vant, or other Perfon, or fhall in any way be interested in keeping of the Revenue any Publick Houfe or Tavern, or Place of publick Entertainment, Laws, &c. fhall or in the felling of any Wine or Spirituous Liquors, or Tobacco be difmiffed or or Tea (unless fuch Pilot fhall have kept, or been concerned or in- fufpended. terested in the fame before the First Day of March One thousand eight hundred and eight, and fhall be duly authorized by the Corporation or Authority under which fuch Pilot shall act, to continue in fuch Bufinefs or Employment); or if any Pilot licensed as aforefaid shall be convicted of any Offence against any Law or Laws relating to the Revenues of Customs or Excife, or shall be concerned in, or fhall wilfully connive at any indirect Practices or Frauds against the Revenues of Cuftoms or Excife, or fhall procure, abet, connive at, or participate in any Deftruétion, Spoil, Concealment, Fraud, Exaction, or corrupt Practice relating to Ships or Veffels, or Perfons in Diftrefs at Sea, or by Shipwreck, or relating to the Tackle, Apparel, or Furniture, or the Cargoes of fuch Ships or Veffels, or relating to the Crew or Paffengers belonging thereto, or the Monies, Goods, or Chattels of any of them, then and in every fuch Cafe every fuch Pilot fhall (over and above all other Punishments, Mulets, and Penalties, » for fuch Offences) be difmiffed from being a Pilot, or fhall be fufpended from acting as fuch. at the Difcretion of the Corporation or other Authority from which fuch Pilot's Licence was derived.

XLII. And be it further enacted, That no Person fhall take Charge of any Veffel, or in any Manner act as a Pilot, or receive any Compenfation for acting as a Pilot, unlefs he fhall be authorized thereto, by fome lawful Licence, nor until fuch Licence fhall have been regiftered by the principal Officers of the Cuftom House of the Place at or nearest to which fuch Pilot fhall refide, which Officers are hereby required to regifter the fame without Fee or Reward, nor without having his Licence at the Time of his fo acting in his perfonal Cuftody ready to be produced, and which he fhall actually produce to the Master of any Ship or Veffel, or other Perfon who fhall be defirous of employing him as a Pilot; nor fhall any Perfon, although duly licenfed to act as a Pilot, act in that Capacity out of or beyond the Limits expreffed in his Licence, or beyond the Extent of his Qualification therein expreffed; on pain of forfeiting a Sam not exceeding Penalty. Thirty Pounds nor lefs than Ten Pounds for the First Offence, and for any Second or fubfequent Offence any Sum, not exceeding Fifty Pounds nor less than Thirty Pounds.

XLIII. And be it enacted, That on the Death of any Pilot, his Executors and Adminiftrators, or One of them, or the Perfon or Perfons to whofe Hands the Licence of fuch deceased Pilot shall come, fhall, without wilful Delay, tranfmit fuch Licence to the Corporation, Company, or Perfons by whom fuch Licence was granted, on pain of forfeiting for any Neglect therein, or for Refufal to deliver the fame when lawfully demanded, a Sum not exceeding Twenty Pounds nor lefs than Forty Shillings.

XLIV. And be it further enacted, That it fhall be lawful for the faid Corporation of Trinity House of Deptford Strond, and alfo for the faid Society or Fellowship of Pilots of Dover, Deal, and the Ifle of Thanet, and alfo for all other Corporate Bodies, or other Perfons having lawful Authority to appoint Pilots within the Limits of their refpective Jurifdictions, to licenfe Veffels of fuch Size and Defcription as fhall appear to them to be proper for the Purpose of having them at Sea, and 48 Geo. Pilots conftantly in Attendance in fuch Veffels at Sea; and for the better Support of fuch Pilot Veffels, it fhall be lawful for any Number of Pilots licenfed by virtue of this Act, or otherwife lawfully licensed, with the Confent of the faid Corporate Bodies, or Perfons by whom refpectively fuch Pilots have been or fhall be appointed as aforefaid, to conftitute a Joint Stock Company or Companies for the providing and maintaining of fuch Pilot Veffels; which Companies, and the faid Veffels, thall at all Times be fubject to fuch Rules and Regulations as fhall from Time to Time be fanctioned and approved in that Behalf by the faid Corporate Bodies, or Perfons by whom refpectively fuch Pilots fhall refpectively have been licensed.

