HENRY Lord SANDYs appears by William Ludlow, his attorney, and says that he is seized in his demesne as of fee, of and in the manor of Durleigh, with all its rights, members, and appurtenances, in the parishes of Eling and Bramshaw in the county of Southampton, without the metes and bounds of the said forest; and claims to have common of pasture in the wastes and commonable lands in the said forest, not inclosed, for himself and his heirs, and for his farmers and tenants of the said manor, for all and all manner of his commonable beasts, except hoggets, levant and couchant, in and upon the said manor, or any parcel thereof, every year, at seasonable times, according to the assize of the said forest (except in the fence month), as belonging and appertaining to the said manor; also pannage, in the time of pannage, for his hogs and pigs,

ringed, suckled in the said manor, in the waste woods of the
said lord the king in the said forest,

Paying therefore yearly to the warden of the said forest
for the time being, for the use of the lord the king, his
heirs and successors, at the feast of Saint Michael the
Archangel,

He also claims to have turf and heath in the wastes of the said forest, not inclosed, for himself and his heirs, and for his farmers and tenants, to be expended in the ancient messuages of the said manor, as belonging and appertaining to the said manor, to be taken by view of the foresters.

No. 308. By petition. NICHOLAS ROGERS, of Exbury in See Petition, the county of Southampton, clerk, appears by William Pocock, No. 5, in bunhis attorney, and says that he is seized in his demesne as of fee, of and in an ancient messuage, a cottage, and 30 and acres of land in Exbury, within the metes of the said forest; and claims to have, to himself, his heirs, assigns, and tenants of the premises, common of pasture for all his commonable beasts, levant and couchant, upon the premises or any parcel thereof, in all commonable places in the said forest, at all times of the year (the fence month excepted), as common appurtenant to the premises; also claims to have the liberty to dig and take turf and cut heath for the use of his house; also claims to have, for his hogs and pigs, common of mast and pannage,

Paying therefore yearly to the warden of the said forest
for the time being, for the use of the lord the king, his
heirs and successors, at the feast of Saint Michael the
Archangel,

And says that he, the aforesaid Nicholas, and the other proprietors and tenants of the premises, whose estate the said Nicholas now has, have had, enjoyed, and used in the premises the said common, liberties, and licence from beyond the memory of man; and the aforesaid Nicholas further claims to have the liberty and licence to inclose the said lands and every parcel thereof, and to reduce into cultivation the same and every parcel thereof, and to cut and carry away when he will his woods and trees, growing or in future to grow upon the same land or any parcel thereof, and the profit thereof convert to his own use, without impeachment, hindrance, or interruption of the

And for his title to the said claim, says that the lord James, late king of England, by letters patent under the great seal of England, at Westminster, on the 27th day of May, in the 7th year of his reign, gave and granted, and in fee farm delivered (among other things) to Thomas Ely and George Merrell the said tenements, with the appurtenances; to have and to hold to the said Thomas Ely and George Merrell, and their heirs and assigns, with the said licence, liberty, and privileges for ever,

Rendering to the said lord the king, his heirs and successors yearly - 0 8 81 as by the said letters patent, produced in court, more fully and at large appears.

He then deduces his title from the grantees.
