Natives of

fectual fecuring the kingdom of England from the apparent dangers that may arise from several acts lately paffed in the parliament of Scotland, there are clauses contained in these words following (that is to fay :)

II. And be it further enacted by the authority aforefaid, That Scotland (ex- from and after the five and twentieth day of December, one thousand cept fettled in- even hundred and five, no perfon or perfons, being a native or nahabitants in tives of the kingdom of Scotland (except fuch as are now fettled England, &c.) after 25 Dec. inhabitants within the kingdom of England, or the dominions there1705,adjudged unto belonging, and fhall continue inhabitants thereof, and fuch as are aliens, &c. now in fervice in her Majefty's fleet or army) shall be capable to inherit any lands, tenements, or hereditaments within this kingdom of England, or the dominions thereunto belonging, or to enjoy any benefit or advantage of a natural born subject of England; but every such perfon fhall be from thenceforth adjudged and taken as an alien, born out of the allegiance of the Queen of England, until fuch time as the fucceffion to the crown of Scotland be declared and fettled by an att of parliament in Scotland, in the fame manner the fucceffion to the crown of England is now fettled by act of parliament in England, in cafe of her Majefty's demife without iffue of her body.

Horfes, arms, III. And be it further enacted by the authority aforefaid, That &c. conveyed if any perfon or perfons whatsoever, fhall at any time from and afin Scotland, ter the twentieth day of February, one thousand feven hundred and four, until fuch time as the fucceffion to the crown of Scotland be declared and fettled by an act of parliament in Scotland, in like manner, as aforefaid, convey or fend, or caufe to be conveyed or fent from any parts or place in England or Ireland, any horfes, arms, or ammunition into the kingdom of Scotland, every fuch perfon or perfons fball forfeit the fum of one hundred pounds, and treble the value of Juch horfes, arms, or ammunition; one third part thereof to the Queen's most excellent majefty, her heirs and fucceffors; and the other third part thereof to him or them who will fue for the fame in any of her Majefty's courts at Westminster, by action of debt, fuit, bill, plaint, or information, wherein no essoin, protection, or wager of law fball lie.

IV. And be it further enacted by the authority aforefaid, That brought into from and after the faid five and twentieth day of December, one England, &c. forfeited. thousand feven hundred and five, until fuch time as the fucceffion to the crown of Scotland be declared and fettled by an act of parliament in Scotland, in like manner, as aforefaid, no great cattle or sheep Shall be brought out of, or from the kingdom of Scotland into the kingdom of England or Ireland, dominion of Wales, or town of Berwick upon Tweed, under the penalty of forfeiting all fuch great cattle or sheep to him or them who will feize or fue for the fame, and alfo the value of fuch great cattle or sheep; one third part to the Queen's most excellent majesty, her heirs and fucceffors, and the other two third parts thereof to him or them who will fue for the fame, to be recovered as aforefaid.

V. And be it further enacted, That it shall and may be lawful to and for any perfon and persons whatsoever, to take and feize in any place or places whatsoever, the great cattle or sheep brought contrary

to this act into this kingdom of England or Ireland, dominion of Wales, or town of Berwick upon Tweed, and detain the fame, during the space of four days, in fome publick or convenient place where fuch feizure fhall be made, within which time, if the owner or owners, or any on his or their behalf, fhall make it appear unto fome justice of the peace of the fame county where the fame shall be fo feized, by the oath of two credible witnesses (which oath the faid juftice of the peace is hereby required and impowered to adminifter) that the fame were not brought from Scotland, after the faid five and twentieth day of December, one thousand seven hundred and five, then the fame upon the warrant of such justice shall be forthwith redelivered.

VI. And be it further enacted, That if any English, or other cat- English cattle tle or sheep, fhall be, with the privity or knowledge of the owner, or intermixed, any perfon employed by bim, driven or intermixed, or caufe to be driven or intermixed with great cattle or sheep, brought out of or from Scotland, and shall be feized with them, fuch cattle and sheep fo intermixed and feized, fhall be deemed Scotch cattle, and fhall be fubject to the like forfeiture, and ordered and difpofed of in all respects as if they were brought out of or from Scotland, contrary to this act; and if any perfon or persons shall wilfully and fraudulently confpire, confederate, or agree together to avoid or evade the feizures or forfeitares upon the bringing in of cattle in this act particularly specified, and the fame fhall put in execution, then every such person and perfons, being thereof indicted or prefented within one year, next after fuch offence by him or them committed, and being thereof lawfully convicted or attainted, at any time hereafter, fhall forfeit the fum of one hundred pounds, to be recovered and diftributed, as aforefaid.

