AN ACT to make appropriations for the Michigan state sanatorium for the fiscal year ending June thirtieth, nineteen hundred twenty-eight, for buildings, improvements and equipments therefor; and to transfer one-half of the appropriation made by act number three hundred fiftyseven of the public acts of nineteen hundred twenty-five, entitled "An act making an appropriation to purchase a site and erect buildings for a state tuberculosis sanatorium on a site to be selected by a committee as herein provided", as amended by act number eleven of the public acts of the extra session of nineteen hundred twenty-six, entitled "An act to amend the title and section two of act number three hundred fifty-seven of the public acts of nineteen hundred twenty-five, entitled 'An act making an appropriation to purchase a site and erect buildings for a state tuberculosis sanatorium on a site to be selected by a committee as herein provided'," to the Michigan state sanatorium.

The People of the State of Michigan enact:

SECTION 1. Each of the said amounts shall be used solely for the specific purpose herein stated subject to the general supervisory control of the state administrative board.

SEC. 2. One-half of the appropriation of five hundred thousand dollars for a state tuberculosis sanatorium as provided by act number three hundred fifty-seven of the public acts of nineteen hundred twenty-five, entitled "An act making an appropriation to purchase a site and erect buildings for a state tuberculosis sanatorium on a site to be selected by a committee as herein provided" as amended by act number eleven of the public acts of the extra session of nineteen hundred twenty-six, entitled "An act to amend the title and section two of act number three hundred fifty-seven of the public acts of nineteen hundred twenty-five, entitled 'An act making an appropriation to purchase a site and erect buildings for a state tuberculosis sanatorium on a site to be selected by a committee as herein provided'," is hereby transferred to and made available for the Michigan state sanatorium.

SEC. 3. The amounts hereby appropriated shall be paid out of the state treasury at such times and in such manner as is or may be provided by law.

SEC. 4. The auditor general shall incorporate in the state tax for the year nineteen hundred twenty-seven, the sum of three hundred fifty-one thousand five hundred dollars to reimburse the general fund for the appropriations hereby made. This act is ordered to take immediate effect.

I am returning herewith, with my objections thereto, House Bill No. 304, File No. 223, being House Enrolled Act No. 83, entitled,

"An act to make appropriations for the Michigan state sanatorium for the fiscal year ending June thirtieth, nineteen hundred twenty-eight, for buildings, improvements and equipments therefor; and to transfer one-half of the appropriation made by act number three hundred fifty-seven of the public acts of nineteen hundred twenty-five, entitled "An act making an appropriation to purchase a site and erect buildings for a state tuberculosis sanatorium on a site to be selected by a committee as herein provided", as amended by act number eleven of the public acts of the extra session of nineteen hundred twenty-six, entitled "An act to amend the title and section two of act number three hundred fifty-seven of the public acts of nineteen hundred twenty-five, entitled 'An act making an appropriation to purchase a site and erect buildings for a state tuberculosis sanatorium on a site to be selected by a committee as herein provided'," to the Michigan state sanatorium.

The above-entitled measure is approved with the exception of items in section 1, providing funds for carrying into effect the provisions of this act, which are approved with the following exceptions: Item in section 1 of $500.00 for 1928, appropriated for "shrubbery", is reduced to $250.00 and approved at that sum; item of $35,000.00, appropriated for "remodeling administration building" is reduced to $4,000, and approved at that sum; item of $90,000.00 for "kitchen and dining room (new)", is reduced to $75,000.00 and approved at that amount; item of $8,000.00 appropriated for "remodeling laundry", is reduced to $500.00 and approved at that amount; items of $75,000.00, appropriated for a "nurses' home (new)" and $10,000.00, appropriated for "physicians' home", are disapproved; item of $10,000.00 appropriation for "entrance to grounds", is reduced to $500.00 and approved at that amount; item of $12,000.00, appropriated for "horse barn and silo (new)", is disapproved; item of $2,000.00, appropriated for "chicken house (new)", is reduced to $500.00 and approved at that amount.

The aforesaid items are disapproved in the interest of economical management of state affairs, made necessary by the condition of the state treasury.

AN ACT to amend section forty-six-d of chapter two of act number three hundred fourteen of the public acts of nineteen hundred fifteen, entitled "An act to revise and consolidate the statutes relating to the organization and jurisdiction of the courts of this state; the powers and duties of such courts, and of the judges and other officers thereof; the forms of civil actions; the time within which civil actions and proceedings may be brought in said courts; pleading, evidence, practice and procedure in civil actions and proceedings in said courts; to provide remedies and penalties for the violation of certain provisions of this act; and to repeal all acts and parts of acts inconsistent with, or contravening any of the provisions of this act," as added to said act by act number fifty-four of the public acts of nineteen hundred nineteen.

The People of the State of Michigan enact:

SECTION 1. Section forty-six-d of chapter two of act number three hundred fourteen of the public acts of nineteen hundred fifteen, entitled "An act to revise and consolidate the statutes relating to the organization and jurisdiction of the courts of this state; the powers and duties of such courts, and of the judges and other officers thereof; the forms of civil actions; the time within which civil actions and proceedings may be brought in said courts; pleading, evidence, practice and procedure in civil actions and proceedings in said courts; to provide remedies and penalties for the violation of certain provisions of this act; and to repeal all acts and parts of acts inconsistent with, or contravening any of the provisions of this act," as added to said act by act number fifty-four of the public acts of nineteen hundred nineteen, is hereby amended to read as follows:

SEC. 46d. There shall be one additional judge in the judicial circuit in which the county of Oakland is or may be situated, the same now being the sixth judicial circuit, making in all three circuit judges in said sixth judicial circuit. The additional office of circuit judge created by this act shall be deemed vacant from and after the day when this act shall

take effect and such vacancy shall be filled by appointment
of the governor until the next general election in November,
nineteen hundred twenty-eight, and until a successor is elected
and qualified. The judge so appointed shall qualify and enter
upon the discharge of his duties within ten days after his
appointment and continue until his successor shall be elected
and qualified.

This act is ordered to take immediate effect.