XLV. And be it further enacted, That every Pilot Boat or Veffel, or other Boat or Veffel in the Pilot Service of any Corporation or Society established by Law in relation to Pilotage, or of any Perfons authorifed to act as a Pilot by fuch Corporation or Society, fhall at all Times and on every Station be fitted with Black Sides, and have the upper Strake next the Gunwale painted White, and fhall while afloat carry a Vane at the Maft Head, or elfe a Flag on a Sprit or Staff, or in fome other equally confpicuous Situation; which Vane or Flag shall be of large Dimenfions, proportioned to the Size of the Boat or Veffel carrying the fame, and fhall be half Red and half White, in horizontal Stripes, of which the uppermoft fhall be White, and the fame fhall at all Times be kept and preferved in a clean and diftin&t Condition, fo as to be easily difcerned at a proper and fufficient Distance, and every fuch Boat or Veffel fhall alfo have the Name of the Principal Pilot thereof for the Time being, painted in broad White Letters of Three Inches in Length on a Black Ground on her Stern, and on each Bow fuch Number as shall be expreffed in the Licence of fuch principal Pilot; which Name and Numbers fhall not be hid or concealed by any Perfon at any Time, on pain of forfeiting the Sum of Twenty Pounds for fuch Omiffion or Evafion, to be paid by fuch principal Pilot, who fhall at all Times be anfwerable for the due Obfervance of the Matters aforefaid, by every Perfon on board fuch Boat or Veffel; and every other Boat not in the Service of any Corporation or Society carrying off a Pilot, fhall exhibit a fimilar Flag on a Sprit or Maft, to distinguish that he has a Pilot on board.

XLVI. And be it further enacted, That if any Boat or Veffel, not having a licenfed Pilot on board, fhall without lawful Authority carry fuch diftinguishing Vane or Flag as aforefaid, the Owner or Owners, or the Malter or other Perfon having Charge of fuch Boat or Veffel, difplaying or carrying any fuch Vane or Flag, fhall for every fuch Offence forfeit and pay the Sum of One hundred Pounds. XLVII. And be it further enacted, That every Pilot licensed by virtue of this Act, or otherwise duly licensed, who fhall, when difengaged or on any frivolous Pretexts, decline to take charge of any Ship or Veffel, unlefs fuch Caufe fhall be fhewn by the Pilot as fhall juftify his not taking charge of the Ship, or who fhall decline, on being required by any Captain of any of His Majefty's Ships, or the Matter or other Perfon having the Charge of any Ship or Veffel, to come on board of any Ship or Veffel, or who fhall decline, when required by any Commiffioned Officer in His Majefty's Navy, or by any Principal Officer of His Majefty's Cuftoms, or by any other Perfon or Perfons interested as Principal or Agent for or on Behalf of any Ship or Veffel wanting a Pilot, to go off to and take charge of

any

any Ship or Veffel when it fhall be fafe fo to do; or who fhall exact or demand, or bargain for any greater Fee or Reward, or any greater Price or Hire for Pilotage than as are or fhall be allowed by fuch Rates or Rules as are or fhall hereafter be legally established in that Behalf; or who fhall in anywife delay going on board any fuch Ship or Veffel, or taking Charge thereof when on board or alongfide thereof, or who fhall quit any fuch Ship or Veffel, or decline the piloting thereof after he has been engaged or after going along fide thereof, without Leave of the Owner, Mafter, Captain, or Perfon having the chief Command of fuch Ship or Veffel, or before the Service hall have been performed for which he was hired, or shall by Drunkennefs render himfelf incapable of conducting fuch Ship or Veffel, or fhall negligently or wilfully run fuch Veffel on Shore, or lofe the fame, or do any Injury to the fame or to the Tackle or Furniture thereof, or who fhall lend his Licence to any unlicensed Perfon, to enable or affift him towards acting or claiming to act as a licensed Pilot, fhall forfeit for every fuch Offence any Sumn not exceeding One hundred Pounds, nor lefs than Ten Pounds, and fhall be liable to be difmiffed from being or fufpended from acting as a Pilot, at the Difcretion of the faid Corporation of Trinity Houfe of Deptford Strond, or at the Discretion of fuch other Corporate Body, or Person or Perfons by whom fuch Pilot was licenfed.

XLVIII. And be it further enacted, That in cafe any Pilot licenfed by virtue of this Act fhall employ or make use of, or shall compel or require any Perfon having the Command or Charge of Ship or Veffel, to employ or make ufe of any Boat, Anchor, Cable, Hawfer, or any other Matter or Thing in or for the Service or pretended Service of fuch Ship or Veffel, beyond what fhall actually and bona fide be neceffary and proper for the Ufe thereof, with Intent thereby to enhance or increafe the Charge or Expence of Pilotage or Pilot Affiftance of fuch Ship or Veffel, whether for the Gain and Emolument of fuch Pilot, or for the Gain or Emolument of any other Perfon or Perfons whom foever, then and in every fuch Cafe the Perfon fo offending fhall forfeit and pay a Sum not exceeding Fifty Pounds nor lefs than Ten Pounds, and fhall also be liable to be deprived of his Licence, or to be fufpended from acting as a Pilot for a limited Time, at the Difcretion of the faid Corporation of Trinity Houfe of Deptford Strond, or other Authority by which he is or fhall be licensed.

