His Hon the Lt. Gov' made a speech to this Board wch was read, as followeth :

Gent".

Having ordered Gen' Assembly to convene at Portsm 8th instant, being next Thursday:

Find fort greatly out of repair; desire four p'sons nominated & appointed to take a view & survey thereof, & make report true condition s fort, & wt prop: forthwith to be done, for to be laid before Assembly; that same be in fitt posture reception Gov' Burgess.

Present a complaint against John Leavitt, Hampton, for great contempt; desire that directions be given the Court Q' Sessions for Peace, to proceed therein, that due witness [P. 341.] born agst such actions.

If you have any thing of moment for service Govern to offer, readily shall receive.

As to State civil and military Province shall enquire fully into, take due care thereof before leaving Province. JOHN USHER.

Ordered, That Mark Hunking & John Wentworth, Esqs. together with Jos. Smith and Theo. Atkinson be a Committee to view his Majtes fort Wm. & Mary, at New Castle, and make report of the state & condition of sd Fort, to ye Gen' Assembly at their next session, wch will be on Thursday ensuing, being ye 8th instant.

His Hon' the Lieut. Gov' communicated a complaint to this Board agst Jno. Leavitt of Hampton, to be p'ferred at the Court of Qr. Sessions of the Peace agst him the sd Leavitt, for misleading his Hon' in his journey from Hampton to N. Castle, & disrespectful treatment on sd journey;

& 'tis appointed that Rich Waldron, Jun. be King's Attorney, to prosecute sa Leavitt.

His Hon' the Lt. Gov' read a minute of his Instructions at this board, respecting ye Treasurer's accounts, &c. & then notified Mr. Treasurer Penhallow yt he expected to have his accounts to send for England before he left the Province.

The Lt. Gov enquired of Mr. Treasurer Penhallow, whether he had received the account of the lumb' Duty. He answered, he had not, but he daily expected ye officer would bring it in.

The Lt. Gov told Mr. Treasurer Penhallow yt he had p'rused his Acct of stores, & found it imperfect, and further, y' he excepted p'ticularly agst ye barr1 powd' spent at Proclaiming ye Peace. Mr. Treasurer Penhallow answered 'twas spent by advice of ye Council.

The Lt. Gov' desired to know of Mr. Treasurer Penhallow, whether yt £1000 voted by ye General Assembly to be burnt in June last, was burnt; he answered ye whole sum was not, & yt ye difficulty of exchange of bills was the

reason.

[P. 342.] The Lt. Gov' recommended to this Board ye consideration of his gt expense & charge in the service of this governt wthout any gratuity therefor.

Voted, That his Honor the Lt. Gov' should have ten pounds paid him out of the treasury, & that a warrant be issued out accordingly.

His Honor the Lt. Gov' told this Board if they had anything to offer for the King's service, he would attend it; if not he would take his leave of them. They answered they had nothing to offer.

His Excellency Elizeus Burgess, Esq., his letter to the Presid&Council of the Prov. of N. Hampshire, pr Geo. Vaughan, Esq., was read at this Board, as followeth :

London, July ye 28th, 1715.

Gent" The King has been pleased to appoint me his Gov' of the Province of N. Hampshire and Massachusetts Bay in New England, and I intend, God willing, to sett out from hence some time next month, in ord' to be with you before this season is over. I would have given you earlier notice of this if I had not waited for an opportunity of writing by Coll° Vaughan, who, I am told has so near a relation to many of you, that I dare say you will not be displeased I have had credit enough to procure him a Commission to be Lieut. Gov' of your Province. I wish I could do any thing more for your service here; but w" I have the pleasure to meet you in America, you yourselves will see how much I have yo' interest at heart, & that I desire nothing more earnestly than yo' good opinion; & the good of the people I have preferred to my best friends, and wth whom I hope to live and die. I am

Upon reading ye foregoing letter, Mr. Sherriff Phipps was sent from ye Councill to Geo. Vaughan, Esq. to pray his Comp at the Council Board, who accordingly came, where the Gent of the Council informed him that they understood by his Excellency Col° Burgess' letter, that he had obtained a Commission for ye Lieutenancy of this Province, he answered he had, wch he p'sented to ye Board, & then, taking his leave, departed. The sa Commission being twice read at ye Board, it was

Voted, That ye sd Commission should be published on ye next day, (viz.) on ye 13th inst., at 10 o'clock forenoon. It was also

Voted, That Col° Waldron ord two foot Compas of ye militia at Portsmouth, (viz.) Capt. Phipp's & Capt. Pierce's companies, to attend ye publication of sd Commission at ye time afores; & that ye Clerk send an ord' to ye Capt. of his Maj'ties fort at New Castle, [P. 344.] to fire eleven great guns at ye Castle to-morrow, wch will be ye 13th inst. ten minutes after they shall hear the first volley of small arms from Portsmo.

Adjourned to Thursday ensuing, 10 o'clock, ante meri

Met again according to adjournment-being the 13th instant.

Ordered, That Mr. Treasurer Penhallow deliver fifty pounds of gun-powder to Capt. Phipps or his order, to be distributed in proportion to the two foot companies of militia now in arms, to be expended for yo King's service; also three pounds mony for ye use of sd Companies.

This day the Gent" of the Council Accompanied by sundry yo principall gentry of ye Prov. walked from yo Council house to ye Market place in Portsm°, where they mett two foot companies of militia in arms, together with a great numb' of other people, at wch time & place, was publickly read the Honble Geo. Vaughan, Esq. his Commission to be Lieut. Gov of the Prov. of N. Hamps', wch was followed by three volleys of small arms & huzzas: & answered from his Maj'ties Fort Wm. & Mary, by the discharge of eleven

cannon.

After this ceremoney was over, the Gent" of the Council returned to ye Council [P. 345.] Chamber, from whence they sent the Clerk to the Honble Geo. Vaughan, Esq. to inform him that the Council were then at the Council Chamber awaiting his Hon" pleasure; who immediately thereupon came to ye Chambr, where his Hon' took the oaths appointed instead of ye oaths of allegiance & supremacy, repeated the Declaration, and subscribed the same, & then took his place at the board accordingly.

Ordered, That ye Clerk write to his Excellency, Jos. Dudley, Esq. & inform him of ye arrival of ye hon'ble Geo. Vaughan, Esq, wth ye King's Commission for y° Lieutenancy of Hamp & the publication of the same.
