viction thereof before the police magistrate of the said city, be punished by a fine not exceeding five dollars, or by imprisonment in the county jail, at hard labor or not, in the discretion of such police magistrate, for a period not exceeding five days, or both such fine and imprison

ment.

All ordinances heretofore passed, inconsistent with this act, are hereby repealed.

AN ORDINANCE REQUIRING PROPERTY OWNERS ALONG THE PUBLIC STREETS IN THE CITY OF TROY TO CAUSE THEIR HOUSES TO BE NUMBERED.

Passed June 16, 1887.

The City of Troy, in Common Council convened, does hereby ordain as follows:

SECTION 1. It shall be the duty of the several property owners along and upon the public streets, alleys, avenues and highways in the City of Troy, to cause their houses fronting on such streets, alleys, avenues and highways to be properly and conspicuously numbered with suitable and appropriate figures, in accordance with the directions of the city engineer, who is hereby charged with the duty of prescribing a uniform method of numbering the residences within this city. The said numbering shall be done and completed within three months from and after the passage of this ordinance.

§ 2. Any such owner or owners who shall neglect or refuse to so number his or their house or houses shall forfeit and pay to the City of Troy the penalty of five dollars, to be sued for and collected in the name of the said city against the person or persons so offending.

83. This ordinance shall take effect on the first day of July, 1887.

A LAW RELATIVE TO THE USE OF THE PUBLIC STREETS, AROUND THE SOLDIERS' AND SAILORS' MONUMENT IN WASHINGTON SQUARE, AND FOR THE PROTECTION OF THE PROPERTY AND GROUNDS AROUND SAID MONUMENT.

Passed May 19, 1892.

The City of Troy, in Common Council convened, does hereby ordain as follows:

SECTION I. It shall not be lawful for any person, firm, association or corporation to erect, place or maintain any stand, tent or other article upon the sidewalks and roadway of the following streets, to-wit: Broadway, between Second and River street; Second street, between Broadway and River street, and River street, between Broadway and Second street, or upon the triangular plot of ground bounded by the said streets, for the purpose of the selling or exposing fruits, candies, peanuts or goods, wares or merchandise of any kind whatsoever or to seil the same in the places aforesaid. No license shall be issued and no permission shall be granted by any officer of the City of Troy authorizing the sale in the manner aforesaid of any articles upon the said streets and ground.

§ 2. It shall be unlawful for any person to deface, smear, daub, write upon, injure, cut or break the stone coping erected about the said monument, or to walk or run upon the same, or to trespass on the grounds between said coping and the monument, or to despoil the said grounds or injure or tear out any grass or flowers thereon, or to place or throw any paper, offal, rags, sweepings, rubbish or articles of any kind in or upon said grounds or coping.

§ 3. It shall not be lawful for any person to stand with or permit to remain any horse, team, cart, wagon or other vehicle owned by him or under his control, upon the sidewalks or roadway of either of the streets above mentioned between the points above named, except for such

reasonable time as may be necessary in the actual loading or unloading of goods into or from such cart, wagon or other vehicle.

§ 4 Any person who shall violate any of the foregoing prohibitions or provisions shall, upon conviction of such offense by or before the police magistrate or the police court of the City of Troy, be punished by a fine of not less than five dollars, nor exceeding thirty dollars or by imprisonment in the county jail of Rensselaer county for not less than five days, nor more than thirty days, or by both such fine and imprisonment in the discretion of such magistrate or court.

§ 5. It is hereby made the duty of the city superintendent and also of the police force of the City of Troy to see that this ordinance is strictly enforced and that all persons guilty of a violation thereof are arrested and prosecuted.

§6. This ordinance shall take effect immediately.

A LAW RELATIVE TO THE USE OF THE PUBLIC STREETS IN THE CITY OF TROY WHICH ARE OR MAY BE PAVED WITH ASPHALT, AND TO PROVIDE FOR THE PreserVATION OF SUCH PAVEMENT.

Passed July 18, 1895.

The City of Troy, in Common Council convened does hereby ordain as follows:

SECTION I. It shall not be lawful for any person to carry or convey any petroleum, rock oil, earth oil, or kerosene, whether the same be crude or refined, upon or along any of the public streets in the City of Troy which are now or which may hereafter be paved with the pavement commonly known as asphalt, by means of any wagon, barrel, can, oil holder, or vessel of any kind which, or the device, opening or faucet to which, shall be in such a defective or leaky condition that the contents of any such vessel

shall drip or fall upon such pavement; nor shall any person throw, deposit or draw off, or permit any one under his control, or in his employ, to throw, deposit or draw off any such oil on to any such pavement, nor shall any person in dealing out or measuring any of such oils permit any of the same to drop on to the pavement; nor shall any person throw or deposit, or permit to be thrown or deposited or run any oil, acid or other liquid, which has a tendency to eat into or disintegrate the wearing surface of any such pavement.

§ 2. No person shall start or keep up any bonfire, or other fire, upon any street which is now or shall hereater be paved as mentioned in section one of this ordinance, nor shall any person permit any fire to be started or kept up upon any street which is now or shall be so paved in front of any premises owned or occupied by him.

§ 3. No person shall slack, mix or deposit any lime, or cause any lime to be slacked, mixed or deposited, whether with or without any other substances, upon any street which is now or shall hereafter be paved with asphalt; and no person being the owner, occupant or having charge or control of any lot or building abutting upon any such street, shall permit any lime to be slacked, mixed or deposited, whether with or without any other substances, in front of such lot or building, unless the same be done in a box, article or vessel which shall be water tight; and so that none of the contents thereof shall run or escape on to such pavement.

Sec. 4. It shall be the duty of the police officers of the City of Troy to enforce this ordinance, and to arrest and present for trial all persons guilty of a violation thereof.

§ 5. Any person guilty of a violation of any of the provisions of sections one and two of this ordinance shall, upon conviction thereof, in the police court of the City of Troy, be punished for each offense by a fine of not less than ten dollars, nor more than twenty-five dollars, or

by imprisonment, in the county jail for not less than ten days, nor more than twenty-five days, or by both such fine and imprisonment, in the discretion of the court or magistrate; and any person who shall be guilty of a violation. of any of the provisions of section three of this ordinance shall, upon conviction thereof, in the said court, be punished for each offense by a fine of not less than ten dollars nor more than twenty-five dollars or by imprisonment in the said jail for not less than ten days nor more than twenty-five days or by both such fine and imprisonment in the like discretion; and each day that lime shall be slacked, mixed or deposited contrary to the provisions of section three shall be considered as a separate offense. The imposition of any such fine or imprisonment, or both, shall not be taken to in any manner waive or prejudice any right of the City of Troy to bring a civil action against any person who shall have caused injury or damage to any street paved or which shall be paved as mentioned in this ordinance, to recover for such injuries. or damages.

§ 6. The word "street" as used in this ordinance shall be held to include "avenues," "alleys" and "highways," and for the purposes of the enforcement of this ordinance the word "person" shall be held to embrace and be coextensive with the officers, directors, agents and servants of any corporation or company which shall be guilty of any violation of this ordinance.

$7. The ordinance on this subject adopted October 4, 1893, is hereby repealed, but such repeal shall not affect any offense committed and the punishment prescribed therefor prior to the time of the taking affect of this ordinance, and such offense so committed shall be punishable as provided in the said ordinance.

§ 8. This ordinance shall take effect immediately.
