XXV. And be it further enacted, That no Ship or Veffel of the United States of America which fhall enter any Port in Great Britain or Ireland in confequence of her having been warned not to proceed to a blockaded Port under His Majesty's Order in Council of the Eleventh of November One thoufand eight hundred and seven, fhall be liable to be charged with the Duty of Two Shillings a Ton of the Burthen of any Ship or Veffel belonging to the inhabitants of the faid United States, impofed by an Act of the Thirty-feventh Year of His Majefty's Reign, which has been continued and revived by feveral fubfequent Acts.

XXVI. Provided always, and be it further enacted, That nothing herein contained, fhall extend to affect or take away any of the Rights or Privileges of the Weft India Dock Company, of the London Dock Company, or of the Eeft India Dock Company.

XXVII. And be it further enacted, That the Duties granted and impofed by this Act fhall continue in force until the End of the next Seffion of Parliament, unless His Majefty, by His Order in Council, fhall think fit to fufpend or reduce the fame, or any Part thereof.

XXVIII. Provided always, and be it further enacted, That it shall be lawful for His Majefty, at any Time, by Order in Council, to fufpend the Operation of this Act as to any Duties, or any Proportion or Part of any Duties granted by this Act, in refpect of any Country for the Time being in Amity with His Majefty, and to allow the Exportation to any fuch Country fo in Amity with His Majefty as aforefaid, of any Goods, Wares, and Merchandize, made fubject by this Act to any Duties on Exportation, without the Payment of fuch Duties, upon fuch Terms and Conditions, and fubject to fuch Reftrictions, as to His Majefty may seem fit.

XXIX. Provided always, and be it further enacted, That nothing in this Act contained fhall extend, or be conftrued to extend, to prevent His Majefty from prohibiting the Exportation of any Articles, Matters, or Things, to any Country or Place from which the British Flag is excluded, in any Cafe in which it would have been lawful for His Majefty to prohibit fuch Exportation, if this Act had not paffed.

XXX. Provided always, and be it further enacted, That the Duties impofed by an Act, paffed in the Forty-third Year of His prefent Majefty's Reign, intituled, An Act for granting to His Majefty during the prefent War, and until the Ratification of a Definitive Treaty of Peace, additional Duties on the Importation and Exportation of certain Goods, Wares, and Merchandize, and on the Tonnage of Ships and Veffels in Great Britain, on certain Goods, Wares, and Merchandize therein enumerated and defcribed, and which by another Act paffed in the Forty-third Year of His prefent Majefty's Reign, intituled, An Ad for permitting certain Goods imported into Great Britain to be fecured in Warehoufe without Payment of Duty, were directed to be paid on all fuch Goods, Wares, and Merchandize (Sugar excepted) which fhould be exported from the Warchoufes or Places in which fuch Goods, Wares, and Merchandize had been lodged or fecured, under the Directions of the faid laft recited Act, fhall not be due or payable on any fuch Goods, Wares, and Merchandize fo exported, on which other Duties are charged, according to the Table marked (A.) hereunto annexed; but that

the Duties on any fuch Goods, Wares, and Merchandize, as fet forth in the faid Table, fhall, during the Continuance of fuch Duties, be instead and in lieu of the Duties charged and impofed thereon by the faid Two laft recited Acts paffed in the Forty-third Year of His prefent Majefty's Reign.

Duties.

