Peace in and for the County or Place where fuch Offence was committed; and that all fuch Offences which fhall be committed within that Part of the United Kingdom called Ireland, fhall and may be profecuted in His Majefty's Court of King's Bench at Dublin, and the Venue be laid at Dublin, or at any Affizes or Seffion of Oyer and Terminer and Gaol Delivery, or at any Quarter or General Seffions of the Peace in and for the County or Place where fuch Offence was committed; and all fuch Offences as shall be committed in Scotland, fhall and may be prosecuted in the Court of Jufticiary in Scotland, or any other Court competent to try Criminal Offences committed within the County, Shire or Stewartry within which fuch Where Offence Offence was committed; and where any Offence made punishable by this Act as a Misdemeanor shall be committed out of the faid United Kingdom, it shall be lawful for any Juftice of the Peace refiding near to the Port or Place where fuch Offence fhall be committed, on Information on oath of any such Offence, to iffue his Warrant for the Apprehension Apprehenfion of the Offender, and to cause him to be brought before fuch Juftice, or any other Juftice of the Peace for fuch Place; and it fhall be lawful for the Juftice of the Peace before whom such Offender shall be brought, to examine into the Nature of the Offence upon oath, and to commit fuch Person to Gaol, there to remain till delivered by due Courfe of Law, or otherwife to hold fuch Offender to bail to answer for fuch Offence in the Superior Court, competent to try and having Jurifdiction to try Criminal Offences committed in fuch Port or Place; and all fuch Offences committed at any Place out of the faid United Kingdom fhall and may be prosecuted and tried in any Superior Court of His Majefty's Dominions, competent to try, and having Jurifdiction to try Criminal Offences committed at the Place where fuch Offence shall be committed.

V. And be it further enacted, That in cafe any Ship or Vessel in any Port or Place within His Majefty's Dominions, fhall have on board engaged board any fuch Perfon or Perfons who fhall have been enlifted or entered to ferve, or fhall have engaged or agreed or been procured to enlift or enter or serve, or who fhall be departing from His Majesty's Dominions for the purpose and with the intent of enlifting or entering to ferve, or to be employed, or of ferving or being engaged or employed in the Service of any Foreign Prince, State or Potentate, Colony, Province or Part of any Province or People, or of any Person or Perfons exercifing or affuming to exercise the Powers of Government in or over any Foreign Colony, Province or Part of any Province or People, either as an Officer, Soldier, Sailor or Marine, contrary to the Provifions of this Act, it fhall be lawful for any of the principal Officers of His Majefty's Cuftoms where any fuch Officers of the Cuftoms fhall be, and in any Part of His Majesty's Dominions in which there are no Officers of His Majefty's Cuftoms, for any Governor or Perfons having the Chief Civil Command, upon Information on oath given before them refpectively, which Oath they are hereby respectively authorised and empowered to administer, that fuch Perfon or Perfons as aforefaid is or are on board fuch Ship or Veffel, to detain and prevent any fuch Ship or Vessel, or to caufe fuch Ship or Veffel to be detained and prevented from proceeding to Sea on her Voyage with fuch Perfons as aforefaid on board: Provided nevertheless, that no principal Officer, Governor or Perfon, fhall act as aforefaid, upon fuch Information upon oath as aforefaid,

And be it further enacted, That if any Mafter or other Perfon having or taking the Charge or Command of any Ship or Veffel, in any Part of the United Kingdom of Great Britain and Ireland, or in any Part of His Majesty's Dominions beyond the Seas, fhall knowingly and willingly take on board, or if fuch Mafter or other Person this Act. having the Command of any fuch Ship or Veffel, or any Owner or Owners of any fuch Ship or Veffel, fhall knowingly engage to take on board any Perfon or Perfons who fhall have been enlifted or entered to ferve, or shall have engaged or agreed or been procured to enlift or enter or ferve, or who fhall be departing from His Majesty's Dominions for the purpose and with the intent of enlifting or entering to ferve, or to be employed, or of ferving, or being engaged or employed in any Naval or Military Service, contrary to the Provifions of this Act, fuch Mafter or Owner or other Perfon as aforefaid fhall Penalty. forfeit and pay the Sum of Fifty Pounds for each and every fuch Perfon fo taken or engaged to be taken on board; and moreover every fuch Ship or Veffel, fo having on board, conveying, carrying or tranfporting any fuch Perfon or Perfons, fhall and may be feized and detained by the Collector, Comptroller, Surveyor or other Officer of the Cuftoms, until fuch Penalty or Penalties fhall be fatisfied and paid, or until fuch Mafter or Perfon, or the Owner or Owners of fuch Ship or Veffel fhall give good and fufficient Bail, by Recognifance before One of His Majefty's Juftices of the Peace, for the Payment of fuch Penalty or Penalties.

