State's claim allowed March 6, 1908, and order made directing half of proceeds of sale of real estate to be applied upon State's claim. The real estate has not yet been sold. November 19th, 1909, received $109.07 in full settlement of state's share.

ASSUMPSIT CASES DISPOSED OF-Circuit Court of the United States, Western District of Michigan, Southern Division.

American Express Company v. Perry F. Powers (Auditor General). and Daniel McCoy (State Treasurer).

This was a suit by the American Express Company to recover moneys which had been paid to the state by that company for taxes assessed against its property by the state board of assessors for the year 1902, amounting to $12,944.67.

The plaintiff's claim was that the act creating the board of assessors was void and that the tax was irregularly and illegally levied against its property.

Stipulation was entered into August 20th, 1903, that, so far as the same questions were involved in this case as involved in the Michigan Railway Tax Cases, (subsequently decided, 201 U. S. 245), the final determination in those cases should be decisive of the same questions involved in this case.

On November 30, 1909, a stipulation was made dismissing the suit without costs.

Consolidated Coal Company v. Board of Trustees of the Michigan Employment Institution for the Blind. Saginaw circuit. Assumpsit to collect price of certain coal furnished the employment institution. Judgment entered in May, 1910 (carried to supreme court on error).

The People of the State of Michigan vs. The Bankers Surety Company. Ingham circuit. Assumpsit. Demurrer having been overruled by supreme court (158 Mich. 30), the surety company paid the penalty of its bond, $17,500.00 and this suit was discontinued by stipulation in February, 1910. (In re Chelsea Savings Bank).

The People of the State of Michigan vs. Federal Union Surety Company. Ingham circuit. Assumpsit. Demurrer having been overruled by the supreme court (158 Mich. 30), the surety company has paid $20,000.00 in three instalments, and through its representatives has agreed to pay the balance. (In re Chelsea Savings Bank).
