or may be condemned as Prize, fhall, on the Exportation thereof from Great Britain, be charged with and fubject and liable to the Duties by this Act impofed on the Exporta-2.1 tion of the like Goods, Wares, or Merchandize refpectively, any Law, Cuftom, or Ufage to the contrary notwithstanding: Provided always, that nothing in this Act contained fhall extend to charge with any of the Duties granted by this Act, any Goods, Wares, or Merchandize (except Cotton Wool or Yarn, or Jefuits Bark) which fhall have been or fhall be brought into any Port in Great Britain for Adjudication before the paffing of this Act, whether the fame fhall have been or shall be fubfequently restored or condemned as Prize.

IX. And be it further enacted, That the Duties of Cuftoms defcribed and fet forth in Figures in the faid Tables hereunto annexed, marked (A.) (B.) and (C.) on the feveral Goods, Wares, and Merchandize fpecified therein, fhall be paid to the proper Officer authorized to receive the Duties of Cuftoms on Goods, Wares, and Merchandize imported into Great Britain, and may and fhall refpectively be managed, afcertained, raifed, levied, collected, anfwered, paid, and recovered, except where any alteration is exprefsly made by this Act, in fuch and the like Manner, and by the fame Means, Ways, or Methods, as former Duties of Cuftoms upon Goods, Wares, or Merchandize in general, and alfo by any fuch Ipecial Means, Ways, or Methods refpectively, as former Duties of Cuftoms upon Goods, Wares, or Merchandize of the fame Sorts or Kinds were or might be managed, ascertained, raised, levied, collected, answered, paid, and recovered; and the Goods, Wares, or Merchandize whereon Duties of Cuftoms are by this Act charged, as the fame are refpectively inferted, described,

and fet forth in the faid Tables, upon Exportation thereof from Great Britain, fhall be and the fame are hereby made fubject and liable to all and every the Conditions, Regulations, Securities, Rules, Reftrictions, Seizures, and Forfeitures, to which Goods, Wares, or Merchandize in general, and alfo all and every the fpecial Conditions, Rules, Regulations, Reftrictions, Seizures, Sales, and Forfeitures refpectively, to which the like Goods, Wares, or Merchandize were fubject and liable by any Act or Acts of Parliament in force on and immediately before the paffing of this Act refpecting the Revenue of Customs, except where any Alteration is exprefsly made by this Act; and all Pains, Penalties, Fines, and Forfeitures, of whatever Nature or Kind the fame may be, as well Pains of Death as others, for any Offence whatever committed against or in Breach of any A&t or Acts of Parliament in force on or immediately before the paffing of this Act, made for fecuring the Revenue of Cuftoms, or for the Regulation or Improvement thereof, and the feveral Claufes, Powers, Provifoes, and Directions contained in any fuch Act or Acts, fhall (unless where exprefsly altered by this Act) extend to and be refpectively_applied, practifed, and put in Execution, in refpect of the feveral Duties of Customs hereby charged, in as full and ample a Manner, to all Intents and Purposes whatever, as if all and every the faid Acts, Claufes, Provifoes, Powers, Directions, Fines, Pains, Penalties, or Forfeitures, were particularly repeated and re-enacted in the Body of this A&t, and made Part thereof.

X. And be it further enacted, That in all Cafes where, by the faid Tables, the Duties of Cuftoms by this Act impofed upon the Exportation of Goods, Wares, and Merchandize from Great Britain, are charged not according to the Weight, Tale, Gauge, or Meafure, but according to the Value thereof, fuch Value fhall be confidered as the fame fhall be at the Port of Exportation, without any Deduction or Abatement whatever; and fuch Value fhall be afcertained by the Declaration of the Exporter or Proprietor of fuch Goods, Wares, or Merchandize, or his known Agent, in the Manner and Form, and under all the Rules, Regulations, and Reftrictions, and fubject to the fame Forfeitures and Penalties as are prefcribed and directed for afcertaining and collecting the Duties to be paid upon Goods, Wares, and Merchandize, according to the Value thereof, by an A&t paffed in the Twenty-feventh Year of the Reign of His prefent Majefty, intituled, An Ad for repealing the feveral Duties of Cuftoms and Excife, and granting other Duties in lieu thereof, and for applying the faid Duties together with the other Duties compofing the publick Revenue, for permitting the Importation of certain Goods, Wares, and Merchandize, the Produce or Manufacture of the European Dominions of the French King into this Kingdom, and for applying certain unclaimed Monies remaining in the Exchequer for the Payment of Annuities on Lives to the Reduction of the National Debt; and in cafe any Goods, Wares, or Merchandize, chargeable with any fuch Duty by this Act, according to Value, fhall not be valued according to the true Price or Value thereof, and according to the true Intent and Meaning of this Act, then it fhall be lawful for the proper Officer or Officers of the Cuftoms, to caufe the fame to be detained; and the faid Goods, Wares, and Merchandize fhall be dealt with, and the proper Officer of the Cuftoms fhall proceed, with
