§ 190. The jurisdiction of the court of appeals in civil actions. From and after the thirty-first day of May, nineteen hundred and seventeen, the jurisdiction of the court of appeals shall, in civil actions and proceedings, be confined to the review upon appeal of an actual determination made by an appellate division of the supreme court in either of the following cases, and no others:

1. An appeal may be taken as of right to said court from a judgment or order entered upon the decision of an appellate division of the supreme court which finally determines an action or special proceeding where is directly involved the construction of the constitution of the state or of the United States, or where one or more of the justices of the appellate division dissents from the decision of the court, or where the judgment or order is one of reversal or modification.

2. An appeal may also be taken as of right to said court from an order of the appellate division granting a new trial on exceptions, where the appellants stipulate that, upon affirmance, judgment absolute shall be rendered against them.

3. An appeal may also be taken from a determination of the appellate division of the supreme court in any department, other than from a judgment or order which finally determines an action or special proceeding, where the appellate division allows the same, and certifies that one or more questions of law have arisen which, in its opinion, ought to be reviewed by the court of appeals, in which case the appeal brings up for review the question or questions so certified, and no other; and

the court of appeals shall certify to the appellate division its determination upon such questions.

4. An appeal may also be taken from a judgment or order entered upon the decision of an appellate division of the supreme court which finally determines an action or special proceeding, but which is not appealable as of right under subdivisions one of this section, where the appellate division shall certify that in its opinion a question of law is involved which ought to be reviewed by the court of appeals, or where, in case of the refusal so to certify, an appeal is allowed by the court of appeals. Such an appeal shall be allowed when required in the interest of substantial justice.

The provisions of this section shall not apply to an appeal taken to the court of appeals prior to the first day of June, nineteen hundred and seventeen, but an appeal so taken shall be heard and determined under existing provisions of law.
