said colored person was so received in any of said stages or
steam boats; and upon conviction thereof shall be fined in
a sum not less than two nor more than five hundred dollars,
and be imprisoned not less than three nor more than six
months; and moreover, shall be liable to an action of tro-
ver at the suit of the owner or owners of any slave or
slaves so received and carried without the aforesaid pre-
mission.

CHAPTER IV.

An Act to establish a precinct election at the house of Robert Huddleston, in Grainger county.

SECTION 1. Be it enacted by the General Assembly of the State of Tennessee, That a precinct election be established at the house of Robert Huddleston, in Grainger county, to vote for Governor, members to Congress, members to the State Legislature, for Convention, and Electors to vote for President and Vice President of the United States.

SEC. 2. Be it enacted, That in the county of Williamson there shall be and is hereby established a precinct election for Governor, members to Congress, members to the State Legislature and for Convention, at the dwelling house of Ephraim Brown, on the plantation upon which he now Wilson county. lives and that the sheriff of the county of Williamson, shall hold elections at the said place in the same way and manner and under the same rules and regulations that elections are and have been holden in said county, at other precinct elections.

CHAPTER V.

An Act making it the duty of chairmen of the county courts to appoint registers pro tempore to fill vacancies happening in the recess of court.

SECTION 1. Be it enacted by the General Assembly of the State of Tennessee, That hereafter, whenever a vacancy shall occur in the office of register in any county within the State of Tennessee during the recess of the county court, it shall be, and is hereby made the duty of the chairGlances man of the county court, in which such vacancy may take place, forthwith to appoint a register pro tempore to fill said vacancy, who shall take the oath and give the bond prescribed by law for county registers.

SEC. 2. Be it enacted, That the person so appointed, shall hold said office until the second day of the succeeding term of the county court in the county where such vacancy may happen, and have and exercise all the duties of register, and shall be entitled to receive and collect the same fees for services by him performed, as may be allowed by law to registers regularly appointed by the county court.

SEC. 3. Be it enacted, That all acts and proceedings done and performed by said register, shall be as binding and valid as if the same had been done and performed by a register regularly appointed by the county court of the county in which such pro tempore appointment was made. SEC. 4. Be it enacted, That the person so appointed shall Liable to be be liable and may be proceeded against for neglecting or proceeded against. refusing to perform any of the duties, now by law required by a county register to be performed and observed, in the same manner as if he had been appointed by the county

CHAPTER VI.

An Act giving further time for surveying lands north and east of the congressional reservation line, and north of Tennessee river, and for other purposes.

Be it enacted by the General Assembly of the State of Tennessee, That the further time of two years be allowed to make surveys, return plats and certificates, and to obtain grants on all entries made under the acts of 1823 and 1824,

allowing vacant land to be entered at twelve and one half cents per acre, and also an act of 1825, authorising land to be entered at one cent per acre; also the acts of 1827 and 1829-30 and 1831, providing for the entry of land north and east of the congressional reservation line and north of Tennessee river.

CHAPTER VII.

An Act to prescribe the duties of Justices of the Peace.

Be it enacted by the General Assembly of the State of Tennessee, That hereafter it shall be lawful for any officer in whose hands any claim or claims are put for collection, to apply to any justice of the peace for a warrant on said claims, and it shall be the duty of said justice to issue the same without any order in writing from the plaintiff-Provided, said officer shall first produce the claim to said justice on which he wishes the warrant to be issued.

CHAPTER VIII.

An Act giving further time to the enterers and purchasers of land in the Hiwassee district to obtain their grants.

Be it enacted by the General Assembly of the State of Tennessee, That the purchasers and assignees of purchasers and enterers, and assignees of enterers of land in the Hiwassee district shall have the further time of two years to obtain their grants for the same, from and after the passage of this act-Provided, this act shall not extend to entries made south of the treaty line of 1819, between the United States and Cherokee Tribe of Indians, as the same has been run by the commissioners.

CHAPTER IX.

An Act to establish a precinct election at Halifax, in the county of Wilson.

Be it enacted by the General Assembly of the State of Tennessee, That the store house belonging to James Somers, Esq. in the county of Wilson, called Halifax, be, and is hereby established a precinct, at which the people shall be entitled to vote for Governor, members of Congress, clectors of President and Vice President, and members of the Senate and House of Representatives for the State Legislature in this State, as well as for all other officers for which they are now entitled to vote at other precinct elections in Wilson county.

CHAPTER X.

An Act to explain the acts in relation to turf racing.

SECTION 1. Be it enacted by the General Assembly of the State of Tennessee, That hereafter all horse racing, without regard to the distance which may be run, where the same is run upon a track or path made or kept for the purpose of horse racing, shall be deemed turf racing within the meaning of the acts of assembly of this State.

SEC. 2. Be it enacted, That all and every person betting or running, aiding and abetting in running any horse race Betting in or along any public road in this State, shall be liable to and running. be indicted under the same rules and provisions as are now in force and use in this State against unlawful gaming. CHAPTER XI.

An Act to change the time of holding the courts therein mentioned.

SECTION 1. Be it enacted by the General Assembly of the State of Tennessee, That from and after the passage of this Carroll county act, the circuit court of Carroll county shall commence on

the first Monday in January and July, in each and every year, and shall continue until the business on the docket of said court shall be disposed of, unless the Judge holding the same shall be compelled to adjourn said court to hold some other, and all writs and other process returnable to the ensuing term of said court as it now stands, shall be returnable on the said first Monday in January next, and shall be good and valid as though the time of holding said court had not been altered or changed.

SEC. 2. Be it enacted, That from and after the passage of this act, the county courts of Henry county shall be Henry county. holden on the fourth Mondays in March, June, September and December, and shall continue as heretofore, until the business on the docket of said court shall be disposed of, and all writs and other process, returnable to said courts as they now stand, or which may hereafter be issued shall be made returnable on the said fourth Mondays in March, June, September and December, and all process so returned shall be good and valid as though the time of holding the said courts had not been altered or changed in any wise whatever.

SEC. 3. Be it further enacted, That the next term of the Supreme court Supreme Court at Sparta, shall commence and be holden at Sparta. on the second Monday of December next, instead of the first Monday of said month, as directed by an act passed at the present session of the General Assembly, and that all the terms of said court thereafter to be holden, shall be at the times prescribed in said act. And that all writs or other process now returnable to the Supreme Court at Sparta, shall be returned the second Monday of December

next.

CHAPTER XII.

An Act to repeal the 7th section of an act "requiring the acts of a public and general nature of the General Assembly of the State to be bound."
