the westerly side line of Kent avenue, together with a spur track on the southerly side of North Sixth street beginning at the bulkhead line and running thence southeasterly to a point on the southerly side line of North Sixth street distant about 561 feet westerly from the westerly side of line of Kent

avenue.

(G) One track on the northerly side of North Sixth street beginning at the bulkhead line on the easterly side of the East river; running thence easterly along the northerly side of North Sixth street to a point thereon about 40 feet westerly from the westerly side line of Kent avenue.

(H) Two tracks beginning at the southerly side line of North Seventh street; thence crossing North Seventh street to the northerly side line thereof, both of said tracks to be situated in that portion of North Seventh street included between a line parallel with and distant about 554 feet westerly from the westerly side line of Kent avenue and a line parallel with and distant about 585 feet westerly from the westerly side line of Kent avenue.

(I) One track beginning at a point on the northerly side line of North Seventh street about 555 feet westerly from the westerly side line of Kent avenue; thence curving southerly and easterly across North Seventh street to the southerly side thereof; thence easterly along said southerly side of North Seventh street to a point about 13 feet westerly from the westerly side line of Kent avenue.

(J) One track on the northerly side of North Eighth street beginning at a point on the northerly side line of said street distant about 577 feet westerly from the westerly side line of Kent avenue; running thence southeasterly along the northerly side of North Eighth street to a point about 180 feet westerly from the westerly side line of Kent avenue.

"(K) One track beginning at a point on the southerly side line of North Eighth street distant about 552 feet westerly from the westerly side line of Kent avenue; running thence northwesterly across North Eighth street to the northerly side line thereof at a point distant about 633 feet westerly from the westerly side line of Kent avenue.

(L) One track beginning at a point on the southerly side line of North Eighth street distant about 596 feet westerly from the westerly side line of Kent avenue; running thence northwesterly across North Eighth street to the northerly side line thereof at a point distant about 633 feet westerly from the westerly side line of Kent avenue.

(M) Two tracks beginning at the northerly side line of North Eighth street; thence crossing North Eighth street to the southerly side line thereof, both of said tracks to be situated in that portion of North Eighth street included between a line parallel with and distant about 633 feet westerly from the westerly side line of Kent avenue and a line parallel with and distant about 671 feet westerly from the westerly side line of Kent avenue.

(N) One track beginning on the northerly side line of North Ninth street at a point distant about 676 feet westerly from the westerly side line of Kent avenue; thence curving southwesterly across North Ninth street to the southerly side line thereof at a point distant about 696 feet westerly from the westerly side line of Kent avenue.

(0) One track on North Ninth street beginning at a point in the center thereof about 137 feet westerly from the westerly side line of Kent avenue; running thence westerly to the bulkhead line on the easterly side of the East river, together with the following spur tracks:

(1) One spur track beginning at a point in the center of North Ninth street distant about 676 feet westerly from the westerly side line of Kent avenue; running thence easterly to a point on the northerly side of North Ninth street distant about 587 feet westerly from the westerly side line of Kent avenue.

(2) One spur track beginning at a point in the centre of North Ninth street distant about 416 feet westerly from the westerly side line of Kent avenue; running thence northwesterly to the northerly side line of North Ninth street at a point about 516 feet westerly from the westerly side line of Kent avenue together with a branch beginning at a point distant about 460 feet westerly from the westerly side line of Kent avenue; running thence northwesterly to the northerly side line of North Ninth street to a point distant about 587 feet westerly from the westerly side line of Kent avenue, and a branch to the last above described branch beginning at a point in North Ninth street distant about 550 feet westerly from the westerly side line of Kent avenue; running thence northwesterly to the northerly side line of North Ninth street at a point distant about 647 feet westerly from the westerly side line of Kent

avenue.

(P) One track on a trestle beginning at the bulkhead at the easterly side of the East river, running thence southeasterly across North Ninth street to the southerly side line thereof at a point distant about 636 feet westerly from the westerly side line of Kent avenue, together with two spur tracks each beginning at a point on the above mentioned track distant about 676 feet westerly from the westerly side line of Kent avenue, and both running thence southeasterly about 40 feet to a point on the southerly side line of North Ninth street, all of said tracks being elevated about 22 feet above the grade of the street.

Certificate of convenience and necessity. June 15, 1908, the Company made application to the Public Service Commission for a certificate of convenience and necessity. December 4, 1908, the Commission granted the certificate.

Special franchises. March 15, 1909, by contract entered into with the city of New York, pursuant to a resolution adopted by the Board of Estimate and Apportionment and approved by the mayor February 23, 1909, the Company obtained a franchise to construct its road on streets as follows:

(a) Four tracks beginning at the westerly side of Wythe avenue; thence across Wythe avenue to the easterly side thereof, all of such tracks to be situated in the portion of Wythe avenue between the southerly side line of North Fourth street and a line parallel thereto crossing Wythe avenue about 60 feet southerly therefrom.

(b) Six tracks beginning at the westerly side line of Kent avenue; thence across Kent avenue to the easterly side line thereof, all of such tracks to be situated in the portion of Kent avenue, between the southerly side line of North Fourth street and the line parallel thereto and crossing Kent avenue about 120 feet southerly therefrom.

