Hir Excellency's Letter with ye Comp't of ye several Inhabitants of Portsmouth was read.

Upon wch ye principall of ye sd Complainers, wth the Selectmen of Portsmouth, were ordered to appear, & accordingly did appear, & upon hearing both p'ties y Council were pleased to give his Excellency ye Gov' a full account. of ye matter in a letter bearing date ye 12th day of Jan", 1714-5, as on file.

The Gov Letter bearing date, Jan 17th, was this day read at ye Council board as followeth :

Roxbury, 17 Jan: 1714-5. Gent I have before me Mr. Secretary Story's letter from the Council, & papers enclosed, & tho' I think ye winter season wd have given leisure [mo ?] to ye Council to have satt upon ye complaints of Portsmo: yet I shall allow of ye proceedings y'upon by a Committee, directing it to be done by impartiall p'sons of the Council; or otherwise to revise ye proceedings upon ye said three years acctts, yt ye whole matter may be sett in a true light agst ye next sitting of an Assembly, wch I suppose will not be long hence.

The dismissing ye appeal by ye Superior Court, I am of opinion ought to have carryed its reason with it; tho' I am [P. 333.] not to doubt but ye Judges had ye reason for it. Referring to ye Papers signed by Captain Pickerin, Mr. Cotton & others alleadging double orders in the town book, &c., I cannot give any opinion unless upon ye place to see them, & hear both p'ties; nor of the surplusage of the tax beyond ye Assembly's order, untill ye Committee have sett them in a true light; whom, therefore, I direct you forthwith to appoint: in the meantime there must be no delay of collecting wt is granted by ye assembly to ye Crown for drawing in ye Province bills.

Gent" Referring to ye Courts & Governm', it is a matter out of all question, yt his Majesty's subjects in the Pro: of New Hampshire are not to be left one day without governmt wch you may be assured his Majesty has directed & disposed before this time; and ye distance and hazard of its arrival & delay thereupon is a warrt sufficient for all yor Bank to proceed in their ordinary methods, & Judges, Justices for the Civil part, as well as military officers, for ye security & defence of his Maj'ties good subjects, wch accordingly I expect from every such officer civill and military, as they will answer ye contrary at yr perill, & ye obedience & assistance of all his Maj'ties good subjects in y Pro: residing; the s officers having every p'son qualified themselves, as ye Lords Justices & Act of Parliament have commanded; & of this y° Gent of his Maj'ties Council will give notice as need may require, that we may be found in a Dutifull & Loyal & peaceable posture when his most

sacred Maj'ties commands shall arrive, we cannot be long.

Ordered, that ye whole Council sitt as a Committee to auditt ye acctts of ye Selectmin of Portsmouth for two years past, to give an acct. of the money raised, & that they be notified to draw out their accounts accordingly, to be layed before the Council board on Tuesday ye 8th of Febry next.

Ordered, that his Excellency, the Gov' be acquainted wth the opinion of this Board, that a Proclamation be forthwith issued throughout this Province for ye continuance of all officers both civill. & military for the defence of his Maj'ties good subjects, untill his Maj'ties pleasure be farther known.

The following Proclamation was published by beat of drum.

By his Excellency, Joseph Dudley, Esq., Capt. Generall & Governour-in-chief in & over his Maj'ues Province of New Hampshire in New England, A PROCLAMATION, requiring all persons in office of authority or governm1, civil or military, to proceed in y execution of y' respective offi

ces.

His Majtles commands referring to the Governm' of this his Majtys Province being not yet arrived, but to ye intent that

good rule and order be upheld, and ye peace and quiett of his Majtys good subjects in ye several parts pr'served, I have thought fitt, by and with ye advice of his Majtys Council, to put forth this Proclamation, hereby strictly charging, & in his Maytys name requiring all officers civil and military (who have qualified themselves by taking yo oaths appointed by Law, pursuant to ye Act of Parliam' made in the sixth year of her late Majs reign, Intitled an Act for ye security of her Majtis p'rson & Governm', & of the succession to ye crown of Great Brittain in the Protestant line; and a Proclamation issued by their Excellencys the Lords Justices of Great Brittain) And ye respective Courts of Justice whin this Pro to attend ye Duty of their respective offices, places and employm's, & vigorously to exert themselves in ye execution of ye Laws for ye conservation of the peace & Administration of Justice, according to ye powers & trust in them severally reposed, until his Majties pleasure shall be known therein, as y tendr y duty and Allegiance to his Sacred Majue & will answer ye neglects thereof att their perill.

Willing and commanding also in his Majties behalf, all his Majties loving subjects to pay a just deference, yield a dutiful obedience & to be aiding, helping and assisting at ye commandt of the said officers and ministers in ye performance [P. 335.] & execution of their respective offices, places and employm's; as they and every of them tend' his Majties utmost displeasure & will answer the neglect of their duty therein at yr perill.

Given at the Council Chamber in Portsmo, upon Monday, ye thirty-first of Jan' 1714-5, in ye first year of the reign of our Soveraign Lord George, by ye Grace of God, of Great Britain, France and Ireland, King, Defend' of ye Faith, &c. J. DUDLEY.

A petition p'sented to this board by ye town of Hampton, (as on file) was read; on hearing of which,—

Ordered, That the Selectmen of Hampton and Exeter be notified to appear on Monday next, at 10 o'clock, before this board, in ord' to have a further hearing of sd Petition, & y' a copy of ye Petition be sent to Exeter Selectmen.

His Hon1 ye Lt. Gov' enquired of ye Council whether anything had been done by ye Assembly as a gratification to him for his former service, as he had formerly proposed to them in Augt last.

They answered, the Committee had not mett since he was here last.

That the several complainers apply ymselves to Capt. Atkinson, who was command of ye Fort, ye several years, wherein they say they are wronged, and settle y' accounts
