exhibition in such theatre, music hall or other public place of amusement, and the time and manner of such payment shall be prescribed by the commissioner of public safety. The moneys so paid for the services of said uniformed firemen shall be by the said commissioner of public safety paid to the uniformed firemen assigned to such duty by the chief engineer of the fire department and the same shall be full compensation for all such services. No theatrical performance, concert or other exhibition shall be given in any of said theatres, music halls or other places of amusement unless this section of this ordinance shall be strictly complied with and the moneys provided for the payment of the said uniformed firemen paid according to the direction of the said commissioner of public safety.

§ 4. The fire marshal of the City of Troy, with the approval of the mayor and commissioner of public safety, is hereby authorized and empowered to make such additional rules and regulations with respect to the places of public amusement referred to in this ordinance as in the judgment of the said fire marshal and said mayor and commissioner of public safety shall be wise, and all such rules and regulations, when so made and approved, shall be operative and effective as an ordinance of the City of Troy.

§ 5. It shall be the duty of the fire marshal of the City of Troy, upon the approval of the mayor and commissioner of public safety, and the said fire marshal is hereby authorized and empowered, with such approval, to cancel and revoke the certificate mentioned in the first section of this ordinance whenever and at any time when any act or thing shall be or shall have been done or omitted by the owner, lessee, manager or person in charge of any such places of amusement which would have prevented the issuing of such certificate if the same had been done or omitted before such certificate was issued.

§ 6. It shall be the duty of the fire marshal of the City of Troy, under the direction and supervision of the

commissioner of public safety, to inspect all theatres music halls and other places of public amusement in the City of Troy at least once in every three months, and the said fire marshal shall report in writing to the commissioner of public safety the results of such inspections.

§ 7. The owners, lessees, managers or other persons in charge of the places of public amusement referred to in this ordinance are hereby required to conform to and obey the following additional regulations, to wit:

I. To prevent any person from sitting in any aisle or passageway during a public performance and to prevent any person, other than an employee or police officer or uniformed fireman actually on duty, from standing in any part of the orchestra or in any balcony during a public performance except only in the rear of all the seats in the orchestra.

2. To have the fireproof or asbestos curtain provided for in the first section of this ordinance raised at the beginning of each performance, lowered between each act and lowered at the close of each performance.

3. To keep all doors unlocked during each perform

ance.

4. To maintain skylights above the stage provided with automatic lids which in case of fire will open of themselves so as to permit the escape of smoke, fire and gas.

5. To procure a new certificate as provided in section one of this ordinance annually.

6. To admit to such place of public amusement at any time, upon his request or demand, the fire marshal or commissioner of public safety or chief engineer of the fire department, or all of said officials, for the purpose of inspection and examination of the premises and to afford to them and each of them full opportunity for full examination thereof.

§ 8. The certificate provided for in the first section of this ordinance shall not be issued until the owner.

lessee, manager or other person in charge of such theatre, music hall or other place of public amusement shall have paid to the mayor for the use of the City of Troy the sum of fifty dollars hereby imposed as a license fee for the issuing of said certificate and the permission to conduct such theatre, music hall or other place of public amusement contemplated therein. The said license fee of fifty dollars shall be payable annually on the first day of January in each year and no such theatre, music hall or other public place of amusement shall present therein any theatrical or musical performance or other exhibition whatever until said license fee shall have been paid.

$ 9. In addition to all the conditions and penalties. imposed by this ordinance and the other ordinances of the City of Troy, it is hereby declared and provided that any violation of this ordinance shall be a misdemeanor, punishable as such.

§ 10. All ordinances and parts of ordinances contrary to or inconsistent with the provisions of this ordinance are hereby, to the extent to which they are so contrary to or inconsistent with the provisions of this ordinance and to that extent only, repealed.

§ 11. This ordinance shall take effect immediately.

AN ORDINANCE PROVIDING FOR THE PURCHASE OF THE NECESSARY LANDS BY THE CITY OF TROY AND FOR THE CONSTRUCTION AND ERECTION OF A Building THEREON TO BE USED AND OCCUPIED BY THE J. J. CHILD ENGINE COMPANY, No. II, AND FOR FURNISHING AND EQUIPPING THE SAME AND MAKING APPROPRIATION OF THE NECESSARY MONEYS THERE

Passed August 6, 1903. The City of Troy, in Common Council convened, does hereby ordain as follows:

SECTION I. That the commissioner of public works of the City of Troy be and he hereby is directed to acquire

and purchase for the City of Troy the necessary lands and real estate requisite for a proper and suitable building to be erected thereon and to be used and occupied by the J. J. Child Engine Company, No. 11, situated and described as follows:

All that piece or parcel of land situate at the northeast corner of Fifth avenue and Sixth street, North End, being fifty feet wide front and rear and one hundred and twenty feet in depth from said Fifth avenue, at a price not to exceed $3,000, as has been approved by the Board of Estimate and Apportionment of said City of Troy.

§ 2. That the report of the commissioner of public works this day made to the common council of the City of Troy for the purchase of the necessary land and real estate for the purpose of erecting a proper and suitable building thereon, as set forth in section I of this ordinance, be and the same is hereby approved and adopted, and the sum of $3,000, or so much thereof as may be necessary, is hereby appropriated and set aside for the purchase price of said land.

§ 3. That the board of contract and supply be and is hereby directed to cause said building to be erected and constructed on the land hereinbefore described and to be suitably furnished and equipped, and the sum of $21,375, or so much thereof as may be necessary, be and the same is hereby appropriated and set aside for that purpose. Said work to be done and supplies furnished under the direction and control of the commissioner of public works of the City of Troy.

§ 4. This ordinance shall take effect immediately.

§ 2. That the report of the commissioner of public works this day made to the common council of the City of Troy for the purchase of the necessary land and real estate for the purpose of erecting a proper and suitable building thereon as set forth in section 1 of this ordinance be and the same is hereby approved and adopted, and the sum of thirty-five hundred dollars or so much thereof as may be necessary is hereby appropriated and set aside for the purchase price of said land.

§ 3. That the board of contract and supply be and is hereby directed to cause said building to be erected and constructed on the land hereinbefore described and to be suitably furnished and equipped and the sum of twenty
