der the public feal, of all laws, ftatutes, and ordinances, that are now made and in force, or which fhall be made and enacted within our faid in nd, unto us and our commiffioners for trade and foreign plantations, within three months, or fooner, after their being enacted, together with duplicates thereof by the next conveyance, upon pain of our higheft difpleafure, and of the forfeiture of that year's falary, wherein you thall, upon any pretence whatfoever, omit to fend over the faid laws and ordinances as aforefaid within the time above limited.

Our will and pleasure is, that no act or order be paffed within that our inland, in any cafe for levying money or impofing fines and penalties, whereby the fame thall not be mentioned to be referved to us, our heirs and fucceffors, for the public ufe of that our ifland, and fupport of the government, as by the faid act or order fhall be directed.

And we do particularly require and command, that no money or value of money whatsoever be given or granted by any act or order of affembly to our chief-governor, lieutenant-governor, or commander-in-chief, of our faid ifland, which fhall not, according to the ftile of acts of parliament in England, be mentioned to be given and granted unto us, with the humble defire of fuch affembly, that the fame be applied to the use and behoof of fuch governor, lieutenant-governor or commander-inchief, if we shall fo think fit; or, if we should not approve of fuch gift or application of faid money or value of money, it be then difpofed of and appropriated to fuch other ufe as in the faid act or order fhall be mentioned; and that, from the time the fame fhall be raised, it remains in the hands of the receiver of that our island until our royal pleasure shall be known therein.

You are not to permit any claufe to be inferted in any law for levying money or value of money, whereby the fame fhall not be accountable unto us here in England, or to our commiffioners of our treasury, or our high treasurer for the time being.

And you are alfo to take care that fair books of accounts be duly kept, upon oath, of all the receipts and payments thereof, which fhall be transmitted here half yearly or oftener, with duplicates thereof by the next conveyance, to the end that a due account may be rendered of the fame, and of the right application thereof unto our faid commiffioners of our treasury, or our high treasurer for the time being.

You

You are not to fuffer any public money whatsoever to be iffued or difpofed of otherwife than by warrant under your hand by and with the advice and confent of the council, and not otherwife; but you may neverthelefs permit the aflembly, from time to time, to view and examine the accounts of all money, or value of money, difpofed of by virtue of laws made by them; which you are to fignify unto them as there thall be occafion.

Our will and pleasure is, that all laws whatfoever for the good government of our faid ifland be made indefinite, and without limitation of time, except the fame be for a temporary end, which fhall expire and have its full effect within a certain time; and therefore you fhall not re-enact any law which fhall be enacted by you, except upon very urgent occafions, but in no cafe more than once, without our express confent.

Our further will and pleafure is, that you do not permit any act or order to pafs in that our ifland, whereby the price or value of current money within the government may be altered, without our particular leave or order for the fame; and you are, upon your arrival in Jamaica, to confider what may be fit to be propofed unto us for the fettling the current coin of that ifland.

And you are particularly not to pafs any law, or to do any act by grant or otherwife, whereby our revenue may be leffened or impaired, without our efpecial leave or commands therein."

You fhall not remove any fines or forfeitures whatsoever, above the fum of ten pounds, before or after fentence given, nor difpofe of any efcheats, until you fhall firft have fignified unto us the nature of the offence, or occafion of fuch fines, forfeitures, or efcheats, with the particular fums or value thereof, which you are to do with all speed unto our commiffioners of our treasury, or high treasurer, for the time being, until fhall have received our directions therein; but you may in the mean time fufpend the payment of fuch fines and forfeitures.

You are to take the moft effectual care for the discovery of our quitrents, and for the making a perfect rent-roll of the fame, by impowering our receiver-general to administer an oath to all fuch as he fhall account with, what other lands they may have, either in their own right or in right of others, unaccounted for, or by fuch other means as you, with the advice aforefaid, fhall think most conducing to this service.

In cafe any goods, money, or other eftate, of pirates, or piratically taken, fhall be brought in or found within our faid ifland of Jamaica, or taken on board any thips or veffels, you are to caufe the fame to be feized and fecured in the hands of our officers, until you fhall have given us an account thereof, and received our pleafure concerning the difpofal of the fame.

You are to require the fecretary of the ifland, or his deputy, for the time being, to furnish you with all fuch acts and public orders as fhall be made from time to time, together with a copy or journal of the council, to the end the fame may be tranfmitted unto us as above directed; which he is duly to perform, upon pain of incurring the forfeiture of his office.

