PUBLIC ACTS OF 1926

EXTRA SESSION

PUBLIC ACTS

[No. 1.]

AN ACT to authorize the proper state officers to contract on behalf of the state of Michigan with the Detroit, Grand Haven and Milwaukee Railway Company for the surrender of its special charter, for the acquiring and improving by the state of property for a new right of way for said railway company, including station grounds and facilities at Birmingham, and the exchange thereof for said railway company's present right of way adjacent, or in close proximity to, state trunk line road number ten between said railway company's mile posts number thirteen and twentytwo and one-tenth in Oakland county, Michigan, and for the reimbursing of the state by said railway company of the cost of acquiring and improving said new right of way; and to provide for the carrying out of the terms and conditions of said contract.

The People of the State of Michigan enact:

SECTION 1. Whereas, the Detroit, Grand Haven and Milwaukee Railway Company is a corporation organized, existing and doing business in the state of Michigan under a special charter consisting of the act of March seven, eighteen hundred thirty-four, of the territorial legislature of Michigan, and acts amendatory and supplementary thereto, and claims privileges and immunities thereunder, certain of which, viz., tax limitations whereby said company pays only twenty-five thousand one hundred seventy-one dollars and forty cents a year in taxes, has been adjudged by the courts of last resort to be binding in perpetuity, and

Whereas, the state of Michigan has for many years desired to obtain a surrender of said special charter by said Detroit, Grand Haven and Milwaukee Railway Company and to have said company incorporate under the general railroad laws of the state, whereby it would pay a specific tax for the benefit of the primary school fund on the same basis as other railroad companies in this state are taxed, and

Whereas, the state of Michigan also desires to obtain the railroad right of way of the said Detroit, Grand Haven and Milwaukee Railway Company from Royal Oak (its mile post number thirteen) to a point between Birmingham and Pontiac (its mile post number twenty-two and one-tenth) in Oakland county, Michigan, hereinafter referred to as the old right of way, for the widening and improving of state trunk line road number ten, also known as Woodward avenue, and
