§ 233. Service without the state in lieu of publication.

In all cases when publication of the summons is ordered, service of the copy of the summons and complaint and of any accompanying notice required by rules by the delivery thereof to the defendant personally without the state is equivalent to notice by publication and deposit in the post-office. The service must be made by a resident or citizen of the state of New York, or a sheriff, under-sheriff, deputy sheriff, or constable of the county or other political subdivision in which the service is made, or an officer authorized by the laws of this state to take acknowledgments of deeds to be recorded in this state, or an attorney and counselor at law duly qualified to practice in the state where such service is made, or by a United States marshal.

Derivation.-Code civ. proc., § 443, subds. 2, 5, as am. by L. 1877, ch. 416, L. 1914, ch. 346, L. 1916, ch. 439, rewritten without intended change of substance, except that the provision that the proof of service must show who served the summons is placed in a rule on proof of service of summons generally. Subd. 3 relates to service without the state without an order and is therefore made a separate section. (§ 235, post.)

Prior to the amendments to § 443 and other sections by L. 1914, ch. 346, plaintiff was required to obtain either an order for publication or an order for service without the state; or an order providing for publication or such service in the alternative.

In the interest of simplification, L. 1914, ch. 346 permitted service without the state in lieu of publication after the plaintiff had obtained an order for publication.

§ 234. Order for service of summons by publication; by whom made.

The order for service of a summons by publication may be made by the court or by a judge thereof or the county judge of the county where the action is triable or in which the attorney for the applicant resides.

§ 235. Personal service out of the state without order.

Where the complaint demands judgment that the defendant be excluded from a vested or contingent interest in or lien upon specific real or personal property within the state or that such an interest or lien in favor of either party be enforced, regulated, defined or limited, or otherwise affecting the title to such property, the summons may be served without an order, upon a defendant without the state in the same manner as if such service were made within the state, except that a copy of the complaint shall be annexed to and served with the summons.

A party who is of full age may prosecute or defend a civil action in person or by attorney unless he has been judicially declared to be incompetent to manage his affairs. Wherever in a statute or rule relating to the conduct of an action a reference is made to an attorney for a party it shall be deemed to include a party prosecuting or defending in person unless otherwise specially prescribed therein or unless that construction is manifestly repugnant to the context. If a party has an attorney in the action he cannot appear to act in person except with the consent of the court.

Derivation.-Code civ. proc., § 55. Reference to "each provision of this act" omitted and "statute or rule" inserted because of removal of various code sections and provisions to rules and consolidated laws. The defendant's appearance must be made by serving upon the plaintiff's attorney, within twenty days after service of the summons exclusive of the day of service, a notice of appearance, a copy of an answer or a notice of motion raising an objection to the complaint in point of law. A voluntary general appearance of the defendant is equivalent to personal service of the summons upon him. § 238. Effect of defendant's appearance.

If a copy of the complaint is not served with the summons a notice of appearance entitles the defendant only to notice of the subsequent proceedings unless with the notice he demands the service of a copy of the complaint.

Derivation.-Code civ. proc., § 422, as am. by L. 1877, ch. 416, without material change, except that the first sentence has been omitted and is covered under "answer" ($263, post.) § 239. Appearance of guardian ad litem for infant.

Where a summons is served upon a guardian ad litem for an infant residing out of the state or residing within the state but temporarily absent therefrom, the time within which to appear is twenty days after the service of the summons exclusive of the day of service. Derivation.-Code civ. proc., § 473, as am. by L. 1877, ch. 416, L. 1889, ch. 494, last part of last sentence; originally revised from code of proc., § 116, in part.

§ 240. Death, removal or disability of attorney.

If an attorney dies, is removed or suspended or otherwise becomes disabled to act at any time before judgment in an action, no further proceeding shall be taken in the action against the party for whom he appeared until thirty days after notice to appoint another attorney has been given to that party either personally or in such manner as the court directs.

Derivation.-Code civ. proc., § 65, without change, except that the last sentence is omitted because it is too drastic a provision and does not afford sufficient protection to the party to whom notice has been given under the first sentence. § 241. Pleadings; what to contain.

Every pleading shall contain a plain and concise statement of the material facts, without unnecessary repetition, on which the party pleading relies, but not the evidence by which they are to be proved.

Derivation.-English practice act, order 19, r. 4, in part, which reads:

"Every pleading shall contain, and contain only, a statement in a summary form of the material facts on which the party pleading relies for his claim or defense, as the case may be, but not the evidence by which they are to be proved."

Also New Jersey practice (1912, amended 1913), r. 17, in part, which reads:

All pleadings must contain a plain and concise statement of the issuable facts on which the pleader relies (and no others) but not of the evidence by which they are to be proved."

The provision that the pleading shall "contain only" a plain and concise statement, etc., is omitted.

This section is a substitute for similar provisions of the code civ. proc., in §§ 481, 500, 514. Code civ. proc., § 518, omitted as unnecessary.

It is interesting to note in this connection that the legislature in 1904 (ch. 500) amended the sections relating to the contents of complaint, answer and reply, to read: "A plain, precise and unequivocal statement," but restored the former language as above indicated in 1905 (ch. 431).

It will also be noticed that the provision from New Jersey relating to admissions and denials, contains the word