You fhall not displace any of the judges, juftices, or other officers or minifters, within our faid ifland, without good and fufficient caufe fignified unto us, and our committee for trade and plantations; and, to prevent arbitrary removal of judges and juftices of the peace, you are not to exprefs any limitation of time in the commiffions which you are to grant, with the advice and confent of the council, to fit perfons for those employments, nor thall you execute yourself, or by deputy, any of the faid offices, nor fuffer any perfon to execute any more offices than one by deputy.

You shall not erect any court or office of judicature, not before erected or established, nor diffolve any court or office already erected or cftablithed, without our efpecial order; and therefore you are to transmit unto us, with all convenient speed after your arrival, a particular account of all establishments of jurifdictions, courts, offices, and officers, powers, authorities, fees, and privileges, granted and fettled within our faid island, to the end you may receive our efpecial directions therein

You are likewife, with the advice and confent of the council, to regulate all falaries and fees belonging to places, or paid upon emergencies, that they may be within the bounds of moderation, and that no other exaction be made on any occafion whatsoever.

We do thereby require and command, that no man's life, member, or freehold, or goods, be taken away or harmed under your government, but by established and known laws, not repugnant to, but as much as may be agreeable with, the laws of our kingdom of England.

You

You fhall adminifter the oaths appointed by act of parliament to be taken instead of the oaths of allegiance and fupremacy, and the teft, to the members and officers of the council and affembly, all judges and justices, and all other perfons that hold any office in that ifland by virtue any patent under our great feal of England, or our feal of Jamaica.

You are to permit a liberty of confcience to all perfons except papists, fo they be contented with a peaceable and quiet enjoyment, not giving offence or fcandal to the government.

You fhall take care planters and christian fervants be well and fitly provided with arms, and they inlifted under officers, and as often as fhall be thought fit mustered and trained, whereby they may be in a better readinefs for the defence of our faid ifland and territorics under your command.

And you are to use your utmost endeavours that each planter do keep fuch a number of white fervants as by law is directed, and that they appear in arms at all fuch times as they fhall be required.

And you are to take efpecial care that neither the frequency nor unreasonableness of remote marches, mufters, and trainings, be an unneceffary impediment to the affairs of the planters,

You fhall take an inventory of all arms, ammunition, and ftores, remaining in any of our magazines or garrifons in our faid island under your command, and fend an account of them forth with after your arrival, and forward yearly unto us and our committee for trade and plantations.

You shall likewise demand an account from our prefident and council how the arms, ammunition, and ftores, fent from the office of our ordnance, in this our kingdom, or bought by any public money, have been employed; and whether any of them, and how many, have been fold, fpent, loft, decayed, of and to whom and to what uses; and, for your better information therein, you fhall herewith receive an account of what hath, fince the month of December, 1676, been iffued out or fent from the office of our ordnance.

And, that we may be the better informed of the trade of our faid island,

you

ou are to take efpecial care that due entries be made in all parts thereof, of all goods and commodities, their fpecies and quantities, imported or exported, with the names, burthens, and guns, of all fhips coming and going from the faid ifland, which the naval officer is to furnish you withal; and you are to tranfmit the fame unto us, or to our high treasurer or commiffioner of our treafury for the time being, and to our committee for trade and plantations, quarterly, and duplicates thereof by the next conveyance.

You fhall take efpecial care that God Almighty be devoutly and duly ferved throughout your government, the book of common prayer, as by Jaw eftablished, read each Sunday and holiday, and the bleffed facrament administered according to the rites of the church of England.

You fhall be careful that the churches already built there, fhall be well and orderly kept, and more built as the colony fhall, by God's bleffing, be improved; and that, befides a competent maintenance to the minifter of each orthodox church, a convenient house be built at the common charge, for each minifter, and a competent proportion of land affigned to him for glebe and exercite of his induftry: and you are to take care that the parishes be limited and fettled, as you shall find most convenient for the accomplishing of this good work.

Our will and pleasure is, that no minifter be preferred by you to any ecclefiaftical benefice, without a certificate from the right reverend father in God, the bifhop of London, of his conforming to the doctrine and difcipline of the church of England; and alfo, our pleasure is, that you give order forthwith, if the fame be not already done, that every minifter within your government be one of the vettry in his refpective parish, and that no veftry be held without him, except in cafe of ficknefs, or that, after notice of a veftry fummoned, he abfent himself.

And you are to enquire whether there be any minifter within your government that preaches and adminifters the facrament in any orthodox church, without being in due orders, whereof you are to give an account to the faid bishop of London; and you are to endeavour, with the affiftance of the council, that good and fufficient ftipends and allowances be made and afcertained unto the minifters of every parith within your government; and, to the end the ecclefiaftical jurifdiction of the faid

bishop.