the Powers of Government in any Colony, Province or Part of any Province or Country, or against the Inhabitants of any Foreign Colony, Province or Part of any Province or Country, with whom His Majefty fhall not then be at War; or fhall, within the United Kingdom, or any of His Majefty's Dominions, or in any Settlement, Colony, Territory, Ifland or Place belonging or fubject to His Majefty, iffue or deliver any Commiffion for any Ship or Veffel, to the intent that fuch Ship or Veffel fhall be employed as aforefaid, every fuch Perfon fo offending fhall be deemed guilty of a Misdemeanor, and fhall, upon Conviction thereof, upon any Information or Indictment, be punished by Fine and Imprisonment, or either of them, at the Discretion of the Court in which fuch Offender shall be Ship, &c. for- convicted; and every fuch Ship or Veffel, with the Tackle, Apparel and Furniture, together with all the Materials, Arms, Ammunition and Stores, which may belong to or be on board of any fuch Ship or Veffel, fhall be forfeited; and it shall be lawful for any Officer of His Majefty's Customs or Excife, or any Officer of His Majefty's Navy, who is by Law empowered to make Seizures, for any Forfeiture incurred under any of the Laws of Cuftoms or Excife, or the Laws of Trade and Navigation, to feize fuch Ships and Veffels aforefaid, and in fuch Places and in fuch Manner in which the Officers of His Majefty's Cuftoms or Excife and the Officers of His Majesty's Navy are empowered refpectively to make Seizures under the Laws of Customs and Excife, or under the Laws of Trade and Navigation; and that every fuch Ship and Veffel, with the Tackle, Apparel and Furniture, together with all the Materials, Arms, Ammunition and Stores which may belong to or be on board of fuch Ship or Veffel, may be profecuted and condemned in the like manner, and in fuch Courts as Ships or Veffels may be profecuted and condemned for any Breach of the Laws made for the Protection of the Revenues of Cuftoms and Excife, or of the Laws of Trade and Navigation.

VIII. And be it further enacted, That if any Perfon in any Part of the United Kingdom of Great Britain and Ireland, or in any Part of His Majefty's Dominions beyond the Seas, without the Leave and Licence of His Majefty for that Purpose first had and obtained as aforefaid, shall, by adding to the Number of the Guns of such Vessel, or by changing thofe on board for other Guns, or by the Addition of any Equipment for War, increase or augment, or procure to be increased or augmented, or fhall be knowingly concerned in increafing or augmenting the Warlike Force of any Ship or Veffel of War or Cruizer, or other armed Veffel, which at the time of her Arrival in any Part of the United Kingdom, or any of His Majefty's Dominions, was a Ship of War, Cruizer or Armed Vessel in the Service of any Foreign Prince, State or Potentate, or of any Perfon or Perfons exercifing or affuming to exercife any Powers of Government in or over any Colony, Province, or Part of any Province or People belonging to the Subjects of any fuch Prince, State or Potentate, or to the Inhabitants of any Colony, Province or Part of any Province or Country under the Controul of any Perfon or Perfons fo exercising or affuming to exercife the Powers of Government, every fuch Perfon fo offending fhall be deemed guilty of a Misdemeanor, and fhall, upon being convicted thereof, upon any Information or Indictment, be punished by Fine and Imprisonment, or either of them, at the Difcretion of the Court before which fuch Offender shall be convicted.

XI. And be it further enacted, That if any A&tion or Suit fhall Former Rules be commenced, either in Great Britain or elsewhere, against any Perfon or Perfons for any thing done in pursuance of this Act, all Law to be applied to Actions Rules and Regulations, Privileges and Protections, as to maintaining commenced in or defending any Suit or Action, and pleading therein, or any Cofts pursuance of thereon, in relation to any Acts, Matters or Things done, or that this Act. may be done by any Officer of Customs or Excife, or by any Officer of His Majefty's Navy, under any Act of Parliament in force on or immediately before the paffing of this Act, for the Protection of the Revenues of Cuftoms and Excife, or Prevention of Smuggling, fhall apply and be in full Force in any fuch Action or Suit as fhall be brought for any thing done in pursuance of this Act, in as full and ample a manner to all Intents and Purposes as if the fame Privileges and Protections were repeated and re-enacted in this Act.

His Heighnefs Licence fight any fingular Combat, under the Paine of Death, and his movable Geare efcheat to His Heighnefs Ufe, and the Provoker to be punished with a more ignominious Death nor the Defender, at the Pleasure of His Majefly:' And Whereas by another A&t of the Parliament of Scotland, paffed in the Sixth Seffion of the First Parliament of the Reign of His Majefty, intituled A&t against Duels, it is enacted, that whofoever, Principal or Second, or other interpofed Perfon, gives a Challenge to fight a Duel or fingle Combat, or whofoever accepts the fame, or whofoever, either Principal or Second on either Side, engages therein, albeit no fighting enfue, fhall be punished by the Pain of Banifh⚫ment and Efcheat of Movables, without prejudice to the A&t already • made against the fighting of Duels:' And Whereas it is expedient that the faid recited Acts fhould be repealed;' Be it therefore enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this present Parliament affembled, and by the Authority of the fame, That from and after the paffing of this Act the faid recited Acts fhall be and the fame are hereby repealed.

An Act for raising a Loan of Twelve Millions from the Commissioners for the Reduction of the National Debt.

WHEREAS an Act paffed in the Twenty fixth Year of the Reign of His prefent Majefty, intituled An A& for vefting certain Sums in Commiffioners at the End of every Quarter of a Year, to be by them applied to the Reduction of the National Debt: And Whereas the Commons of the United Kingdom of Great Britain and Ireland in Parliament affembled, towards raifing the neceffary Supplies, have refolved, that the Sum of Twelve Millions be raised by Annuities in manner hereinafter mentioned: And Whereas the • Commiffioners under the faid recited Act of the Twenty fixth • Year aforefaid have agreed to fubfcribe the faid Sum of Twelve Millions' May it therefore please Your Majetty that it may be enacted, and be it enacted by The King's Most Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this present Parliament affembled, and by the Authority of the fame, That all the Monies which have heretofore been iffued, or are required or directed by any Act or Acts of Parliament to be iffued to the faid Commiffioners for the Reduction of the National Debt, fhall continue to be issued and placed to the Account of the faid Commiffioners as heretofore.