VII. And be it further enacted by the authority aforefaid, That if any action, fuit, bill, plaint, or information, fhall be commenced to plead the or profecuted against any perfon or perfons for any feizure, or other general issue. thing done or made in purfuance or execution of this act, fuch perfon or perfons fhall not be obliged to give any more than a common appearance, and may plead the general iffue, and give the Special matter in evidence; and if the plaintiff or profecutor fhall become nonfuit, or forbear profecution, or fuffer difcontinuance, or if a verdict pafs against him in any fuch action, bill, plaint, fuit, or information, as aforefaid, the defendants fhall have treble cofts, for which they shall have the like remedy as in any cafe where cofts by law are given to the defendant.

VIII. And be it further enacted by the authority aforefaid, That from and after the five and twentieth day of December, one thousand imported, for feven hundred and five, until fuch time as the fucceffion to the crown feited. of Scotland be declared and fettled by an act of parliament in Scotland, in like manner, as aforefaid, no Scotch coals shall be imported out of the kingdom of Scotland into the kingdoms of England or Ireland, dominion of Wales, or town of Berwick upon Tweed, under the penalty of forfeiting the coals fo imported; one half to the Queen's most excellent majefly, the other half to such person as shall Jeize or fue for the fame.

IX. And be it further enacted by the authority aforefaid, That from and after the faid five and twentieth day of December, one thousand feven hundred and five, until fuch time as the fucceffion to the crown of Scotland be declared and fettled by an act of parliament in Scotland, in like manner, as aforefaid, no Scotch linen shall be imported or brought out of Scotland into the kingdom of England, dominion of Wales, town of Berwick upon Tweed, or Ireland, under the penalty of forfeiting the faid linen, and double the value thereof, to be recovered with cofts of fuit in any of her Majefty's courts of record; one moiety thereof to the Queen's majefty, the other moiety to fuch perfons as fhall feize, inform, or fue for the fame.

X. And whereas, fince the making the faid act, an act hath been made and paffed in the parliament of Scotland, for enabling her Majefty to appoint commiffioners to treat with commiffioners for the kingdom of England, of and concerning an union of the said kingThe aforefaid doms of England and Scotland: now to the end that the good claufes repeal- and friendly difpofition of this kingdom towards the kingdom

of Scotland may appear; be it enacted by the Queen's most excellent majefty, by and with the advice and confent of the lords fpiritual and temporal, and commons, in parliament assembled, and by the authority of the fame, That the faid clauses be from henceforth abfolutely repealed and vacated to all intents and purposes whatsoever.

CAP. IV.

An alt for the naturalization of the most excellent princess Sophia, electress and dutchess dowager of Hanover, and the iffue of her body.

WH

WHEREAS the imperial crown and dignity of the realms of England, France, and Ireland, and the dominions thereto belonging, after the demife and death of your Majefty, our most gracious fovereign, without issue of your body, is limited by act of parliament, to the most excellent princess Sophia, electress and dutchefs dowager of Hanover, grandaughter of the late King James the Firft, and the heirs of her body, being proteftants: and whereas your Majefty, by your royal care and concern for the happiness of these kingdoms, reigns in the hearts and affections of all your people, to their great comfort and fatisfaction, and will be a glorious example to your royal fucceffors in future ages: and to the end the faid princefs Sophia, electrefs and dutchefs dowager of Hanover, and the issue of her body, and all perfons lineally defcending from her, may be encouraged to become acquainted with the laws and conftitutions of this realm, it is juft and highly reafonable, that they, in your Majefty's life time (whom God long preferve) fhould be naturalized, and be deemed, taken, and esteemed natural born fubjects of England: we your Majefty's most dutiful and loyal fubjects, the lords fpiritual and temporal, and commons, in parliament affembled, do moft humbly befeech your Majefty that it may be enacted; and therefore be it enacted by the Queen's moft excellent majefty, by and with the advice and confent of the lords spiritual and temporal, and the commons, in this prefent parliament affem-

