VII. VIII. And be it enacted by the authority aforefaid, That Is. 6d. to be for every barrel of falted beef or pork, which fhall be exported paid per barfor fale from any port of this kingdom, dominion of Wales, or 3 Geo. 2. c.20. town of Berwick upon Tweed, to parts beyond the feas, after the f. 16. faid first day of May, one thousand seven hundred and feven, Revived by by any perfon or perfons whatsoever, there fhall be for each bar-5 Geo. 2. c. 6. rel the like allowances as are to be allowed upon exportation of fuch beef and pork exported from Scotland, which allowance fhall be paid by the officer appointed to collect the duties upon falt, in the fame port from whence any fuch beef or pork fhall be exported, within thirty days after demand thereof, on a debenture to be prepared by the collector of the customs where fuch beef or pork shall be entred out for exportation, and verified by the perfon executing the office of fearcher in such port, as to the quantity of beef and pork actually shipped for fale, and that the fame is good and merchantable, and that the oath of the exporter or agent be firft taken before the principal officers of the faid port, before the debenture be allowed, who are hereby required and impowered to give the faid oath, That the beef or pork in fuch debenture mentioned, was falted with falt for which the duties had been paid, and not drawn back, and that the fame is really exported to parts beyond the feas for fale, and that any part thereof was not spent, or intended to be fpent for the fhip's ufe, and was not relanded, or intended to be relanded; for which debenture no fee or reward fhall be taken; and in cafe the officer hereby directed to pay fuch debenture, fhall not have fufficient money in his hands to pay the fame, then upon certificate thereof by him made, (which certificate he is hereby required to give the party gratis) the principal commiffioners for managing her Majefty's revenues of excife upon falt for the time being, fhall be chargeable with the faid payment, to be made in courfe out of the firft money in their hands arifing out of the duties upon falt: and that it shall and may be lawful for the officers for the faid duties on falt, in the feveral and respective ports of the kingdom of England, dominion of Wales, or town of Berwick upon Tweed, upon the exportation of any beef or pork, and before the fame fhall be laid on board for exportation, to mark any cafk, barrel, or other veffel wherein any fuch beef or pork shall be exported, to the intent it may be known that fuch beef or pork has been exported, and allowances obtained on exportation thereof, in cafe the fame, or any part thereof, fhall be relanded or reimported. X. And whereas by the aforefaid articles of union, it is provided, That from and after the union there shall be certain allowances for all bigg, export- oatmeal, and grain called beer, exported from Scotland, be it enacted by the authority aforefaid, That for all oatmeal, and grain called beer alias bigg, which from and after the faid first day of May, one thousand feven hundred and feven, fhall be exported from any port of this kingdom of England, dominion of Wales, or town of Berwick upon Tweed, to parts beyond the feas, by any merchant, or other perfon or perfons whatsoever, there fhall be the like præmium given upon the exportation thereof, as is to be given upon exportation of oatmeal and beer from Scotland; fuch merchant or other person first bringing a certificate in writing under his or their hands, containing the quantity of fuch oatmeal, or beer alias bigg, fo fhipped, to the collector or other perfon appointed, or to be appointed for the time being, to collect the duties or rates arifing by customs within any fuch port, and making proof of fuch certificate by one or more credible perfon or perfons upon their oaths, (which oaths the faid collector, or other perfon, is hereby authorized and required to administer) and giving bond in the fum of ten pounds at least for every ton of oatmeal fo fhipped, confifting of twenty hundred weight, and for every forty bushels of beer alias bigg, fo fhipped, and fo proportionably for a greater or leffer quantity, That the fame fhall be fo exported to parts beyond the feas, and not be relanded; which premium every merchant, or other person so shipping off any fuch oatmeal, or beer alias bigg, and giving certificate and bond, as aforesaid, fhall have and receive from fuch collector, or other perfon, as aforefaid, in any port refpectively where the fame thall be fo fhipped, out of her Majefty's revenue of the customs, and upon certificate returned under the common feal of the chief magiftrate in any place or places beyond the feas, or under the hands and feals of two known English merchants upon the place, that fuch oatmeal, or beer alias bigg, was there landed, or upon proof by credible persons that fuch oatmeal, or beer alias bigg, was taken by enemies, or perished in the feas; which proof being made, or certificate delivered to the collector, or other perfon, who took bond, as aforefaid, the faid bond shall be delivered up to fuch merchant, or other perfon, or his order, to be cancelled, without any fee for the fame.

XI. And be it enacted by the authority aforefaid, That all Penalties, &c. how diftribut- penalties and forfeitures given by this or any former law relating to the duties of excife upon falt, fhall be distributed in manner following; (that is fay) one moiety thereof to the Queen,

XIV. And whereas white falt and rock falt in the exportation Allowances from England to Ireland, are liable to waste, be it therefore en- for waste. acted by the authority aforefaid, That from and after the faid firft day of May, upon producing fuch a certificate as is by law required, from the collector and proper officers of the port or place in Ireland, of the quantity of what white falt and rock falt was there landed, the exporter or proprietor of fuch white falt and rock falt fhall have an allowance of four bushels for every forty bushels of white falt, and of two for every forty bufhels of rock falt put on board in England in order to be exported to Ireland, in confideration of the ordinary wafte in the carriage thereof; and a debenture or debentures fhall be iffued out gratis accordingly, by the collector or proper officer of the port or place in England, from whence fuch white falt or rock falt was exported, and the fame fhall be allowed or paid to the exporter or proprietor, in like manner as debentures are or fhall be payable for falt exported.

