district in the same manner as heretofore provided by statute: Provided, That if any such city or graded school district shall desire to give up its own organization as a school district and become a part of the township district, and such district and the other district or districts of the township shall respectively so express themselves by ballot by a majority vote of the legal voters of each district at an annual or special meeting of such districts, the superintendent of public instruction shall have authority to declare the organization of such city or graded school district for school purposes dissolved, and he shall make such declaration in writing and serve the same upon the officers of the township district and upon the officers of such city or graded district, and such officers shall immediately turn over to the board of education of such township all the building, property, appurtenances, money, and material heretofore belonging to such city or graded district to the board of education of the township district, and thereafter such city or graded district shall be a part of the township district and controlled by the township board of education as herein provided: Provided further, That where fractional school districts have been organized heretofore, the organization of the township district for school purposes shall conform to the boundaries of such school districts, and that the said fractional districts shall become a part of the township district in which the school house of such district is located, and that in the election of school officers said boundaries shall be recog nized by the officers of the township: Provided further, That in any case where a fractional district has been organized heretofore, such territory may be divided so that the township school district boundary lines shall conform to the township boundary lines, said division being made in their discretion by the township boards of the townships in which the territory may be located, said boards meeting in joint session for such purpose. When such division has been made, the township boards at said joint meeting shall immediately proceed to make an equitable division of the property, and money, if any, belonging to such district between the townships in which such district was located. The township clerk of the township in which the school house of such fractional school district is located shall give at least ten days' notice to the township clerk of the other townships interested of the time and place of such meeting, and each township clerk upon receiving such notice shall notify each member of the township board of his township of the time and place of such meeting. The joint meeting of the township boards when assembled shall elect from their number a chairman and a clerk, and a majority of the joint board shall be necessary to determine all questions submitted. The clerk of said joint board shall provide each township clerk with an exact record of the proceed. ings of said meeting.

AN ACT to amend section nine of chapter two of act number one hundred sixty-four of the public acts of eighteen hundred eighty-one, entitled "An act to revise and consolidate the laws relating to public instruction and primary schools, and to repeal all statutes and acts contravening the provisions of this act," being section five thousand six hundred fifty-six of the compiled laws of nineteen hundred fifteen.

The People of the State of Michigan enact:

SECTION 1. Section nine of chapter two of act number one Section hundred sixty-four of the public acts of eighteen hundred eighty-one, entitled "An act to revise and consolidate the laws relating to public instruction and primary schools, and to repeal all statutes and acts contravening the provisions of this act," being section five thousand six hundred fifty-six of the compiled laws of nineteen hundred fifteen, is hereby amended to read as follows:

SEC. 9. A township board may in its discretion detach the May property of any person or persons from one district and attach district. it to another, or divide and consolidate districts: Provided, Proviso. however, That no land which has been taxed for building a schoolhouse shall be set off into another district for the period of three years thereafter except by the consent of a two-thirds majority of the resident owners of said land to be set into another district; and no district shall be divided into two or more districts without the consent of the majority of the qualified school electors of said district present and voting at a meeting called for such purpose, and two or more districts shall not be consolidated without the consent of a majority of the qualified school electors of each district present and voting at a meeting called for that purpose.

This act is ordered to take immediate effect.

AN ACT to organize the state psychopathic hospital at the university of Michigan, to provide for the management thereof, and to repeal act number two hundred seventyeight of the public acts of nineteen hundred seven and act number three hundred ten of the public acts of nineteen hundred seventeen.

The People of the State of Michigan enact:

SECTION 1. The state psychopathic hospital at the university of Michigan shall be a state hospital designed, equipped and administered for the observation and treatment of those persons who are afflicted with abnormal mental states and for the care and treatment of those who are in the early phases of insanity.

SEC. 2. It shall be known at [as] the state psychopathic hospital at the university of Michigan, and shall be located at Ann Arbor.

SEC. 3. It shall be under the control of a board of trustees, which board shall consist of eight members, four of whom shall be members of the board of regents of the state university and four members who shall be appointed by the governor. After the taking effect of this act, the governor shall appoint four members, two of whom shall serve for a term of two years and two of whom shall serve for a term of four years. Thereafter, on the expiration of the term of service of each, their successors shall be appointed for a term of four years. The four members from the board of regents of the state university shall be appointed annually by said board of regents at their January meeting. All said trustees shall hold office until their successors are duly appointed and qualified.

