SEC. 14. The statutory provisions of this state relative to Provisions the procedures for apprehension, commitment and care of the insane shall apply to patients who are to be admitted to the state psychopathic hospital at the university of Michigan in all particulars not provided for in this act.

First, Observation Commitment: When in accordance with Observation the provisions of the statutes, petition has been made in a ment. probate court for the commitment of a person who may be insane or disordered in mind to an institution of the state, it shall appear to the examining physicians and to the judge of probate, that the mental disorder of the person is such as to make it inadvisable that such person should at the time of the hearing be adjudged to be insane, because of doubt as to the sanity or insanity of said person; or because the nature of the mental disorder is such that by treatment at the psychopathic hospital, the disorder might be cured; or if the person has complicating disorders, which if treated by the physicians of the general hospital of the university might be benefited and the mental disorder of said person be cured; the court may continue the hearing of such case to a subsequent date and direct that the mentally disordered person shall be sent to the psychopathic hospital as a person afflicted with a mental disorder and shall decree that said person be there confined, observed and treated for a period not to exceed thirty-five days. Before the expiration of this period of obser- Report to vation, the director of the psychopathic hospital shall report judge. to the judge of probate the results of the observation and treatment of said patient and an opinion stating whether said patient is sane or insane, feeble-minded or epileptic: Provided, Proviso. That if the medical director shall report to the judge of probate that the period of observation and treatment is not of sufficient length to determine the sanity or insanity of said person or if the mental disorder shows improvement and recovery may be aided by further treatment at the psychopathic hospital, then the court may continue the hearing of said case for an additional sixty days from the expiration of the first period of ob

Before the expiration of this extended period of observation the director of the psychopathic hospital shall report to the judge of probate the results of observation and treatment of said patient and an opinion stating whether the patient is sane or insane, feeble-minded or epileptic. If the report of the director of the psychopathic hospital states the results of observation have determined that the patient is insane, feeble-minded or epileptic then the judge of probate shall notify the person who made the application for the admission of said person to an institution of the state and such of the relatives of said patient as may be found within the jurisdiction of the court, and may find said person to be insane, feeble-minded or epileptic and may order that said person be committed to the state psychopathic hospital at the university of Michigan for care and treatment, and in said order he shall further decree that said patient may be transferred to the state hospital for mental disease of the district of which said patient was a legal resident or to such hospital or sanitarium, licensed or supported by the state to care for persons having mental disease or who may be feeble-minded or epileptic, as he may designate in the order of commitment, whenever in the opinion of the medical director of the psychopathic hospital further residence in said hospital is inadvis able: Provided, That whenever said insane person is to be transferred from the psychopathic hospital, due notice of the intention of such transfer shall be given to the judge of probate and the superintendent of the hospital or school to which When order said patient is to be transferred. Voluntary admissions.

Second, Voluntary Admissions: Any resident of this state who is in need of and desires treatment for mental disorder in the psychopathic hospital, and who is not at the time legally adjudged insane, and is competent to make application for admission may be received into said hospital for treatment on the approval of the director of the psychopathic hospital as a voluntary private patient, or in case said person is unable to provide the financial requirements for maintenance as a private patient, such person may on the finding of the judge of probate of the county in which he resides of such inability to pay, and an order directing that said person be supported as a public patient, be admitted to the psychopathic hospital as a voluntary public patient, on the approval of the medical director. The expenses for the maintenance of voluntary public who to pay. patients shall be paid by the state in the same amount and manner as that for committed public patients. Voluntary private patients shall provide for their maintenance charges without expense to the state. The rate for their maintenance shall be fixed by the board of trustees, who shall further require an advance payment to be made towards their main

tenance account and the amount agreed upon as a charge for their maintenance shall be secured by a properly executed bond in an amount to be fixed by the board of trustees, and approved by the director of the psychopathic hospital; Third, Admission by Transfer: In case the superintendent Admission of any one of the state hospitals for mental disease, epileptic, or the feeble-minded, in the state of Michigan shall be of the opinion that the disorder of mind of any person who is confined in such hospital may be benefited by residence and treatment or valuable as clinical material at the psychopathic hospital at the university of Michigan, he may, on the approval of the director of the psychopathic hospital, cause said patient to be conveyed to said psychopathic hospital, and, in case said patient while there shall be restored to sanity such patient shall be discharged; but in case such patient shall be found to be incurable, such patient may be returned to the hospital from which said patient was received, or may be discharged, or paroled, from the psychopathic hospital by its director, with the consent of the superintendent of the hospital from which such patient was received. Whenever in accordance with the above provisions a patient shall be transferred from any state hospital, the superintendent of said hospital shall notify the judge of probate of the county of which such patient was a legal resident, and when said patient is discharged, paroled or returned to the hospital from which said patient was received, the director of the psychopathic hospital shall inform said judge of probate, before taking such action;

Fourth, Observation of Transfer: Whenever the mental Observation condition of an inmate in any institution supported by the state shall be so disordered, that in the opinion of the superintendent of such institution, said inmate should be observed and treated at the state psychopothic hospital at the university of Michigan he may petition the probate court of the county in which said institution is located, that said inmate be committed to the state psychopathic hospital at the university of Michigan for observation and treatment in the same manner as herein before provided in the first paragraph of section fifteen of this act: Provided, That a copy of the report Proviso. of observation shall also be sent to the superintendent of the institution from which said patient was received. If the report of the results of observation at the psychopathic hospital shows that said inmate is not insane, feeble-minded or epileptic or whenever any such inmate shall have been restored to his normal condition, the director of the psychopathic hospital shall so certify in writing to the superintendent of the institution to which said inmate was originally committed, who shall forthwith on receiving such certificate send for and receive back such inmate into said institution.

