The certificates authorized by this act shall expire on the last day of December, of the year of issuance and shall not be transferable, and shall not authorize the holder to take any blue bird or its nest, egg or (eggs), any kirtland warbler, its nest or eggs, any scarlet tanager, its nest or eggs, or any rose-breasted grosbeak, its nest or eggs: Provided, That no person shall by himself, his clerk, servant or agent, expose or keep for sale, or directly or indirectly, upon any pretense or any device, sell or barter, or in consideration of the purchase of any other property give to any person any of the birds, or any part of the birds, taken under the pro visions of this section. SEC. 10. No person or persons shall at any time make use of any pit, pitfall, deadfall, scaffold, cage, snare, trap, net, baited hook, or any similar device, or any drug, poison, chemical or explosive for the purpose of injuring, capturing or killing any birds or animals protected by the laws of this state, nor shall any person at any time or in any manner whatever, injure, destroy or rob the eggs of any bird protected by the laws of this state, molest, harass or annoy such birds upon their nests, except as herein provided: Provided, however, That said provision shall not prohibit the trapping of fur-bearing animals, as provided by law. Νο person shall hunt, pursue, worry or kill any wild waterfowl, or partridge or other bird or animals by any means whatever during such time as said person is upon any floating device, automobile or other contrivance propelled by, or using as motive power, steam, gas, naphtha, oil, gasoline or electricity, or when upon any sailboat. No person while in an automobile shall carry a gun or other firearm, except a pistol or revolver, unless the same be unloaded. No person shall make use of a swivel or punt gun, or any gun of a greater size than ten gauge for the killing of any wild waterfowl or make use of any battery, sink boat or any similar device. No person shall hunt, pursue, worry or kill any wild waterfowl, save only from one-half hour before sunrise until sunset of each day of the open season for hunting and killing such wild waterfowl. It shall be unlawful for any person, directly or indirectly, to buy, sell, expose or offer for sale any game animal or game bird, or part thereof, mentioned in this act. SEC, 11. No person or persons shall molest, harass or annoy or break, train or practice any dog upon any game birds or animals during their respective closed seasons: Provided, That it shall be lawful to train or practice dogs upon game birds or rabbits for fifteen days next preceding the opening of the season for hunting ruffed grouse in each year: Provided further, That under such regulations as may be made by the Director of Conservation, dogs entered in field trials may be trained upon game birds or rabbits for thirty days next preceding the opening of the season for hunting ruffed grouse. No person shall kill in any calendar year more than twenty-five of any one kind of the following named game birds, to-wit: Quail, ruffed grouse, commonly called partridge, spruce hens, plover, woodcock, snipe and other shore birds, twenty-five geese and brant combined; nor more than six male Chinese ring neck pheasants; ten pinnated grouse, commonly called prairie chicken; fifteen fox squirrels; twenty-five rabbits; and not more than fifty ducks in all during one calendar week. The following named game animals and game birds may be hunted and killed as herein provided during the periods named, which shall be the open seasons: Fox, gray and black squirrels, October fifteenth to October thirtyfirst, both inclusive; rabbits or hares, October fifteenth to Proviso, jack December thirty-first, both inclusive: Provided, That the open season on snow-shoes, commonly known as jack rabbits, shall be from October fifteenth to March first, both inclusive; quail, Chinese ring neck pheasants, ruffed grouse, commonly called partridge, spruce hens and woodcock, October fifteenth to November twentieth, both inclusive; ducks, geese, brant, wilson or jack snipe, coots and gallinules, September sixteenth to December thirty-first, both inclusive; black breasted and golden plover and yellow legs, September first to December fifteenth, both inclusive; rails, September first to November thirtieth, both inclusive: Provided, however, That black and gray squirrels shall not be hunted or killed until the year nineteen hundred twenty-four: Provided further, That Mongolian, Chinese, English or any other kind of pheasants, Hungarian partridge, black fowl, capercailzie, hazel grouse, spruce hens or Canadian grouse, pinnated grouse, commonly called prairie chicken, quail, wild turkey, killdeer and wading, shore and meadow birds shall not be hunted or killed until the year nineteen hundred twenty-four, and then only at the time, in the manner and for the purpose authorized by law: Provided further, That woodduck shall not be taken until nineteen hundred twenty-four: Provided further, That blue heron, shelldrake, kittiwakes or terns and mergansers may be killed at any time when it can be shown that they are destroying brook trout or other fish in any of the waters of this state, by securing a permit to do so from the Director of Conservation. Any person or persons violating any of the provisions of this act, shall be deemed guilty of a misdemeanor, and upon conviction thereof, for the first offense shall be punished by a fine of not less than ten dollars and not exceeding one hundred dollars, together with costs of prosecution, or by imprisonment in the county jail or Detroit House of Correction not exceeding ninety days, or by both such fine and imprisonment in the discretion of the court; and for the second or any subsequent offense charged as such in the complaint, shall upon conviction be punished by a fine of not less than fifty dollars and not exceeding two hundred dollars and costs of prosecution, or by imprisonment not less than sixty days nor more than one year, and in all cases when a fine and costs are imposed, the court shall sentence the of fender to be confined in the county jail or Detroit House of Correction until such fine and costs are paid, for any period not exceeding the maximum jail penalty provided for such offense. That all of the swamp or submerged lands lying Public shootalong the borders of Lakes Erie, Huron, Michigan, Superior grounds. and St. Clair, except such parts of the "St. Clair Flats," socalled, as shall have been, prior to January first, eighteen hundred ninety-nine, actually occupied, built up, cultivated or improved to the extent of at least twenty-five dollars, within the boundaries of the state of Michigan, and within the limits hereinafter described, and also all swamp or submerged lands adjoining said lakes, or in the bayous adjoining or emptying into said lakes, and also all swamp or submerged lands contiguous to and lying along the shores of the Kalamazoo river, Grand river and Muskegon river, which now belong to the state of Michigan, or to which the state of Michigan shall hereafter acquire title, shall be and hereby is set apart and dedicated for a public shooting and hunting ground, for the benefit and enjoyment of the people of the state of Michigan. This park so set aside shall extend to the state line into the respective lakes from the shore line thereof, and the outer boundary thereof shall be the center line of Boundary said lakes or the boundary of said state, and shall include all determined. Proviso. swamp or submerged lands lying between said shore line and outer boundary: Provided, That no premises herein described shall be deemed to include any islands in any of the said lakes to which the state of Michigan has not title, unless the state shall first acquire such title. Said park shall also include the swamp or submerged lands owned by the state aforesaid or hereafter acquired by the state, bordering upon said lakes or in or upon the bayous emptying therein.
