partment of the City of Troy, or a majority of them, to be proper and necessary for such building. Such fire escape or escapes shall be provided and erected on the outside of such building, connecting with each floor above the first, well fastened and secured and of sufficient strength, and each of which shall have landings or balconies not less than six feet in length and three feet in width, guarded by iron railings not less than three feet in height and embracing at least two windows at each story, and connecting with the interior by easily accessible and unobstructed openings, and the balconies or landings shall be connected by iron rails not less than eighteen inches wide, the steps not to be less than six inches tread, placed at a proper slant and protected by a well-secured hand rail on both sides, with a twelve inch drop ladder from the lower platform reaching to the ground.

But any other plan or style of fire escape shall be sufficient, if approved by the chief engineer and assistant engineers or a majority of them; but if not so approved the said chief engineer and assistant engineers, or a majority of them, must notify the owner, proprietor, lessee or occupant of such building, or the agent or superintendent, or either of them in writing, that such other plan or style of fire escape is not sufficient, and must, by an order in writing, served in like manner, require at least one fire escape, or more if they shall so deem it necessary, to be provided and erected for such building, at such locations, and of such plan and style as shall-be declared to be sufficient by the said engineer or assistant engineers or a majority of them, in the said notice. It is hereby declared to be the duty of the owner, proprietor, agent, or lessee or occupant of every such building, as is herein described, to provide such building with one or more fire escapes, as is herein directed after being notified so to do as hereinafter prescribed.

§ 2. The chief engineer and the assistant engineers of the fire department of the City of Troy, shall immediately after this ordinance shall take effect, make an in

spection of all the buildings in said city which come within the provisions of this ordinance, and, in all cases where such buildings are not already provided with such proper and necessary fire escapes as are prescribed by the laws. of this state or as are required by this ordinance, they shall promptly notify the owner, proprietor, lessee, agent or occupant of such building to provide and erect one or more fire escapes in such manner as to conform to the requirements of this ordinance within thirty (30) days from the service of such notice. Such notice in writing. or printing may be served personally or by depositing the same in the postoffice addressed to such person at his last known place of residence.

In case of the failure of any person to comply with such notice, it shall be the duty of the said chief engineer and assistant engineers to notify the corporation counsel of said city, in writing, of such failure, and to give him any and all such particulars as shall enable him to prosecute the offenders for the recovery of the penalties hereinafter prescribed.

It shall be the duty of the said chief engineer and assistant engineers to invite the co-operation and attendance of some officer of the factory inspection department of this state to make the aforesaid inspection with them, to the end that better security for life from fire in such buildings may be obtained and that the laws of this state as well as this ordinance upon said matter may be the better enforced. The chief engineer may call upon the clerk of the fire department for clerical aid in the discharge of the duties imposed upon him and the assistant engineers by this ordinance, and in such case it shall be the duty of said clerk to render such assistance.

§ 3. Any person who shall be guilty of any violation of this ordinance, or neglect to comply with its provisions, shall be, and is hereby, made subject to a penalty of fifty dollars ($50) for each and every week that may elapse after such failure to comply with such notice aforesaid, which penalty shall be sued for in an action brought in a

court of competent jurisdiction by and in the name of the City of Troy.

The word "person" used in this ordinance shall be held and construed to include firms, associations, and corporations.

§ 4. The ordinance passed July 16, 1885, entitled “A law for the better security of life from fire in hotels and other buildings," is hereby repealed.

§ 5. This ordinance shall take effect on the twentyfirst day of March, 1896.

AN ORDINANCE WITH REFERENCE TO THEATRES, MUSIC HALLS AND OTHER PUBLIC PLACES OF AMUSEMENT IN THE CITY OF TROY, AND TO SAFEGUARD The Lives OF PATRONS AND EMPLOYEES IN SAID THEATRES, MUSIC HALLS AND OTHER PLACES OF AMUSEMENT IN SAID CITY OF TROY.

Passed September 15, 1904.

The City of Troy, in Common Council convened, does ordain as follows:

SECTION I. It shall be unlawful for any owner, lessee, manager or other person in charge of any theatre, music hall or other place of amusement in the City of Troy to give or permit to take place therein any public theatrical or musical performance or other exhibition without first obtaining from the Mayor of the City of Troy a certificate specifying that the Fire Marshal has personally inspected such place of amusement and has found that all of the requirements of law and of the ordinances of the City of Troy have been fully complied with and observed.

§ 2. The mayor of the City of Troy shall not issue the certificate provided for in the first section of this ordinance unless all the laws of the State of New York and the ordinances of the City of Troy applicable to said place of amusement have been complied with and ob

served by the owner, lessee, manager or person in charge of said place of amusement and unless the following additional requirements shall have been complied with and observed by said owner, lessee, manager or person in charge, to-wit:

First. There shall be, capable of completely separating the stage from the auditorium, either a fireproof metal curtain or a curtain of asbestos mechanically adjusted to drop of its own weight and operated from the stage.

Second. There shall be at least three aisles from front to rear in the orchestra and in each balcony, and each side aisle shall be at least three feet wide at the end thereof next to the stage and at least four and one-half feet wide at the end thereof opposite the said stage end, and the said aisle shall broaden from the said stage end at said minimum width, to the said rear end at said minimum width, and each centre aisle shall be at least three and one-half feet in width at the stage end thereof and at least five feet in width at the end opposite the stage end thereof and the said aisle shall widen from the said stage end thereof to said minimum width to the said rear end thereof at said minimum width. There shall be no steps in any of said aisles but all thereof shall be either level or slanting without steps or other rises therein making anything in the nature of steps therein.

Third. There shall be a space of at least thirty-two inches between each row of seats.

Fourth. All exits shall be at least five feet in width and shall be so placed and arranged as to furnish safe and convenient means of exit from the different parts of such places of amusement, and the location, size and number of such exits shall be determined by the fire marshal of the City of Troy with the approval of the mayor of the City of Troy and it shall be the duty of all said owners, lessees, managers or other persons in charge of any such theatre, music hall or other place of

public amusement to conform to the requirements of said fire marshal as approved by the mayor with respect to all such exits.

Fifth. There shall be ample hose connections on the stage, in the orchestra and in each balcony, and suitable supply of hose at or near each hose connection.

Sixth. All doors shall open outwards.

Seventh. There shall be provided over each exit a small red light, which must be kept burning during the performance. The door to every exit must be unfastened, that is, neither hooked, locked, bolted nor fastened in any other manner, during every performance.

Eighth. No seats, chairs or obstructions whatsoever shall be allowed in any of the aisles in any such theatre, music hall or public place of amusement during any performance, concert or exhibition therein.

§ 3. It shall be the duty of every owner, lessee, manager or other person in charge of any theatre, music hall or other public place of amusement in the City of Troy to notify the chief engineer of the fire department of the City of Troy at least forty-eight hours in advance of any theatrical production, concert or exhibition in said theatre, music hall or other public place of amusement that such production, concert or exhibition is to take place and requesting that two uniformed firemen of the fire department of the City of Troy be assigned by said chief engineer to attend such production in uniform for the purpose of performing fire duty and service thereat. It shall be a condition upon which the certificate hereinbefore authorized to be issued shall be issued with respect to any theatre, music hall or other public place of amusement, that the owner, lessee, manager or other person in charge of such theatre, music hall or other public place of amusement shall pay to the commissioner of public safety of the City of Troy for the services of said uniformed firemen the sum of one dollar and fifty cents for each of said uniformed firemen for each performance, concert and