XV. And whereas by an act of parliament made in the first year, W. & M. of the reign of the late King William and Queen Mary of bleffed feff. 1. c. 12. memory, intituled, An act for the encouraging the exportation of corn, it was amongst other things thereby enacted, That every fuch merchant by the faid act defcribed, shipping any malt or barley, rye, or wheat, and giving certificate and bond as the faid act directs, fhall have and receive from the farmers, commiffioners, collectors, or other perfons appointed or to be appointed for the time being, to collect the duties and rates arifing by customs, within any fuch port where the

faid corn fhall be shipped off, for every quarter of barley or malt, ground or unground, two fhillings and fix pence; for every quarter of rye, ground or unground, three fillings and fix pence; for every quarter of wheat, ground or unground, five fhillings: and whereas Since the making of the faid act there have been divers quantities of malt made of wheat, fome part whereof have been exported, and fome doubts have arifen touching the bounty-money to be paid upon the exportation thereof, to the difcouragement of the exportation of corn: and for clearing thereof, and for preventing future difputes touching the fame; be it enacted by the authority aforefaid, That every merchant or other perfon exporting malt made of wheat, from and after the faid first day of May, one thousand seven hundred and feven, fhall have and receive of the faid farmers, commiffioners or perfons aforefaid, five fhillings for every quarter of malt made of wheat, or wheat malt, ground or unground, to be paid by the respective persons in the faid recited act mentioned.

XVI. And whereas by the feveral acts of parliament for laying duties on rock falt, and falt refined from rock falt, the exporters of the fame draw back more money from the falt revenue than they pay to her Majelly; for prevention thereof, be it enacted by the authority aforefaid, That from and after the said first day of May, one thousand seven hundred and feven, no perfon or perfons who fhall export rock falt, or falt refined from rock falt, fhall have any other or greater allowance on prompt payment and exportation of the fame, by way of debenture, than what really and bona fide was before paid for the duty of the said salt; and that no perfon giving bond and fecurity for the faid duty, payable within the time limited by law, and paying the fame in twenty eight days after giving the faid fecurity, fhall be entitled, 4 Ann. c. 12. on exportation from England, Wales, or Berwick, to any other advantage than to fuch a debenture as fhall discharge the bond and fecurity only given for the payment of the faid duty.

XVII. And whereas foreign falt imported is allowed to be cellared, or put into warehoufes, and the duties thereof are to be paid or fecured upon delivery, as in this act is mentioned; be it enacted by the authority aforefaid, That all merchants and other perfons importing fuch foreign falt, from and after the first day of May, one thousand feven hundred and feven, fhall be, and are hereby charged with the duties for the full quantity of falt so cellared, or put into warehoufes; and if upon clearing any cellar or warehoufe, in which the faid falt was locked up, there be any want of the faid quantity, the importer or importers of the faid falt fo wanting fhall be anfwerable for the fame; any thing herein contained to the contrary notwithstanding.

XVIII. And whereas by a claufe in an act paffed in the last feffion of this prefent parliament, intituled, An act for continuing an additional fubfidy of tonnage and poundage, and certain duties upon coals, culm, and cynders, and additional duties of excife, and for fettling and establishing a fund thereby, and by other ways and means, for payment of annuities to be fold for

raifing a further fupply to her Majefty, for the fervice of the year one thousand feven hundred and fix, and other uses therein mentioned, all intereft on bonds entred into, and due and payable before the fixth day of February, one thousand feven hundred and five, by merchants and others, for the customs, additional duties, impofitions, and other duties on goods and merchandizes imported into the kingdom of England, was thereby discharged, provided the principal fums fecured by fuch bonds were paid before the first day of June, one Merchants of thousand feven hundred and fix; and whereas feveral merchants and Bristol, who others of the city of Bristol had, before the faid first day of June, paid 30881. one thousand feven hundred and fix, paid feveral fums of money, reft on bonds amounting in the whole to the fum of three thoufand eighty eight given for cu pounds, eight fillings, in to the collector of the customs of the ports itoms, &c. there, for the intereft of feveral principal fums of money, upon feveral bonds by them given for cuftoms, and other duties of goods and merchandize by them imported into the faid port of Bristol, which principal monies they had also before that time paid, and which principal monies and intereft have been fince applied to the ufe of the publick; and it is equally just that those monies fo paid for intereft fhould be allowed back to the faid perfons, as the other intereft should be forgiven to the faid perfons, pursuant to the faid before-mentioned claufe; be it therefore further enacted by the authority aforefaid, That Lord treasurer it fhall and may be lawful to and for the lord high treasurer, or to direct colcommiffioners of the treasury for the time being, or any three ftoms of or more of them, to direct the collector of the cuftoms of the Bristol, to refaid port of Briftol for the time being, out of the monies which pay the fame, fhall be at the time of such direction in the hands of fuch col- &c. lector, upon account of cuftoms, additional duties, impofitions, and other duties on goods and merchandizes respectively, imported there, or which fhall from thence next after come into his hands upon that account, and fuch collector is hereby authorized and required accordingly to refund and repay to the faid feveral merchants and others, (who paid in the faid three thoufand eighty eight pounds, eight fhillings) their executors, adminiftrators, and affigns, the fum and fums of money so paid in by all and every fuch merchants, or others; and that thereupon, and upon the faid collector's producing receipts and acquittances for fuch fum and fums, fuch collector fhall be allowed the fame upon his account, as if the fame had been by him paid upon account of drawbacks for goods exported; any law or cuftom to the contrary notwithstanding.
