FORM of the CERTIFICATE to be granted by the faid I DO hereby certify to the Governor and Company of the Bank of England, That it appears by a Certificate and Affidavit produced to me, conformably to the Provifions of an Act,, paffed in the Fortyeighth Year of the Reign of His prefent Majefty, intituled, An A&t [here infert the Title of the A8] that A. B. the Nominee [or, in cafe of Two Nominees, the furviving Nominee] defcribed in the Certificate, No. Day of granted for the Purpose of enabling the Transfer of of the £.3 per Centum Confolidated [or, Reduced] Bank Annuities, for and and the Life of the longer Liver of them] died on the An Act to repeal the Stamp Duties on Licences granted by 'grant grant new and additional Duties in lieu thereof, certain Stamp Duties were imposed on Licences granted by any Juftice or Justices of the Peace or other Magiftrate or Magiftrates for felling Ale, Beer, * or other Excifeable Liquors by retail: And whereas it is expedient 'that the faid Duties fhould be repealed, and other Duties granted in lieu thereof, to be placed under the Management of the Commiffioners of Excife;' be it therefore enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after the Tenth Day of October One thoufand eight hundred and eight, all and fingular the faid Duties fhall ceafe and determine; fave and except in all Cafes relating to the receiving or paying any Arrears thereof respectively, which may at any Time remain uupaid, or to any Fine, Penalty, or Forfeiture, Fines, Penalties, or Forfeitures relating thereto refpectively, which fhall have been incurred at any Time before or on the faid Tenth Day of Odober One thoufand eight hundred and eight. II. And be it further enacted, That from and after the faid Tenth Day of Odober One thousand eight hundred and eight, all and every Perfon or Perfons, who shall fell Beer or Ale by Retail, or who fhall fell Cyder or Perry, to be drank or confumed in his, her, or their Houfe or Premifes, fhall, before he, fhe, or they fhall fell any Beer or Ale by Retail, or any Cyder or Perry, to be drank or confumed in his, her, or their Houfe or Premifes, take out an Excife Licence, authorizing fuch Perfon or Perfons to fell Beer or Ale by Retail, and alfo Cyder and Perry, to be drank or confumed in his, her, or their Houfe or Premifes; which Licence fhall be granted in Manner herein-after mentioned; (that is to lay) If any fuch Licence fhall be taken out within the Limits of the Chief Office of Excife in London, the fame fhall be granted under the Hands and Seals of Two or more of the Commiffioners of Excife in England for the Time being, or of fuch Perfons as they the faid Commiffioners of Excife or the major Part of them for the Time being fhall from Time to Time appoint or employ for that Purpofe; and if any fuch Licence fhall be taken out in any Part of England, not within the faid Limits, the fame fhall be granted under the refpective Hands and Seals of the several Collectors and Supervisors of Excife within their refpective Collections and Diftricts; and in cafe any fuch Licence fhall be taken out within the Limits of the City of Edinburgh, the fame shall be granted under the Hands and Seals of Two or more of the Commiffioners of Excife in Scotland for the Time being; or if any fuch Licence fhall be taken out in that Part of Great Britain called Scotland, out of the faid Limits of the City of Edinburgh, then the fame fhall be granted under the refpective Hands and Seals of the feveral Collectors and Supervisors of Excife in Scotland, within their respective Collections and Districts; and the faid Commiffioners of Excife in England and Scotland refpectively, or any Two or more of them refpectively, and the Perfons to be appointed or employed by the faid Commiffioners of Excife in England or Scotland refpectively, or the major Part of them, and alfo all fuch Collectors and Supervifors Licence Duty L14 Two Duty on fuch Licences fhall be Duration of Licence; 10th October yearly. Time of taking out Licences, in certain Cafes of Charters, &c. Licences fhall be Ten Days after Penalty 501. Executors and Affignees may have the Benefit of Licences. Two Shillings, to be applied and accounted for as herein-after directed. III. And be it further enacted, That the Duty by this A&t directed to be paid for fuch Licences, fhall be paid at fuch Places, or to fuch Perfons as are herein-after in that Behalf refpectively mentioned; (that is to fay) For Licences which fhall be taken out within the Limits of the Chief Office of Excife in London, the fame fhall be paid at the Chief Office of Excife in London; and for Licences which shall be taken out within the Limits of the City of Edinburgh, the fame shall be paid at the Chief Office of Excife in Edinburgh and for Licences which fhall be taken out in any Part of Great Britain, not within the faid refpective Limits, the fame fhall be paid to the respective Collectors of Excife granting fuch refpective Licences ; and all Licences which fhall be granted under and by virtue of this Act, to any Perfou or Perfons, to fell Beer and Ale by Retail, and Cyder and Perry, to be drank or confumed in his, her, or their House or Premifes, fhall remain and continue in force until and upon the Tenth Day of Odober next enfuing the Time of granting thereof, and no longer. IV. Provided always, and be it further enacted, That in all Cafes where the Licence or Authority granted by any Juftices of the Peace or Magiftrates, or other competent Perfons, to any Perfon or Perfons to keep a Common Inn, Ale House, or Victualling Houfe, fhall under or in pursuance of any Charter, Cuftom, or Ufage, be iffued at any Time of the Year except in the Month of September, and terminate or expire at any Time of the Year except in the Month of September, then and in every fuch Cafe the Excife Licence required by this A&t to be taken out for the Sale of Beer, Ale, Cyder, or Perry, fhall be taken out within Ten Days next after the Date of the faid Licence or Authority of the Juftices of the Peace, Magiftrates, or other competent Perfons, and fuch Excife Licence fhall continue in force for Twelve Calendar Months next enfuing the Date of the Commencement thereof, any Thing in this Act to the contrary in anywife notwithstanding. V. And be it further enacted, That no Perfon or Perfons fhall fell any Beer or Ale by Retail, or any Cyder or Perry, to be drank or confumed in his, her, or their Houfe or Premifes, after the Expiration of fuch his, her, or their Excife Licence, unless fuch Perfon or Perfons fhall take out a fresh Licence, for the faid Purposes, in the Manner herein-before directed within Ten Days after the Expiration of fuch former Licence, and fo in like Manner renew every fuch Licence from Year to Year; or if any Perfon or Perfons fhall fell any Beer or Ale by Retail, or any Cyder or Perry, to be drank or confumed in his, her, or their Houfe or Premifes, without firft taking out an Excife Licence, authorizing him, her, or them fo to do, or without renewing the fame as is herein in that Behalf directed, he, fhe, or they fhall, for every fuch Offence, forfeit the Sum of Fifty Pounds. VI. And be it further enacted, That upon the Death of any Person, fo licensed, or upon the Removal of any Perfon or Perfons fo licensed from the entered Houfe or Premifes in which fuch his, her, or their Excife Licence fhall authorize him, her, or them to fell Beer or Ale by Retail, or Cyder or Perry, to be drank or consumed in his, her, or their House or Premises, it shall be lawful for the Commiffioners of Excife in England and Scotland respectively for the Time ! |