The maintenance expenses of said inmate while in the psychopathic hospital shall be those of a public patient and paid by the state in the same amount and manner as for other public patients.

SEC. 16. After an order for admission to the psychopathic transferred. hospital has been regularly made, and entered, the judge of probate shall mail a certified copy of such order to the medical director of the psychopathic hospital and upon receipt of such order the said medical director shall as soon as there is room for such patient at the psychopathic hospital notify the judge of probate of the fact, whereupon the judge of probate shall cause the patient to be transferred to said hospital for admission thereto Provided, That no person shall be admitted to said hospital under such order after the expiration of twenty days from and including the date of receipt of such notice by the judge of probate.

SEC. 17. All patients transferred to the psychopathic hospital in accordance with the foregoing provisions shall pass from under all care of the hospital from which they are received except in matters provided for in the foregoing provisions as to their discharge or parole and the order committing such patient to the said hospital from which patients shall be received shall be full authority for their transfer and confinement in the psychopathic hospital at the university of Michigan, and the director of the psychopathic hospital shall be responsible for their custody, care and treatment.

SEC. 18. All expenses for transfers between the state hospitals and the psychopathic hospital shall be borne by the state in the case of public patients and by those responsible for their support in the case of private patients.

SEC. 19. No compensation shall be allowed to any physi cian, surgeon or other officer of the university of Michigan, who shall care for or treat any patient of the psychopathic hospital, other than their regular salaries, but all necessary expenses for care of such patients, while in the wards or rooms of the general hospitals of the university of Michigan, shall be paid to the general hospitals by the psychopathic hospital. Such charges shall be audited by the auditor general and in the case of public patients shall be paid from funds credited to the phychopothic hospital in accordance with the accounting regulations prescribed by the state administrative board. In case the patient treated is a private charge, all expenses for care and treatment of such patient in the general hospitals of the university of Michigan shall be paid by those responsible for the private maintenance of such patient while in the psychopathic hospital. In all cases where the state may reimburse itself for the costs of maintenance of patients in the psychopathic hospital, as hereinafter provided, the state shall collect from the county of which said patient was a legal resident, as a charge additional to the maintenance cost of said

patient, such amounts as have been expended for the care and treatment of said patient while in the general hospital. Patients while in the ward or rooms of the general hospitals of the university of Michigan, shall have the same legal status as if they were resident in the psychopathic hospital.

SEC. 20. The medical director of the state psychopathic When patient hospital at the university of Michigan may discharge any discharged. patient in the following ways:

First, Any patient who in his judgment has recovered from his mental disorder;

Second, Any patient whose order for a limited period of observation has expired;

Third, Any patient who has not recovered but whose discharge, in the judgment of the director of the psychopathic hospital, will not be detrimental to the public welfare, nor injurious to the patient: Provided, That before ordering such Proviso. discharge the director shall notify the relatives or friends of such patient or the superintendent of the poor of the county whence he came, and give notice of such discharge to the judge of probate of said county. If such patient is not removed within ten days of such notice he shall be returned to his home and friends or to the superintendent of the poor of said county. When the director of the psychopathic hospital is unwilling to discharge an unrecovered patient on request and so certifies in writing, giving his reasons therefor, the probate court of the county from which said patient was admitted into the hospital may upon certificate, and an opportunity for hearing thereon being accorded to the director and upon such other proofs as may be produced, direct, by order, the discharge of such patient upon such security to the people of the state as the court may require for the good behavior and maintenance of the patient. A certified copy of the order shall be delivered to the director of the psychopathic hospital. Neither the state, the director or any officials of said psychopathic hospital shall be liable for any act of such paroled or discharged patient; Fourth, Any insane patient who is an inmate of the psycho- Insane pathic hospital may be transferred to the state hospital for transfer of. mental disease in the district of which said patient was a legal resident, or to such hospital, or sanitarium as the judge of probate may designate in his order of commitment, whenever, after a satisfactory period of observation and treatment, it is found that the disorder of the patient cannot be cured or that further confinement in the psychopathic hospital is inadvisable: Provided, That whenever an insane person is to be so Proviso. transferred due notice of such transfer shall be given to the judge of probate and to the superintendent of the hospital to which said patient is to be transferred. The foregoing provisions for transfer shall apply to any patient who has been discharged from the psychopathic hospital, subsequent to commitment to that hospital as insane, and whose mental condition has become such as to require further care and treatment in a hospital for mental diseases: Provided, That such Proviso.
