The House met pursuant to adjournment.

Prayer by the Rev. Dr. Huntington.

The minutes of Saturday were read and approved.

Messrs. Spencer and Hopkins, a select committee from the Senate, appeared, and announced that that body had elected the Hon. A. B. Dickinson, president pro tem.

Mr. Littlefield, from the committee on engrossed bills, reported as correctly engrossed the bills entitled as follows, to wit: "An act for the relief of Royal T. Alvord." "An act for the relief of Thomas Wiltsie."

"An act to erect the town of Horseheads, from the town of Elmira, in the county of Chenango."

"An act in relation to the Utica and Black River railroad company, empowering it to apply for appraisal of land damages, on certain conditions."

"An act in relation to the Ogdensburgh, Clayton and Rome railroad company, to empower them to apply to the courts for commissioners of appraisal, &c., on line of road from Rome to Ogdensburgh."

"An act to amend chapter 172, Laws of 1826, entitled 'An act to incorporate the Ovid academy, and for other purposes.""

Mr. Burnett presented the petition of sundry inhabitants of Essex courty, for an appropriation to remove obstructions in Minerva creek and Trout brook in said county, which was read and referred to the committee on commerce and navigation.

Mr. Burnett presented the memorial of certain citizens of Essex co., praying for the appointment of A. P. Morse, to fill the office of commissioner, &c., rendered vacant by the decease of Edward Talbott, which was read and referred to the committee on the internal affairs of towns and counties.

Mr. Freeman presented the petition of the Medina and Alabama plank road company for an act to abandon their road, which was read and referred to the committee on roads and bridges.

Mr. Gibbs presented the petition of James M. Warner, for relief, which was read and referred to the committee on claims. Mr. Scott presented the petition of Ezekial A. Durmont, and other lock tenders on the Seneca & Cayuga canal, for redress, which was read and referred to the committee on canals.

Mr. Lozier presented three petitions of citizens of Allegany, Steuben and Livingston counties, for a new county from parts of said counties, which were read and referred to the committee on the erection and division of towns and counties.

which were read and referred to the committee on the erection and division of towns and counties.

Mr. Gibbs presented the remonstrance of inhabitants of Mount Morris, against the division of the county of Livingston, which was read and referred to the committee on the erection and division of towns and counties.

Mr. Williams presented the petition of 178 legal voters of the town of Woodhull, in Steuben co., for a division of said county, with the county buildings at Addison, and remonstrating against confirming the acts of the commissioners appointed to locate the public buildings in the southern jury district in said county, which was read and referred to the committee on the judiciary. Mr. Kirkland presented the petition of supervisors and other officers of the county of Cattaraugus, for a prohibitory liquor law, which was read and committed to the committee of the whole.

Mr. Neilson presented the petition of Catharine A. Winslow and others, for a law changing the name of William S. Winslow, to William S. Waterman, which was read and referred to the committee on the judiciary.

Mr. Mosely Hutchinson presented the petition of a committee appointed by the board of supervisors of Cayuga co., to sell the real estate and other property belonging to the poor fund of said county, which was read and referred to the committee on the internal affairs of towns and counties.

Mr. Lozier, from the committee on the internal affairs of towns and counties, to which was referred the petition of inhabitants of the town of Lenox, Madison co., to be authorised to raise money for road purposes, reported, and asked and obtained leave to introduce a bill entitled "An act to authorise the town of Lenox to raise money by tax for road purposes," which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

Mr. Mitchell, from the committee on claims, to which was referred the petition of Henry Dygert, praying for relief for loss of canal boat and furniture, reported in writing, and asked and obtained leave to introduce a bill entitled "An act for the relief of Henry Dygert, for the loss of a canal boat and property," which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

Mr. Harris, from the committee on militia and public defence, to which was referred the bill entitled "An act for the better or ganization of the uniformed militia in Richmond co.," reported that the committee had examined said bill, and saw no reason why the same should not be passed into a law.

Ördered, That said bill be committed to the committee of the whole.

Mr. Lozier, from the committee on the internal affairs of towns and counties, to which was referred the Senate bill entitled "An

act to amend an act entitled 'An act for the better support of the poor in the town of Newburgh, in the county of Orange,' passed March 23, 1854," reported that the committee had examined said bill, and saw no reason why the same should not be passed into a law.

Ordered, That said bill be committed to the committee of the whole.

Mr. Mitchell, from the committee on claims, to which was referred the petition of Moses W. Lester, praying for relief, reported in writing, and asked and obtained leave to introduce a bill entitled "An act for the relief of Moses W. Lester," which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

Mr. Lozier, from the committee on the internal affairs of towns and counties, to which was referred the bill entitled "An act to amend an act entitled 'An act in relation to the accounts of town officers,' passed May 14, 1840," reported that the committee had had said bill under consideration, and come to the conclusion that the same ought not to be passed into a law, which report was agreed to.

Mr. Speaker presented the third annual report of the trustees of the State asylum for idiots.

Resolved, That 2,000 copies of the annual report of the trus tees of the State asylum for idiots, be printed for the use of the Legislature, and 500 copies for the trustees and superintendent.

Ordered, That said resolution be referred to the committee on public printing.

The Senate bill entitled "An act for the relief of the Lockport and Cambria plank road company," was read a third time.

Mr. Speaker put the question whether the House would agree to the final passage of said bill, and it was determined in the affirmative, a majority of all the members elected to the Assembly voting in favor thereof, as follows:

The bill entitled "An act to provide for an additional justice of the peace in the town of Ellisburgh, in the county of Jefferson," was read a third time.

Mr. Speaker put the question whether the House would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Assembly voting in favor thereof, as follows:

The bill entitled "An act in relation to the Black River and Utica railroad company, empowering it to apply for appraisal of land on complying with certain conditions," was read a third time.

Mr. Speaker put the question whether the House would agree to the final passage of said bill, and it was determined in the affirmative, a majority of all the members elected to the Assembly voting in favor thereof, as follows:
