On motion, the Executive Session arose.

On motion of Mr. Horne, the Senate adjourned until to-morrow at 10 o'clock A. M.

Journal of yesterday was read and approved.

Mr. Quigg, chairman of the Special Joint Committee of Conference, made the following report:.

MR. PRESIDENT:-Your Committee on the part of the Joint Committee to confer on the disagreement between the House and Senate on amendments to the appropriation bill, would unanimously report as follows on the amendments appertaining to the "Law Library." We would report, recommending that the appropriation for the Law Library be for the sum of one thousand dollars. On the amendment in reference to the Penitentiary appropriation, we

would report, recommending the adoption of the Penitentiary appropriation in the following language, to wit:

That the sum now in the Treasury, heretofore appropriated for the construction of the Penitentiary be, and the same is hereby reappropriated for the continuance of work upon the Penitentiary. That the sum of seven thousand five hundred dollars, ($7,500) herein appropriated for the boarding, clothing, &c., State convicts be, and the same may be at the discretion of the Board of Directors, used for the purpose of constructing the Penitentiary. On the amendment, in reference to the militia appropriation, we report recommending the appropriation, in the following language, to wit:

That the bonds heretofore ordered issued for payment of claims for services in militia in the years prior to 1864, and for the year 1864 be, and the same are hereby appropriated for the payment of militia claims arising prior to the 1st of October, 1864, and all such sums of money now in the hands of the Paymaster General be, and the same are hereby placed under the order of the Governor, to be used in payment of such military claims for the years prior to October, 1864, as may be deemed necessary, all of which is respectfully submitted.

Mr. Colton moved that the Senate do now agree to the report of the Conference Committee.

Motion prevailed.

Mr. Speer of Douglas moved that the Senate do now concur in House amendments to Senate bill No. 86, "Making appropriations. for the current expenses for the year 1865," as agreed to upon by the Conference Committee.

Motion revailed.

The amendments were read.

The question then being shall we concur in House amendments to Senate bill No 86?

The ayes and noes were called, and resulted as follows: Ayes 14,

moes none.

Those gentlemen voting aye, were

Messrs. Barbour, Colton, Eskridge, Houston, Horne, Lane, Man ning, Melhoan, Quigg, Speer of Brown, Speer of Douglas, Smith, Twiss and Weer.

A constitutional majority having voted to concur, the House amendments were concurred in.

Mr. Weer presented Senate Concurrent Resolution No. 52, which was passed over for the present.

On motion, the Senate went into Executive Session.

The following message was received from the Governor, and the several nominations therein were duly and unanimously confirmed by the Senate:

Gentlemen of the Senate of the State of Kansas:

I have the honor to transmit the following appointments and ask your confirmation of the same :

Wm. F. Cloud, Major General, K. S. M.; D. E. Ballard, Quartermaster General, K. S. M.; John K. Rankin, Inspector General and Paymaster General; N. T. Winans, Surgeon General.

I will appoint the Brigadier Generals as soon as the State is Districted by the Major General in accordance with the provisions of the militia law, and submit the same for confirmation at the next annual session of the Legislature. S. J. CRAWFORD.

On motion, the Executive Session arose.

On motion, the Senate took a recess until 11 o'clock A. M.

Message from the House of Representatives:

MR. PRESIDENT:-The House have adopted the following resolution and desire your concurrence therein :

1.

Resolved, By the House of Representatives, the Senate concurring, that the Legislature adjourn sine die on Monday the 20th day of February, A. D. 1865, at 12 o'clock M.

Resolved, By the House of Representatives, the Senate concurring, that a Joint Committee be appointed to wait upon his Excellency the Governor and inform him that the two House have finished their business, and inquire if he has any further communication to make to the Legislature. Committee, on the part of the House, Messrs. Page, Hodgman and Snyder.

Resolved, By the House of Representatives, the Senate concurring, that no Daily State Records be received by the Legislature after to-day, and no pay for such papers shall be allowed beyond the amount already appropriated in the general appropriation Bill. D. B. EMMERT,

On motion, the Senate concurred by unanimous consent in House Concurrent Resolution No.Relating to adjournment at 12 M.

on Monday next.".

On motion the Senate by unanimous consent concurred in House Concurrent Resolution No.-"Relating to the appointment of a Committee to act with a like Committee on the part of the House' to wait on the Governor."

Whereupon, the President Pro. Tem. appointed Messrs. Eskridge, Melboan and Horne as such Committee on the part of the Senate.

On motion, the Senate concurred by unanimous consent, in House Concurrent Resolution No. "In regard to the State Record axing the date at which the contract with the proprietors expires.

Mr. Eskridge, chairman of the Joint Committee on the part of the Senate, to wait on the Governor, made the following report:

MR. PRESIDENT:-Your Committee appointed to act with a like Committee on the part of the House, to wait on the Governor and inform him that the Legislature would adjourn on Monday next at

12 o'clock M., and to enquire whether he has any further communications to make, have discharged the duty assigned them, and respectfully report that his excellency has no further communications to make except reporting the approval of the appropriation bill, which he will do immediately upon its presentation to him.
