the trustees of said school district to the treasurer of the village of Fond du Lac for collection, to be collected in the same manner in all respects as taxes for corporate purposes; and in default of payment thereof, the district taxes shall be included in a separate column with the corporation taxes, and form a part of the amount for which the delinquent lands Compensation shall be sold. For making the necessary records, entries, and advertisements of the said district taxes, it shall be lawful for the said treasurer to charge two cents each for every lot or parcel of land thus entered and advertised for sale, which sum shall form a part of the amount for which the same shall be sold.

SEC. 4. That whenever this provision shall take effect as collector, &c. aforesaid, by reason of the adoption of the act to incorporate the village of Fond du Lac, the office of collector and treas-· urer for the Franklin school district shall be abolished, and the treasurer of the said village corporation shall be ex officio treasurer of said school district, and shall be subject to the same duties, liabilities, and restrictions towards said district as the present district treasurer is now or shall be made by law.

SEC. 5. That for the purpose of supporting schools in said district how district, bye-laws may be enacted in the manner prescribed by the act to which this is amendatory, requiring a portion of the expense of education to be paid by the resident scholars, not exceeding twenty-five cents per scholar per term, to be levied and collected of their parents or guardians by the trustees, as is now provided by law in relation to fuel and rate bills for instruction, in towns under the township system of government; and this provision shall apply to the collection. of any amount due, or to be due, for fuel and instruction, since the incorporation of said district for special purposes; and the trustees of said district are hereby empowered, in their discretion, to release any poor or indigent person or persons in said district from paying any part or portion of said expenses.

SEC. 6. The trustees of said school district are hereby authorized to build and erect a school house in said district, at a cost not exceeding one thousand dollars, and to contract

for the same, or any or all of the materials therefor, on time not exceeding six years, and on such terms as they may deem for the best interests of said district, and the amount thereof may levy and collect, and pay annually, or in other instalments, as they may deem proper.

AN ACT

To incorporate the Watertown Seminary.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin:

SECTION 1. Walter H. Besley, William M. Dennis, Patrick Rogan, Michael Gallagher, Simeon Ford, William R. Perry, Edward Gilman, John Richards, Luther A. Cole, Linus R. Cady, E. W. Cole, Edmund S. Bailey, David Temple, Michael Murphy, Calvin M. Bantare, H. B. Hawley, Eliphalet Cramer, L. E. Boomer, and Jacob J. Enos, and their associates and successors, are hereby declared and constituted a body corporate, by the name and style of the Watertown Seminary, to be located in the village of Watertown, Jefferson county, for the purpose of educating youth of both sexes.

SEC. 2. Said corporation shall have power to contract and · be contracted with, sue and be sued, plead and be impleaded, defend and be defended, in all courts of law and equity; said corporation shall have a common seal; and shall have power to acquire, purchase, receive, possess, hold, and enjoy, property, real and personal, not exceeding in value ten thousand dollars, and the same to sell and convey, rent, or other wise lawfully dispose of at pleasure.

Capital stock SEC. 3. The stock of said company shall be divided into may be trans- shares of ten dollars each, which shall be deemed personal property, and shall be transferable on the books of said corporation in such manner as shall be directed by the bye-laws of said corporation.

The election of trustees shall be by ballot; each stockholder shall be entitled to one vote for every share by him owned, to the number of five, and one vote for every five shares above that number. SEC. 5. The trustees shall have power to elect their president, secretary, and other officers:

SEC. 6. No religious test or qualification shall be required from any trustee or other officer of said corporation as a condition for admission to any privileges in the same.

SEC. 7. This act may be amended or repealed by any future legislature.

Dam Rail Road. Company.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin :

Snow, and Alfred Loomis, be and they are hereby appointed commissioners, under the direction of a majority of whom subscriptions may be received to the capital stock of the Fond du Lac and Beaver Dam Rail Road Company, hereby incorporated; and they may cause books to be opened at such times and places as they shall direct, for the purpose of receiving subscriptions to the capital stock of said company,, first giving sixty days notice of the times and places of taking such subscriptions, by publishing the same weekly in a public newspaper printed in the county of Dane, and also in one printed in the county of Fond du Lac, and in two printed in the county of Milwaukee.

SEC. 2. That the capital stock of said company shall be five hundred thousand dollars, in shares of fifty dollars each; and as soon as two thousand shares of stock shall be subscribed, and five dollars on each share actually paid in, and a statement shall be deposited with the secretary of the territory or state of Wisconsin, authenticated by the oath of the secretary, and two or more of said commissioners, that such subscriptions and payments have been in good faith made, the subscribers of such stock, with such other persons as shall associate with them for that purpose, their successors and assigns, shall be, and they are hereby declared and created a body corporate and politic, by the name and style of "The
