tions in this section of this ordinance contained, shall forfeit and pay a penalty of two dollars, and the further penalty of two dollars for each and every forty-eight hours, he, she or they shall suffer or permit such stove pipe to remain otherwise than horizontally running into such chimney or flue, or such chimney built or constructed contrary to the provisions of this ordinance to remain after being directed in writing by any fire warden, fire engineer or member of the common council of said city, to remove or alter the same.

Unleached ashes shall be kept and deposited in vessels of iron or tin only, or in safe or secure ash houses of brick, stone or other incombustible materials; and every person who shall suffer or permit any unleached ashes to be or remain otherwise than is provided by this section of this ordinance in or upon the premises by him, her or them occupied or possessed, shall, for each and every such offense, forfeit and pay a penalty of five dollars.

§ 22. Every person using a trade by which shavings are made shall, at the close of each day, cause such shavings to be stowed in some safe and secure place, unless the same be already enclosed in some shop or other building having secure doors and windows; and every person doing otherwise shall for each and every offense, forfeit and pay a penalty of two dollars. No person in the first, second, third, fourth, seventh or eighth wards of said city shall set fire to or burn any straw, chips, shavings, or other combustible materials, in or upon any street or alley, or in or upon any vacant or other lot, within the distance of two hundred feet of any building; and every person offending in the premises shall, for each and every such offense, forfeit and pay a penalty of five dollars. Provided, however, that nothing in this section contained shall be construed to prevent any mechanic from such reasonable use of fire as may be necessary for carrying on their respective trades and business, otherwise than in the streets of said city.

§ 23. No lighted candle or lamp shall be carried into, placed in or used in any barn or stable in said city, unless the same be in a safe and secure lantern of tin, glass or horn, the door of which lantern shall be closed and fastened; and every person violating the prohibition in this section of this ordinance contained shall, for each and every such offense, forfeit and pay a penalty of three dollars.

§ 24. No person shall have, place, put or keep, within either of the first, second, third, fourth, seventh or eighth wards of this city, any hay, straw, hemp, flax or rushes, in a stack, rick or heap, within the distance of twenty rods from any dwelling house or other building; and every person offending in the premises shall forfeit and play a penalty of five dollars, and the further sum of five dollars for each and every forty-eight hours that such stack, rick or heap shall continue and remain after notice in writing given by any fire engineer, member of the common council, or fire warden, to remove the same.

§ 25 and § 26. [Repealed by ordinance passed September 19, 1839.]

KEEPING AND STORING OF GUNPOWDER. A LAW TO AMEND THE LAW ENTITLED “A LAW FOR THE PREVENTION AND EXTINGUISHMENT OF FIRES, AND A MORE EFFECTUAL ORGANIZATION OF THE FIRE DEPARTMENT OF THE CITY OF TROY."

Passed September 19, 1839.

The Mayor, Recorder, Aldermen and Commonalty of the City of Troy, in Common Council convened, do ordain as follows:

SECTION 1. No person or persons shall keep, or have, or suffer or permit to be kept in any store, building or place by him, her or them owned or occupied, in this city, any greater quantity of gunpowder than twenty-eight

pounds, without a license for that purpose from the mayor, or in his sickness or absence, the recorder three members of the common council, nor any quantity of gunpowder unless the same be placed and kept in safe, tin, horn, or stone vessels, or cannisters, or in glass phials or bottles, containing not more than seven pounds each, without such license as aforesaid; nor shall any person or persons carry or convey, or transport by teams, wagons, horses or otherwise, any greater quantity of gunpowder at one time than twenty-eight pounds in any part of the City of Troy, without such license and under such regulations as the mayor, recorder or members of the common council granting such license shall prescribe in said license; and any person violating either of the provisions of this law shall, for each and every such violation, forfeit and pay a penalty of fifty dollars.

§ 2. No master navigating or having the charge, command or control of any sloop, scow, boat, or other vessel, laden in whole or in part with gunpowder, shall suffer or permit such sloop, scow, boat, or vessel, to lay, be or remain at any of the wharves, or slips or within the distance of two hundred and fifty feet of the east shore. of the Hudson river, in any part of said city, without a written license therefor from the mayor, or in his sickness and absence, recorder or three members of the common council, which license shall particularly specify the time when, the place where, and the circumstances under which the said sloop, scow, boat, or other vessel, so laden, in whole or in part, shall remain; and every person offending in the premises shall forfeit and pay a penalty of twenty-five dollars, and a further penalty of twenty-five dollars for each and every hour which such master, or other person, shall suffer or permit any such sloop, scow, boat, or other vessel, to lay, be or remain contrary to the prohibition in this section contained after being notified in writing to remove the same by any member of the common council, fire engineer or other fire warden of said city.

§ 3. The twenty-fifth and twenty-sixth sections of the law hereby amended are hereby repealed.

A LAW RELATIVE TO THE FIRE DEPARTMENT.

Passed October 15, 1846.

The Mayor, Recorder, Aldermen and Commonalty of the City of Troy, in Common Council convened, do ordain as follows:

SECTION 1. Any person not a member of the fire department of the City of Troy, or not an exempt fireman of said department, who shall take hold of, seize, or attempt to take hold of or seize, the tongue or dragropes of any fire engine, hose cart, or hook and ladder cart, or wagon, belonging to the City of Troy, or the fire department of said city, during any alarm of fire, or during any fire, and run or walk with or attach themselves to any such fire engine, hose cart, or hook and ladder cart, or wagon, as aforesaid, during any such alarm, or returning from any fire as aforesaid, or who shall in any way interfere or meddle with any such fire engine, hose cart, or hook and ladder cart, or wagon, as aforesaid, on any of the occasions aforesaid, or who shall go into or enter upon any of the buildings in the said City of Troy where any such fire engine, hose cart, or hook and ladder cart, or wagon, as aforesaid, is, or shall, or may be kept or deposited, and shall draw or take out, or assist in drawing or taking out, or attempt or endeavor to draw or take out, of any such building, as aforesaid, any such fire engine, hose cart, or hook and ladder cart, or wagon, as aforesaid, without the direction or permission of the mayor, chief or any assistant engineer of the said fire. department of the said city of Troy, shall forfeit and pay a penalty of ten dollars.

A LAW RELATIVE TO THE BUILDING AND PROPERTY PERTAINING TO THE FIRE DEPARTMENT OF THE CITY OF TROY, AND TO PUNISH VIOLATIONS OF LAWS AND ORDINANCES OF SAID CITY.

Passed January 15, 1852.

The Mayor, Recorder, Aldermen and Commonalty of the City of Troy, in Common Council convened, do ordain as follows:

SECTION I. No person not a member of a fire company or of the fire department, or a member of the common council, or justice of the peace, constable, city marshal, or a member of the night police of the said city, shall enter any fire engine house, or building used by any fire company, or any other building connected with the fire department.

§ 2. No member of a fire company or of the fire department shall deliver to any person, not allowed by the preceding section of this ordinance to enter such house or building, or suffer such person to take any key in his possession or under his control, belonging to such house or building, or which will unlock the same, and no person shall receive from any such member of a fire company or of the fire department any such key with a view. of entering or unlocking any such house or building, or enabling any other person to unlock or enter the same, who has no right to enter therein.

§ 3. All assemblages of persons having no right to enter such house or building, in or near such house or building, without just and necessary cause, are hereby prohibited.

§ 4. All persons, not excepting persons belonging to the fire department, or officers of the city government, are hereby prohibited from entering or being in any such house or building for the purpose of amusement, or play of any description, or from engaging in any such play or amusement therein.