II. Provided always, and be it further enacted and declared No papift, & by the authority aforefaid, That every person and perfons, who to have the fhall be naturalized by virtue of this act of parliament, and fhall benefit of a become a papist, or profefs the popith religion, fhall not enjoy any benefit or advantage of a natural born fubject of England; but every fuch perfon fhall be adjudged and taken as an alien, born out of the allegiance of the Queen of England, to all intents and purposes whatsoever; any thing herein contained to the contrary notwithstanding.

CAP. VI.

An act for continuing an additional fubfidy of tonnage and poundage, and certain duties upon coals, culm, and cynders, and additional duties of excife, and for fettling and establishing a fund thereby, and by other ways and means, for payment of annuities, to be fold for raising a further fupply to her Majefty, for the fervice of the year one thousand Seven hundred and fix, and other ufes therein mentioned. AY it pleafe your most excellent Majefty, we your Majesty's moft dutiful and loyal fubjects the commons of England in parliament affembled, duly confidering your Majesty's great occafions for money to carry on the prefent war, and having regard as well to the great burthen of taxes now lying upon your Majesty's fubjects, as to the prefent condition of the publick funds, and the prefent incumbrances thereupon, are therefore defirous, by fuch eafy and effectual ways and means, as in this act are expressed and intended, to raife a fum of money, not exceeding in the whole, two millions five hundred feventy five thousand feven hundred fixty one pounds, fixteen fillings 25757611. 168. and two pence, (part of the money neceffary to be provided in this 2d to be feffion of parliament for your Majesty's fupply) and fuch further fum of money as will be fufficient, during the first two years of the term herein after mentioned, to compleat the payment of the annuities to be purchased upon this act, and have for that end and purpose, cheerfully and unanimously given and granted, and do by this act give and grant unto your Majesty the fubfidy of tonnage and poundage Tonnage and upon wines, goods, and merchandizes, and the feveral duties upon poundage, upfoal, culm, and cynders, and upon beer, ale, cyder, and other liquors on wines, &c.

C. 23.

New Subfidy.

hereafter in this aft mentioned, for fuch feveral and respective terms, and to commence at or from fuch respective days and times, and to be paid and payable in fuch manner and form, as in this acl are afterwards exprefed: (that is to fay) whereas by an act made and passed in the ninth year of the reign of his late majefty King William the 9 & 10 W. 3. Third, of glorious memory, (intituled, An act for granting to his Majefty a further fubfidy of tonnage and poundage, towards raifing the yearly fum of feven hundred thousand pounds, for the service of his Majefty's houfhold, and other uses therein mentioned, during his Majesty's life) it was enacted, That ever and above the fubfidies, impofitions, and other duties therein mentioned, there fhould be raised and paid to his Majesty, one other fubfidy called tonnage, for and upon all wines which from and after the last day of January, in the year of our Lord one thousand fix hundred ninety and nine, at any time and times, during his Majesty's life, should be imported or brought into the kingdom of England, dominion of Wales, or town of Berwick upon Tweed; and one further fubfidy called poundage of all manner of goods and merchandizes imported or brought into this realm, or any his Majefty's dominions to the fame belonging, at any time or times after the faid laft day of January, one thousand fix hundred ninety nine, during his Majesty's life, by way of merchandize (except fuch goods and merchandizes as are therein excepted) and with fuch abatements, regulations, directions for making repayments or allowances upon exportation, and fubject to fuch rules and other matters and things touching the faid feveral fubfidies, as in the laft-mentioned act are expreffed: which faid further fubfidies of tonnage and poundage, and other duties upon wines, goods, and merchandixes, granted by the aft above recited, are to be raised and paid to her Majefty, during her life, by virtue of another act of parliament Annæ, ftat. made and passed in the first year of her reign, (intituled, An act for the better fupport of her Majefty's houthold, and the honour and dignity of the crown :) and whereas by an aƐt made and passed 2 & 3 Annæ, in the fecond year of her Majesty's reign, (intituled, An act for
