By unanimous consent, Mr. Twombly offered for the consideration of the House a resolution, in the words following, to wit:

Resolved, That the Assembly bill No. 601, general order 685, entitled "An act to provide for the holding the courts of oyer and terminer for the trial of certain cases by justices of the supreme court to be assigned for that purpose," be referred to the sub-committee of the whole.

Mr. Speaker put the question whether the House would agree to said resolution, and it was determined in the negative.

By unanimous consent, Mr. Twombly introduced a bill entitled “An act in relation to the appointment of clerk, deputy clerk and other officers of the court of special sessions of the peace, in and for the city and county of New York," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Twombly, and by unanimous consent, said bill was read a third time.

Mr. Speaker put the question whether the House would agree to the final passage of said bill, and it was determined in the affirmative, a majority of all the members elected to the Assembly voting in favor thereof, and three-fifths of said members being present.

By unanimous consent, Mr. Bemus introduced a bill entitled “An act authorizing the Quincy Rural Association of the town of Ripley, county of Chautauqua, to purchase additional lands to enlarge their buryingground," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on charitable and religious societies.

By unanimous consent, Mr. Bemus introduced a bill entitled “An act to legalize the proceedings of the Quincy Rural Cemetery Association, held December 1 and 2, 1871, in the town of Ripley, county of Chautauqua, New York," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on charitable and religious societies.

By unanimous consent, Mr. Bemus introduced a bill entitled "An act to incorporate the Quincy Rural Cemetery Association, in the town of Ripley, county of Chautauqua," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on charitable and religious societies.

By unanimous consent, Mr. Aitken introduced a bill entitled "An act to explain and define the laws relating to common carriers," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

On motion of Mr. Niles, and by unanimous consent,

Resolved, That Assembly bill No. 322, general order 362, entitled "An act relative to purchasers of the franchises and property of corporations, etc.,” be considered in the next committee of the whole not full.

By unanimous consent, Mr. Niles introduced a bill entitled “An act in relation to Fordham and Pelham avenue, in the towns of West Farms and Westchester, in the county of Westchester," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on roads and bridges.

By unanimous consent, Mr. Mosher introduced a bill entitled "An act to regulate the auditing of accounts by the boards of supervisors in the river counties of this State, and to authorize suits against said board," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on internal affairs.

By unanimous consent, Mr. Couchman introduced a bill entitled "An act to amend an act entitled "An act to erect the village of Middleburgh into a separate road district, passed April 7, 1859, and the acts amendatory thereof,' passed February 15, 1867, and March 20, 1871," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on roads and bridges.

Pursuant to the 9th joint rule, Mr. Speaker announced the order of business of third reading of bills.

Mr. Fields moved to lay said order of business upon the table and also all orders of business except "reports of standing committees and "introduction of bills.' ""

Mr. Speaker put the question whether the House would agree to said. motion, and it was determined in the negative, two-thirds of all the members present not voting in favor thereof.

The bill entitled "An act to amend an act entitled 'An act to organize a fire department and board of fire commissioners in the city of Troy,' passed April 13, 1861," was read a third time.
