The question then recurred on the resolution reported from the Committee of the Whole House; when

Mr. John Quincy Adams moved to amend the same by striking out these words, viz. "It being impracticable for this House to determine, with any certainty, who is the rightful Representative of said district;" which motion to amend was decided in the negative.

A motion was then made by Mr. Clayton to prefix to the said resolution the following preamble, viz.

Whereas, by the returns of the election for a Representative of the fifth congressional district in the State of Kentucky, it appeared that Robert P. Letcher had a majority of forty-nine votes; that the said election was contested by Thomas P. Moore, and the Committee of Elections, to which the same was referred, reported to this House that there was an election, and that Thomas P. Moore was elected by a majority of fortyfour votes of all the legal votes in said district: and whereas this House, by sundry resolutions, has added to and subtracted from the votes of each party in the following manner, to wit:

From the majority as reported by the committee, viz.

They have restored the votes given on the first day before Grant, 25 :

Whereby it appears that Robert P. Letcher received a majority of eleven votes of all the legal votes in said district: and whereas, in the face of these facts, the House has resolved that Robert P. Letcher is not entitled to his seat in this House: and whereas it appears, by motions now pending before this House, that sundry other votes are yet in controversy between the parties, and the House having stopped the investigation upon those votes which were alleged to have been illegally received by Thomas P. Moore.

And after debate thereon, Mr. Clayton withdrew the said preamble; when Mr. Garland renewed the same.

And on the question that the House do agree thereto,

Resolved, That there be a new election for a member of this House for the fifth congressional district of Kentucky, it being impracticable for this House to determine, with any certainty, who is the rightful Representative of said district.

The House then proceeded to the consideration of the engrossed bill (No. 132) for the relief of Edmund Brooke; when
