of the Navy for the Time being with all Memorials to be by him prefented to the Treasury for Money for fuch Services; in which Memorials the faid Treafurer fhall pray that fuch Sums as fhall be required by the Commiffioners of the Navy may be iffued to the Governor and Company of the Bank of England on his Account.

II. And be it further enacted, That all the other Provifions contained in the faid recited Act, not hereby altered or in any other Act refpecting the Office of Treafurer of the Navy, fhall be and remain in full force and effect as if this Act had not been made.

An Act for abolishing the Office of Surveyor of Subfidies and
Petty Customs in the Port of London. [11th March 1808.]

HEREAS by an Act paffed in the Thirty-eighth Year of 38 G. 3. c. 86. the Reign of His prefent Majefty, intituled, An A for abolishing certain Offices in the Cuffoms, and for regulating certain other Offices ther in; and for applying the Fees which have been received from vacant Offices towards the Augmentation of the Su-· perannuation Fund; certain Offices in His Majefty's Cuftoms in England which had been ufually granted by Letters Patent under the Great Seal, and had been found to be unneceffary, were wholly abolished, and certain other Offices in the faid Customs alfo ufually 'granted by the like Letters Patent were abolished, so far as any of the Duties thereof appeared not to be neceffary or useful, and Provifion was made for the Difcharge of fuch Duties as might be • neceffary or useful, in fuch Manner as fhould be found convenient for the Publick Service; and it is expedient that the Office of Surveyor of Subfidies and Petty Cuftoms in the Port of London fhould alfo 'be abolished, and fhall not in future be granted to any Perfon or • Perfons by patent or otherwise, but that fuch of the Duties thereof as may hereafter be neceffary or ufeful may be executed in fuch Manner as may be found convenient for the Publick Service;' Be it therefore enacted by the King's moft Excellent Majesty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament aflembled, and by the Authority of the fame, That the Office of Surveyor of Subfidies and Petty Cuftoms in the Port of London, being an Office the Duties whereof are in part ufeful and neceffary, fhall not from and after the paffing of this Act, be granted to any Perfon or Perfons by Patent or otherwife, fave as herein-after mentioned; and that, when vacant, the fame fhall forthwith be abolished, and the fame is hereby abolished, fave as herein-after provided.

II. Provided always, That it fhall and may be lawful to and for the Commiffioners of His Majefty's Cultoms, with the Approbation of the High Treasurer, or the Commiffioners of His Majefty's Treafury, or any Three of them for the Time being, to provide for the Execution of fuch of the Duties of the faid Office, as fhall in their Judgment appear to be neceffary or useful, by appointing, by Inftrument or Inftruments under their Hands, (with the Approbation aforefaid,) a proper Perfon or proper Perfons to execute during their Pleasure fuch neceffary and useful Duties of the said Office when vacant as aforefaid, and otherwise to regulate the faid Office in fuch Manner as the Commiffioners of His Majesty's Customs, with the Approba tion

en Spirits made in Scotland, as relates to delivering up the
Licences granted for diftilling Spirits in the Low-lands of
Scotland, and for better preventing private Diftillation.

HEREAS by an Act, paffed in the Forty-fixth Year of His prefent Majefty's Reign, intituled, An A&t for repealing the Duties of Excife on Stills used for diftilling or redifying Low Wines or Spirits for Confumption in Scotland, on Worts or Wash made for extrading Spirits, and on Spirits made for Confumption in Scotland, and for granting and fecuring other Duties in lieu thereof; and for better fecuring the Duties on Foreign Spirits and on Malt; it was amongst other Things enacted, That all Licences to make, diftil, rectify, or compound Spirits in the Low-lands of Scotland should be granted in the Manner and Form directed by an Act of the Thirty-ninth and Fortieth Years of His prefent Majefty's Reign, intituled, An Ad for repealing the Duties of Excife on Distilleries in Scotland, and on the Exportation of British made Spirits from England to Scotland, and for granting other Duties in lieu thereof, and for altering, amending, and continuing certain Ads of Parliament for the Regulation of Distilleries in Scotland, fave and except that every fuch Licence fhould commence and take Effect from the First Day of October in each Year, and that no fuch Licence should be granted, fave and except between the First Day of October and the First Day of November in each Year; provided always, that it fhould and might be lawful to and for any licenfed Distiller in the Low-lands of Scotland to deliver up to the Commiffioners of Excife, or to the proper Supervisor or Surveyor of the District,

