CRIMINAL CASES, IN THE SUPREME COURT, DISPOSED OF UP TO JUNE 30, 1901.

PEOPLE v. FRANK MORGAN.

Supreme court. Exceptions from circuit court, Cheboygan county. Defendant was convicted of murder in the second degree and brings exceptions. Submitted May 1, 1900. Submitted May 1, 1900. Reversed and new trial ordered

July 3, 1900. (83 N. W. 275; 124 Mich. 527.)

PEOPLE v. WILLIAM CONRAD ET AL.

Supreme court. Error to circuit court, Genesee county.

Defendants were convicted of unlawfully spearing fish and bring error. Submitted June 12, 1900. Reversed and respondents discharged October 31, 1900. (83 N. W. 1012; 125 Mich. 1.)

PEOPLE v. EDWARD ECARIUS.

Supreme court. Error to circuit court, Saginaw county.

Defendant was convicted of murder in the first degree and brings error. Submitted June 12, 1900. Affirmed September 13, 1900. (83 N. W. 628; 124 Mich. 616.)

PEOPLE v. JAMES CAREY.

Supreme court. Error to circuit court, Lapeer county.

Defendant was convicted of larceny and brings error. Submitted November 14, 1900. Affirmed January 29, 1901. (84 N. W. 1087; 125 Mich. 535.)

PEOPLE v. FRANK WEBB.

Supreme court. Error to circuit court, Kalamazoo county.

Defendant was convicted of conveying tools, etc., into jail to assist a prisoner to escape, and he brings error. Submitted February 15, 1901. Reversed and new trial ordered June 4, 1901. (86 N. W. 406.)

PEOPLE v. HENRIETTA ELIZA RHEINER.

Supreme court. Error and certiorari to recorder's court of Detroit. Defendant was charged with murder and acquitted by reason of insanity, but confined in the state asylum for criminal insane, at Ionia. Defendant's attorney filed assignments of error, praying that the order for detention in the asylum be set aside and defendant discharged. Stipulation for discontinuance of writ of error filed October 20, 1900, and writ dismissed October 29, 1900.

PEOPLE v. EDWARD ASCHER, ALIAS LOUIS LANG.

Supreme court. Error to recorder's court of Detroit.

Defendant was convicted of murder in the first degree and brings error. Submitted Febuary 15, 1901. Reversed and new trial ordered May 21, 1901. (86 N. W. 140.)

PEOPLE v. ARTHUR F. MARSH.

Supreme court. Exceptions from circuit court, Ingham county. Defendant was convicted of being an accessory and aiding and abetting, while inspector general, William L. White, while quartermaster general, in the crime of fraud, and embezzlement in office. After conviction and before sentence he removed the case to the supreme court, where it was submitted and argued November 14 and 15, 1900, but, pending the decision, the governor granted a pardon, which defendant. accepted, and then asked to have the case returned to the trial court, the trial court restrained from entering sentence on the conviction, and his sureties discharged, etc. A motion to dismiss appeal and stay proceedings in the circuit court was filed December 4, 1900, and argued and submitted December 11, 1900. Pardon declared valid, appeal dismissed and case remanded to the circuit court December 19, 1900. (84 N. W. 472; 125 Mich. 410.) See also note *.

PEOPLE v. HOWARD D. SMITH.

Supreme court. Error to recorder's court of Detroit.

Defendant was convicted of having in his possession a forged railroad passenger ticket with intent to defraud, and he brings error. Submitted December 4, 1900. Affirmed January 29, 1901. (84 N. W. 1068; 125 Mich. 566.) Motion for re-hearing denied February 27, 1901.

PEOPLE v. CHARLES L. BERNARD.

Supreme court. Error to circuit court, Van Buren county.

Defendant was convicted of assault with intent to murder, and he appeals. Submitted November 14, 1900. Affirmed January 29, 1901. (84 N. W. 1092; 125 Mich. 550.) Motion for re-hearing submitted March 13, 1901, and denied May 7, 1901.

PEOPLE v. DORNBOS (HENRY & GERRIT).

Supreme court. Error to circuit court, Ottawa county.

Defendants were convicted of having in their possession a number of lake trout of unlawful size, and they bring error. Submitted February 15, 1901. Affirmed June 17, 1901. (S6 N. W. 530.)

PEOPLE v. PETER VAN MAREN.

Supreme court. Exceptions from circuit court, Ottawa county. Defendant was convicted of illegally fishing in Grand river and brings exceptions. Submitted February 15, 1901. Affirmed February 27, 1901. (85 N. W. 240.)

PEOPLE v. HENRY LUDERS.

Supreme court. Exceptions from circuit court, Muskegon county. Defendant was convicted of retailing liquor without paying the special tax and brings exceptions. Submitted November 14, 1900. Affirmed May 7, 1901. (84 N. W. 1081.)

PEOPLE v. FRANK MARRS.

Supreme court. Exceptions from circuit court, Cass county. Defendant was convicted of assault with intent to commit rape, and brings exceptions. Submitted November 15, 1900. Reversed and a new trial ordered December 4, 1900. (84 N. W. 284; 125 Mich. 376.)

PEOPLE v. THEODORE BIRD ET AL.

Supreme court. Error to circuit court, Lenawee county.

Defendants were convicted of obtaining money on false pretenses and appeal. Submitted and argued February 14 and 15, 1901. May 21, 1901. (86 N. W. 127.)

PEOPLE v. CHARLES DOWD.

Supreme court. Error to circuit court, Allegan county.
Defendant was convicted of manslaughter and brings error.

Submitted

February 15, 1901. Reversed and a new trial ordered June 17, 1901. (86 N. W. 546.)

PEOPLE v. HORACE B. SEVERANCE.

Exceptions from circuit court, Ingham county. Defendant was convicted of having wilfully and maliciously destroyed and injured a building, and he appeals. Submitted November 15, 1900. Reversed January 29, 1901. (84 N. W. 1089; 125 Mich. 556.)

PEOPLE v. LUDGER CLEMENT.

Supreme court. Error to circuit court, Schoolcraft county. Defendant was convicted of an attempt to incite the crime of perjury, and he appeals. Submitted February 15, 1901. Affirmed June 17, 1901. (86 N. W. 535.)

PEOPLE v. THEODORE STRATTON.

Supreme court. Error to circuit court, Van Buren county. Defendant was convicted of larceny, and brings error. Submitted February 14, 1901. Reversed and defendant ordered discharged February 26, 1901. (85 N. W. 248.)

PEOPLE v. AUGUST G. REETZ.

Supreme court. Error to circuit court, Muskegon county. Defendant was convicted of practicing medicine without complying with act No. 237 of the public acts of 1899, entitled "An act to provide for the examination, regulation, licensing and registration of physicians and surgeons," etc. Submitted May 7, 1901. Affirmed June 4, 1901. (86 N. W. 396.) Writ of error to the United States supreme court, by defendant (there entitled Reetz v. People, page 13).

HABEAS CORPUS CASES, IN CIRCUIT COURT, DISPOSED OF UP TO JUNE 30, 1901.

IN RE MANN.

Circuit court, Jackson county. Application for writ of habeas corpus. Charles Mann, convict paroled from the State Prison at Jackson, violated the terms of his parole and was returned to prison. The principal question raised was as to the authority of the prison officials, under the circumstances, to forfeit all of his "good time." Came on for hearing September 17, 1900, when the petition was withdrawn from the circuit court and subsequently filed in the supreme court. (Forward to page 14.)