XXXI. And be it further enacted, That all the Monies arifing Application of from the Duties of Cuftoms by this Act impofed (the neceffary Charge of railing and accounting for the fame excepted) fhall from Time to Time be paid into the Receipt of His Majefty's Exchequer at Westminster, diftinctly and apart from all other Branches of the Publick Revenue; and that there fhall be provided and kept in the Office of the Auditor of the faid Receipt of Exchequer, a Book or Books, in which all the Monies arifing from the faid Duties, and paid into the faid Receipt as aforefaid, fhall be entered separate and apart from all other Monies paid and payable to His Majefty, His Heirs and Succeffors, upon any Account whatever; and the faid Monies fo paid in as aforefaid, into the Receipt of His Majefty's Exchequer, fhall from Time to Time, as the fame fhall be paid into the faid Receipt, be issued and applied to fuch fervices as fhall then have been voted by the Commons of the United Kingdom of Great Britain and Ireland in this prefent Seffion of Parliament, for the Service of the Year One thoufand eight hundred and eight, or fhall be voted by the faid Commons for the Service of any fubfequent Year. XXXII. And be it further enacted, That if any action or Suit fhall be brought or commenced against any Perfon or Perfons for any Thing done in purfuance of this Act, or of any Order in Council referred to in this A&t, fuch Action or Suit fhall be commenced within Three Calendar Months next after the Fact committed, and not afterwards, and fhall be laid in the County or Place where the Caufe of Complaint did arife, and not elsewhere; and the Defendant or De- General Iffue. fendants in every fuch Action or Suit may plead the General Iffue, an give this A&t and the fpecial Matter in Evidence at any Trial to be had thereupon; and if the Jury fhall find for the Defendant or Defend ints in any fuch Action or Suit, or if the Plaintiff or Plaintiffs fhall be nonfuited, or difcontinue his, her, or their Action or Suit after the Defendant or Defendants fhall have appeared, or if upon Demurrer Judgment fhall be given against the Plaintiff or Plaintiffs, the Defendant or Defendants fhall have Treble Cofts, and Treble Cofts. have the like Remedy for the fame as any Defendant had in other Cafes to recover Cofts by Law.

and set forth in the faid Tables, upon Exportation thereof from Grea
Britain, fhall be and the fame are hereby made fubject and liable to al
and every the Conditions, Regulations, Securities, Rules, Restrictions,
Seizures, and Forfeitures, to which Goods, Wares, or Merchandize in
general, and alfo all and every the fpecial Conditions, Rules, Regu-
lations, Reftrictions, Seizures, Sales, and Forfeitures respectively, to
which the like Goods, Wares, or Merchandize were subject and
liable by any Act or Acts of Parliament in force on and immediately
before the paffing of this Act refpecting the Revenue of Customs,
except where any Alteration is exprefsly made by this A&; and all
Pains, Penalties, Fines, and Forfeitures, of whatever Nature or Kind
the fame may be, as well Pains of Death as others, for any Offence
whatever committed againft or in Breach of any Act or Acts of Par-
liament in force on or immediately before the paffing of this Act,
made for fecuring the Revenue of Cuftoms, or for the Regulation or
Improvement thereof, and the feveral Claufes, Powers, Provifoes, and
Directions contained in any fuch Act or Acts, fhall (unless where
expressly altered by this Act) extend to and be refpectively applied,
practifed, and put in Execution, in refpect of the feveral Duties of
Cuftoms hereby charged, in as full and ample a Manner, to all Intents
and Purpofes whatever, as if all and every the faid Acts, Clauses, Pro-
vifoes, Powers, Directions, Fines, Pains, Penalties, or Forfeitures,
were particularly repeated and re-enacted in the Body of this Act,

and made Part thereof.

X. And be it further enacted, That in all Cafes where, by the faid Tables, the Duties of Cuftoms by this Act impofed upon the Exportation of Goods, Wares, and Merchandize from Great Britain, are charged not according to the Weight, Tale, Gauge, or Measure, but according to the Value thereof, fuch Value fhall be confidered as the fame fhall be at the Port of Exportation, without any Deduction or Abatement whatever; and fuch Value shall be afcertained by the Declaration of the Exporter or Proprietor of fuch Goods, Wares, or Merchandize, or his known Agent, in the Manner and Form, and under all the Rules, Regulations, and Reftrictions, and fubject to the fame Forfeitures and Penalties as are prefcribed and directed for afcertaining and collecting the Duties to be paid upon Goods, Wares, and Merchandize, according to the Value thereof, by an A&t paffed in the Twenty-feventh Year of the Reign of His prefent Majefty, intituled, An At for repealing the feveral Duties of Customs and Excife, and granting other Duties in lieu thereof, and for applying the faid Duties together with the other Duties compofing the publick Revenue, for permitting the Importation of certain Goods, Wares, and Merchandize, the Produce or Manufacture of the European Dominions of the French King into this Kingdom, and for applying certain unclaimed Monies remaining in the Exchequer for the Payment of Annuities on Lives to the Reduction of the National Debt; and in cafe any Goods, Wares, or Merchandize, chargeable with any fuch Duty by this Act, according to Value, fhall not be valued according to the true Price or Value thereof, and according to the true Intent and Meaning of this Act, then it fhall be lawful for the proper Officer or Officers of the Cuftoms, to cause the fame to be detained; and the faid Goods, Wares, and Merchandize fhall be dealt with, and the proper Officer of the Cuftoms fhall proceed, with