his or their Licence to be vacated on the Terms and Conditions and at the Time and in the Manner directed by the faid Act of the Thirty-ninth and Fortieth Years of His prefent Majefty's Reign; 'any Thing in the faid Act or any other Act to the contrary notwithstanding; And whereas Doubts have arifen as to the Meaning and true Conftruction of the faid Claufe, and it is expedient to 'explain and amend the fame;' Be it therefore enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons in this prefent Parliament affembled, and by the Authority of the fame, That when and so often as any Diftiller or Diftillers in the Low-lands of Scotland fhall duly deliver up to the faid Commiffioners of Excife in Scotland, or to the proper Supervifor or Surveyor of the District, his, her, or their Annual Licence, to be vacated before the Expiration of the Year for which fuch Licence fhall have been granted, and before he, she, or they fhall have brewed, made, or received, or diftilled into Spirits a Quantity of Worts or Wafh fufficient to produce Two thoufand and twenty-five Gallons of Spirits of the Strength of One to Ten over Hydrometer Proof, for each and every Gallon of the full Content or Capacity of the Still or Stills fpecified and mentioned in fuch Licence, computing Sixteen Gallons and One Half of a Gallon of fuch Spirits of the Strength aforefaid, for every One hundred Gallons of fuch Worts and Wash, fuch Distiller or Distillers fhall pay fuch a Proportion of the Annual Licence Duty as the Whole Quantity of Spirits diflilled by him, her, or them, bears to the full Quantity of Two thoufand and twenty-five Gallons of the Strength of One to Ten over Hydrometer Proof, for each and every Gallon of the full Content or Capacity of the Still or Stills mentioned in fuch Licence, or as the whole Quantity of Worts or Wash brewed, made, or received by fuch Diftiller or Distillers bears to the full Quantity of Two thoufand and twenty five Gallons of Spirits, calculated at the Strength aforefaid, for each and every Gallon of the full Content and Capacity of fuch Still or Stills, and computed at the Rate of Sixteen Gallons and One Half of a Gallon of Spirits for every One hundred Gallons of fuch Worts or Wash: Provided always, that if the Quantity of the Worts or Wash brewed, made, or received by fuch Distiller or Diftillers, computed at the Rate aforefaid, at the Time of vacating fuch Licence, fhall be found to exceed the Quantity of Spirits actually diftilled by fuch Distiller or Diftillers, under and by virtue of fuch Licence, that then and in fuch Cafe the faid Proportion of Licence Duty fhall be charged upon and paid and payable by him, her, or them, according to fuch Proportion of Worts and Wafh fo brewed, made, or received by fuch Diftiller or Diftillers, but not otherwife.

II. Provided alfo, and be it further enacted, That all and every Perfon or Perfons intending to deliver up his, her, or their Licence or Licences to be vacated, fhall give to the Commiffioners, Supervisor, Surveyor, or Officer of Excife, Fifteen Days Notice in Writing, figned by fuch Perfon or Perfons, of fuch Intention, before he, she, or they fhall be entitled to discontinue the working of his, her, or their Still or Stills licensed as aforefaid, and thereupon the faid Commiffioners, Supervifor, Surveyor, or Officer fhall and they are hereby refpectively authorised to vacate the faid Licence or Licences, but not fooner than at and from the End of any One Calendar Month,

from which Time the Licence Duty fhall have been actually paid in Advance by fuch Perfon or Perfons; it being the true Intent and Meaning of the faid Act made and paffed in the Forty-fixth Year of His prefent Majefty's Reign, that no Part of the faid Licence Duty which fhall have been actually paid in Advance by fuch Perfon or Perfons fhall be, under any Circumftances or any Account whatsoever, returned or repaid to fuch Perfon or Persons. III. And whereas private and illicit Diftillation is in many Parts of Scotland carried on to a great Extent to the manifeft Injury of the fair Trader and the very great Diminution of the Publick Revenue: And whereas Wafh and other Materials fit and proper for Distillation are often found in the Cuftody and Poffeffion of • Perfons notoriously concerned in fuch illicit Practices, and fuch Offenders frequently escape from the Penalties of the Law by the • Removal and Concealment of their Still or Stills,' for remedy whereof be it enacted, that all and every Perfon and Perfons in Scotland, not being an entered Diftiller, Brewer, or Vinegar-maker, in whofe Poffeffion any Quantity of Wafh, fermenting or fermented exceeding the Quantity of Twenty Gallons, or any Quantity whatfoever of Low Wines fhall be found, fhall feverally forfeit and lofe the Sum of One hundred Pounds; and all fuch Wafh and Low Wines, fhall and may be feized or deftroyed by any Officer or Officers of Excife; which faid Penalty of One hundred Pounds fhall and mɩy be fued for, levied, mitigated, and applied, by fuch Ways, Means, and Methods, as any Fine, Penalty, or Forfeiture, may be fued for, levied, mitigated, and applied, by any Law or Laws of Excife, or by Plaint or Information in the Court of Exchequer in Scotland: Provided always, that it fhall not be lawful for any Juftices of the Peace in Scotland, by or before whom fuch Perfon or Perfons fhall be convicted under any Prétence what foever to mitigate or leffen the faid Penalty of One hundred Pounds to lefs than Twenty Pounds; and if the Penalty adjudged against fuch Perfon or Perfons be not forthwith paid down to the Profecutor, or to the Person authorized by him to receive the fame, fuch Juftices of the Peace by or before whom fuch Perfon or Perfons was or were convicted, are hereby authorized and flrictly enjoined and required, immediately by their Warrant under their Hands, to commit fuch Offender and Offenders to the Gaol or Prifon of the County for any Time not exceeding Six Months nor lefs than Three Months, unlefs fuch Penalty fhall be fooner paid.