(c) One track beginning at the westerly side line of Kent avenue; thence curving northerly and easterly across Kent avenue and North Fourth street to the northerly side line of North Fourth street at a point about 110 feet easterly from the easterly side line of Kent avenue.

December 27, 1909, by contract entered into with the city of New York, pursuant to a resolution adopted by the Board of Estimate and Apportionment and approved by the mayor, December 23, 1909, the Company obtained a franchise to construct its railroad on streets and avenues as described in its certificate filed in the office of the secretary of state, December 23, 1909.

Grade crossing. By order of the Public Service Commission, adopted June 8, 1909, the Company obtained consent to cross the tracks of The Brooklyn Heights Railroad Company and the Brooklyn Rapid Transit Company in Kent avenue at grade.

Stock. In the Company's annual report to the Public Service Commission, 1910, it stated that its entire capital stock had been issued for cash.

Intercorporate relations. (See also chart VI, no. 59-a.) The Company's principal business is the hauling of cars containing freight for the Brooklyn Eastern District Terminal. It has contracts with that Company, which nets it an annual compensation for handling this freight business.

Construction and operation. In the Public Service Commission's report, 1910, it appears that the operation of the Company's road commenced July 20, 1909.

187 The East River Tunnel Railroad Company
(Manhattan and Queens)

Incorporation. February 25, 1885; General Railroad Law of 1850; corporate life, 99 years; capital stock, $2,000,000; route (about one mile) as follows:

Commencing at some eligible point in Ravenswood, Long Island City; thence by the most feasible route below the bed of the East channel of the East river to and under Blackwell's Island; thence under the west channel of the East river by the most feasible route to an eligible and convenient point on the line of First avenue between 34th and 86th streets.

Construction. No record of any construction. has probably forfeited its corporate existence.

The Company

188 East Side and Mount Vernon Railway Company

(The Bronx)

Incorporation. April 21, 1881; Rapid Transit Law of 1875; by Rapid Transit Commissioners of Westchester County by a certificate dated March 25, 1881, for purpose of constructing a rapid transit railroad from a junction with the New York, New Haven and Hartford Railroad, a short distance east of Mount Vernon, terminating at the city line of New York City, nearly opposite Fordham; corporate life, 99 years; capital stock, $250,000.

Stock. The last report of the Company to the Board of Railroad Commissioners for 1891, showed $4,934 of capital stock paid in.

Extension of time to construct. In a certificate granted by the Rapid Transit Commissioners the Company was given five years within which to construct the first section of its road. By chapter 57, laws of 1886, the time for construction of the first section was extended five years from the passage of the act. By chapter 422, laws of 1890, the time for construction of the several portions of the road was extended six years from the passage of the act. Construction. No report of any construction. The Company has probably forfeited its corporate existence.

189 East Side & New Rochelle Patent Railway Company (Manhattan and The Bronx)

Incorporation. July 26, 1866; General Railroad Law of 1850; for purpose of constructing a railroad to be operated by propelling rope or cable attached to the stationary power; corporate life, 999 years; capital stock, $5,000,000; route (about 25 miles) as follows:

Commencing at or near the southerly extremity of the city of New York, and extending thence northwardly with one or more branches parallel or lateral to the main line, extending to the village of New Rochelle, in the county of Westchester.

Two other companies, the Broadway and Yonkers Patent Railway Company and the West Side and Yonkers Patented Railway Company were incorporated on the same day to construct a similar road on substantially the same route. Two of the incorporators of this Company were also the incorporators of the other two companies.

Construction. No record of any construction by this Company, but part of the road was actually constructed by the West Side and Yonkers Patented Railway Company. The Company has probably forfeited its corporate existence.

190 East Side Railway Company

(Manhattan)

Incorporation. March 18, 1868; General Railroad Law of 1850; corporate life, 50 years; capital stock, $1,000,000; route (about five miles) as follows:

Commencing on South street near South ferry; thence along South to Broad; along Broad to Pearl; along Pearl to Cherry; along Cherry to Market; along Market to Monroe; along Monroe to Grand; along Grand to Grand street ferry. Also along Grand street to Madison; along Madison to New Chambers; along New Chambers to William; along William to South William; along South William to Broad; along Broad to Pearl; along Pearl to Whitehall along Whitehall to place of beginning with turnouts, sidings, and switches.

Construction. No record of any construction. In the state engineer's report, 1878, the Company is marked extinct.

191 East Side Viaduct Railroad Company

(Manhattan and The Bronx)

Incorporation. June 5, 1906; The Railroad Law of 1890; for purpose of constructing a standard gauge locomotive railroad to be operated by steam, electricity or any other mechanical power; corporate life, 999 years; capital stock, $50,000; route (about five miles) as follows:

To be constructed as an elevated viaduct railroad from the terminus in the borough of Manhattan to a terminus in the borough of The Bronx, at or near the Suburban Rapid Transit Railroad.

Construction. No record of any construction. The Company has probably forfeited its corporate existence.
