SEC. 4. The trustees of said academy shall have power,

I. To elect their president annually.

II. Upon any vacancy in the said office of president or trustees, to elect others in their places, by the votes of a majority of the trustees, present at any regular meeting.

III. To take and hold by gift, grant, or devise, any real or personal property, and to sell, mortgage, let, or otherwise dispose of the same, in such manner as they shall deem most conducive to the interests of said corporation.

IV. To direct and prescribe the course of study and discipline to be observed in said academy.

V. To appoint a treasurer, clerk, and such other officers as they shall deem expedient, who shall hold their offices during the pleasure of the trustees.

VI. To prescribe the duties, and fix the salaries of all the officers of said corporation and to remove or suspend them from office for incapacity, immoral conduct, or misbehavior in office, and to appoint another in the place of any officers so removed or suspended."

VII. To make all ordinances and bye-laws necessary and proper to carry into effect the preceding powers, not inconsistent with the constitution of the United States and the laws of Wisconsin.

AN ACT

To organize certain towns therein named.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin:

SECTION 1. That all of township four, north of range eleven east, in the county of Rock, shall constitute a separate town, and shall be known by the name of Porter, and the first election shall be held at the school house in Cooksville.

SEC. 2. That township fourteen, north of range fourteen east, in Fond du Lac county, shall constitute a separate town, and shall be known by the name of Alto, and the first town meeting shall be held at the school house near Miller's mill.

SEC. 3. That township twelve, north of range twenty-one east, in Washington county, shall constitute a separate town, and shall be known by the name of Fredonia, and the first town meeting shall be held at the house of Hiram King.

SEC. 4. That township number seven, north of ranges numbered eleven and twelve east, in the county of Dane, shall constitute a separate town by the name of Cottage Grove, and the first town meeting shall be held at the house of Amos Beecher.

SEC. 5. That township twelve, north of range nineteen east, in Washington county, shall constitute a separate town, and shall be known by the name of North Bend, and the first town meeting shall be held at the house of William P. Barnes.

SEC. 6. That the north half of township three, north of range eleven east, be and hereby is attached to and shall form a part of the town of Centre, in the county of Rock.

SEC. 7. That township five, north of range nine east, in the county of Dane, shall constitute a separate town, and

shall be known by the name of Oregon, and the first town meeting shall be held at the house of L. S. Pratt.

SEC. 8. That township twelve, north of range twenty Clarence. east, in the county of Washington, shall constitute a separate town, and shall be known by the name of Clarence, and the first town meeting shall be held at the house of Thomas Bailey.

SEC. 9. That all that part of town five, north of range fif- Hebron. teen east, in the county of Jefferson, north of the Scuppenong creek, and north of that part of Bark river lying westerly of the mouth of the Scuppenong, together with the south half of town six, north of range fifteen east, in said county, shall constitute a separate town, and shall be called and known by the name of Hebron, and that the first town meeting shall be held at the school house near H. J. Monroe.

SEC. 10. That all that part of town six, north of range fifteen east, in the county of Jefferson, included within sections three, four, five, six, seven, eight, nine, ten, fifteen, sixteen, seventeen, and eighteen, be and hereby is attached to and shall form a part of the town of Jefferson; and that sections one, two, eleven, twelve, thirteen, and fourteen, be and hereby is [are] attached to and shall form a part of the town of Sullivan.

SEC. 11. That township eight, north of range thirteen Waterloo. east, in the county of Jefferson, shall constitute a separate town, and shall be known by the name of Waterloo, and the first town meeting shall be held at the house of Moses Rood, in the village of Waterloo.

That all that section of country comprised in Butte des township number eighteen north, and fractional township nineteen north, south of Fox river, of range number fifteen east, in Winnebago county, be set off into a separate town by the name of Butte de Morts, and that the first town meeting shall be held at the house of Edward West.

SEC. 13. That township number twenty, north of ranges Neenah. sixteen and seventeen east, and the north half of town nineteen in ranges number sixteen and seventeen east, in Winnebago county, be organized into a separate town by the

name of Neenah, and the first town meeting shall be held at the mill house of Loyal H. Jones.

SEC. 14. That township number nineteen, north of range fifteen east, north of Fox river, and the south half of township nineteen, north of ranges numbers sixteen and seventeen east, and fractional township eighteen of ranges sixteen and seventeen east, north of Fox river, in Winnebago county, be organized into a separate town by the name of Winnebago, and that the first town meeting be held at the tavern house of L. M. Miller; and that for temporary township purposes, town twenty, north of ranges fourteen and fifteen east, be attached to the town of Winnebago.

SEC. 15. That township thirteen, north of ranges eighteen and nineteen east, in Fond du Lac county, shall constitute a separate town, and shall be known by the name of Auburn, and the first town meeting shall be held at Crouch's mill house.

SEC 16. That township number four, north of range number twenty east, in the county of Racine, is hereby set off into a separate town by the name of Norway, [and], that the first town meeting in such town shall be holden at such place in said town of Norway as the town clerk of the town of Raymond shall by three written notices direct; [and] it shall be the duty of said town clerk to cause said notices to be posted up in three of the most public places in said town of Norway, at least three weeks before the (said) first Tuesday of April next.

SEC. 17. That all that part of the county of Winnebago embraced in the following towns, viz: fractional township number seventeen and eighteen in range fourteen east, and also township seventeen in range fifteen, be and the same are hereby set off and organized into a separate town by the name of Rushford, and that the first town meeting shall be held at the house of L. M. Parsons.

SEC. 18. The said several towns shall be entitled to all the rights and privileges [to] which other towns are entitled by law, and the next town meetings in the said towns shall be held at the time prescribed by law for holding town. meetings,

SEC. 19. That in case any town established by this or If towns ne glect to orany act passed during the present session, shall neglect organize to be refuse to organize and elect town officers at the April town otherwise meeting, in such case it shall be the duty of the clerk of the board of supervisors of each county to attach such town to some adjoining town which is organized; and such town, för all purposes, shall be considered a part of the town to which it is attached for the time being, anything in any law to the contrary notwithstanding.

SEC. 20. That the town of Calamus, Dodge county, shall, Calamus. on the first Tuesday of April next, organize and elect town officers, according to the law in such case made and provided, and the first town meeting shall be held at the house of John Manson.

SEC. 21. All other towns in said county, which failed to Privileges af elect officers and organize according to the provisions of an act entitled "an act to change the form of government in the county of Dodge, and for other purposes," approved January 22, 1846, may organize at the town meeting, to be held in April next, according to the provisions of said act.

SEC. 24. That township number six, north of ranges num- Rome. bers ten and eleven, east, in Dane county, shall constitute a separate town by the name of Rome, and the first town meeting shall he held at the house of John Frederick.