An Act for permitting the Importation of Goods from the
Portuguefe Territories on the Continent of South America, in
Portuguese Ships.
[11th March 1808.]

WHEREAS it is expedient to permit the Produce of Brazil,

or any other Territories of the Crown of Portugal, in South America, to be imported into Great Britain, and Ireland, in Ships of thofe Countries, or of Portugal; May it therefore please Your Majefty that it may be enacted; and be it enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from

and after the paffing of this A&t, it fhall and may be lawful to import into the United Kingdom, directly from Brazil, or any of the Territories and Poffeffions of the Crown of Portugal on the Continent of South America, in Ships or Veffels built in the Kingdom of Portugal, before the firft Day of January One thoufand eight hundred and eight, or in Ships or Veffels built in any of the aforelaid Territories or Poffeffions on the Continent of South America, or in Ships or Veffels taken by the Ships or Veffels of War belonging to the Portuguefe Government, or belonging to any Subjects of the faid Government, having Commiffions or Letters of Marque and Rep rital from the Portuguese Government, and condemned as lawful Prize in any Court of Admiralty of the Portuguese Government, of which Condemnation Proof fhall be given to the Satisfaction of the Com. millioners of His Majefty's Customs, or any Four or more of them, in that Part of the United Kingdom called England, or any Three or more of them in that Part of the United Kingdom called Scotland, or to the Satisfaction of the Commiffioners of the Cuftoms, or any Three or more of them, in Ireland, and owned by Subjects of the Portuguese Government refident in the faid Territories and Poffeffions on the Continent of South America, and whereof the Mafter and Three Fourths of the Mariners at least are Subjects of the Portuguese Government, and Refidents in the faid Territories and Poffeffions, any Goods, Wares, or Merchandize, the Growth, Produce, or Manufacture of the faid Territories and Poffeffions (which are not prohibited by Law to be imported from Foreign Countries); and to enter and land fuch Goods, Wares, and Merchandize, upon Payment of the fame Duties as are now payable on fuch or fimilar Articles when imported from the Kingdom of Portugal, fubject to the like Conditions and Regulations as in the Cafe of fuch Goods not imported in a British-built Ship; any Thing in an Act paffed in the Twelfth Year of the Reign of His Majefty King Charles the, Second, intituled, An Ad for the encouraging and encreasing of ra Car. 2. «. 18. An Act to amend and continue, until the Twenty-fifth Day of March One thoufand eight hundred and nine, fo much of an Act of the Forty-feventh Year of His present Majefty as allows certain Bounties on British Plantation Raw Sugar exported. [21st March 1808 ] WHE HEREAS by an A&t paffed in the Forty-feventh Year of 47 G. 3. ft. 1. His prefent Majefty, intituled, An Act to allow for Two c. 22. § 8; Years from and after the paffing of this A, an additional Bounty granting Bounty on Exportation on double refined Sugar, and to extend former Duties on other refined of Raw Sugar Sugar, to fuch as shall be pounded, crashed, or broken; and to allow continued. for One Year certain Bounties on British Plantation Raw Sugar exported; certain Bounties, under certain Conditions, are allowed on the Exportation of Raw Sugar the Produce of the British Plant⚫ations in the fame State in which it was imported: And whereas it is expedient that the faid Bounties fhould be further continued, and the faid Act amended;' Be it therefore enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the