SEC. 4. Whenever a vacancy shall occur in said board of trustees it shall be filled by the governor, if the vacancy shall occur in one of the appointments made by the governor, or by the board of regents of the state university, if the vacancy shall occur in one of the appointments herein provided to be made by the said board of regents.

SEC. 5. The government and sole control of the state psychopathic hospital at the university of Michigan shall be vested in its board of trustees. They may take and hold in trust for the state any grant, or donation or personal property to be applied to the maintenance of the patients or for the specified or general use of the psychopathic hospital. They may make rules fixing charges to be made against private patients or may make special contracts for the care of the same. They shall not receive any compensation for their services, but shall receive their actual and reasonable expenses incurred in the performance of their duties, which shall be paid in accordance with the rules and regulations of

the state administrative board. Said board shall:
First, Have the general direction and control of all property board.

vided for by law;

Second, Provide its own by-laws, rules and regulations and see that its designs are carried into effect according to such by-laws, rules and regulations;

Third, Appoint as often as vacancies occur a medical director, who by virtue of his position shall be the pathologist of the state hospitals for mental disease, and with the approval of the board of regents, may hold the position of professor of psychiatry in the medical school of the state university;

Fourth, Appoint, on the nomination of the medical director, necessary assistant physicians and hospital officials;

Fifth, Determine from time to time the salaries and allowances of the officers and employes of the psychopathic hospital;

Sixth, Establish by-laws, rules and regulations as they deem necessary for regulating the appointment and duties of officers, assistants and employes, and for fixing the conditions of admission, support and discharge of patients, and for the business management and internal government of the psychopathic hospital; maintain an efficient inspection of the hospital and keep records of its doings;

Seventh, Provide for the treatment of all patients according to the best medical standards. The board may also organize dispensaries and mental hygiene departments for the examination, treatment and maintenance of patients, in any city or community of this state; and may make such provision as may be deemed necessary and expedient for the prevention of mental disease and the preservation of the mental health of patients who have received treatment at said hospital. The expenses for the work contemplated shall be considered. a necessary part of the cost of maintaining the hospital, and shall be audited and paid, in accordance with the regulations of the state administrative board.

SEC. 6. The medical director of the psychopathic hospital Medical shall be its chief officer and in his absence or incapacity the first assistant physician shall perform the duties and be subject to the responsibilities of the medical director.

approval of the trustees, their compensation, and may discharge from the psychopathic hospital any of these at his sole discretion, but shall keep a record in the hospital of such discharges with the reasons for same.

SEC. 8. In his capacity of professor of psychiatry in the medical school of the state university of Michigan he may utilize the clinical and laboratory facilities of the psychopathic hospital for the instruction of students of the state university of Michigan.

SEC. 9. The medical director of the psychopathic hospital shall in his capacity of pathologist of the state hospitals for mental diseases advise regarding the clinical and pathological research in the several mental hospitals of the state and shall maintain a systematic co-operation between the several mental hospitals of the state and the psychopathic hospital. He shall from time to time visit the mental hospitals of the state and may advise and instruct the medical officers of such hospitals in subjects relating to mental disorders. All necessary expenses incurred in making such visits shall be chargeable to the account of the hospital visited, and shall be paid in accordance with such regulations as shall be made by the state administrative board.

It shall be provided by rules of the state hospital commission, that the medical officers of the state hospitals for mental diseases shall from time to time receive instruction at the psychopathic hospital. The necessary expenses incurred in attendance at such courses of instruction shall be paid by the hospital to which the respective medical officers are attached.

SEC. 11. The treasurer of the state university shall be exofficio treasurer of the psychopathic hospital, and shall assume such duties as may be prescribed by the state administrative board or by the auditor general.

SEC. 12. The superintendent of the university of Michigan hospital or his deputy shall be the business officer of the psychopathic hospital. He shall receive such salary as the board of trustees of the psychopathic hospital shall from time to time fix, and shall:

First, Under the direction of the director of the psychopathic hospital, be accountable for the careful keeping and economical use of all furniture, stores and other articles of said hospital;

Second, Under the direction of the medical director, make all requisitions for supplies, equipment and materials for the institution and conform to such regulations in regard thereto. as are or shall be provided by the state administrative board; Third, Keep the accounts for the support of patients and expenses incurred in their behalf and furnish the trustees and medical director when required any and all reports of such accounts;