XLIX. And be it further enacted, That in cafe any Perfon licenfed to act as a Pilot by virtue of this Act, or otherwife duly licensed, or any Perfon not being a Pilot, but acting under pretext or colour of Pilotage, fhall wilfully and knowingly conduct, lead, decoy, or betray any Ship or Veffel into Danger in any Manner not already provided against by any Statute or Statutes; or fhall unneceffarily or improperly cut any Cable or Cables of or belonging to any Ship or Veffel, or caufe or procure the fame to be cut unneceffarily and improperly; or if any fuch Perfon fhall, by wilful Mifreprefentation of any Circumftances upon which the Safety of any Ship or Veffel shall appear materially to depend for the Time being, obtain or endeavour to obtain the Charge and Conduct of any Ship or Veffel, then and in every fuch Cafe the Perfon fo offending, or who fhall aid in, procure, abet, or connive at the committing of any fuch Offence or Offences, fhall forfeit and pay a Sum not exceeding One hundred

Pounds, nor less than Twenty Pounds; and in cafe the Perfon fo offending fhall be a Pilot, he fhall be either difmiffed from being a Pilot, or fufpended from acting as fuch for a limited Period, at the Difcretion of the Corporation or other Authority by whom such Pilot was licenfed.

L. And be it further enacted, That if any fuch licensed Pilot Veffel or Boat fhall run before any Ship or Veffel, not having a licensed Pilot on board, for the Purpofe of directing the Course of fuch Ship or Veffel until a Pilot can be put on board, the Pilot on board fuch Pilot Veffel, or the Perfon having Charge of her, fhall be entitled to the full Pilotage for the Distance run, until a duly licensed Pilot shall be put on board, as if fuch Perfon had been actually on board fuch Ship, and had the Charge of her as a Pilot.

LI. And be it further enacted,That no Pilot shall be taken to Sea by the Commanding Officer of any of His Majefty's Ships, or by any Mafter of any Ship or Veffel in the Merchant Service, without his free Confent, except in cafe of abfolute and unavoidable Neceflity; and in fuch Cafe every Pilot so taken to Sea fhall have and receive Ten Shillings and Sixpence per Diem, until he fhall be returned to the Port or Place where he was taken on board, or until he shall have been difcharged from the Ship for a fufficient Time to have enabled him to return there.

LII. And whereas it is expedient that the furplus Rates of Pilotage impofed by this Act on Ships not having British Regif ters, fhould be applied for creating a Fund for fuch Pilots belonging to the Trinity House of Deptford Strond, and of the Fellowship of the Cinque Ports as fhall be fuperannuated;' be it enacted, That all fuch Excefs of Rates as aforefaid, which fhall pertain to the Eftablishment of the Trinity Houfe, fhall be paid to a Receiver or Receivers, to be appointed in that Behalf by the faid Corporation at fome Place or Places convenient for the making of fuch Payment within the Port of London, and fhall be applied by the faid Corpora tion in the Manner herein-after directed; and if fuch extra Rates of Pilotage fhall pertain to the Eftablishment of the Cinque Ports, then the fame fhall be paid to a Receiver or Receivers, to be in that Behalf appointed by the Lord Warden and the Court of Loadmanage, at fome convenient Place or Places for the Payment thereof within the faid Port of London, and fhall be applied by the faid Court in the Manner hereinafter in that Behalf directed; that is to fay, in both Cafes to create a Fund for the better Support and Maintenance of fuch Pilots as fhall become incapable of difcharging their Duty from advanced Age, or from any Accident, or permanent Infirmity, to be applied and diftributed in fuch Manner, and under fuch Rules and Regulations as the Corporation of the Trinity Houfe of Deptford Strond, and the Lord Warden and the Court of Loadmanage of the Cinque Ports fhall refpectively order and provide, of which Receipts and Appropriations the faid Corporations and Courts refpectively fhall annually lay an Account thereof before Parliament, within Ten Days after the Commencement of each Seffion.

LIII. And be it further enacted, That all Sums of Money which fhall become due to any licensed Pilot for Pilotage, fhall and may be recovered from the Owners or Mafters of Ships or Veffels, or from the Confignees or Agents thereof, not being Foreign Ships or Vesfels, who fhall have paid or made themfelves liable to pay any other

Charge for the Ship or Veffel in the Port of her Delivery, and shall and may be levied in fuch and the like Manner according to the Amount of any fuch Sums of Money refpectively, as any Penalty or Penalties may be recovered and levied under and by virtue of this Áct, Demand thereof being made in Writing at leaft Fourteen Days be fore fuch Levy.

LIV. And be it further enacted, That the Confignees or Agents of all Foreign Ships and Veffels, who fhall have paid or engaged to pay any Charge whatever in relation to fuch Ship or Veffel, fhall be liable to the Payment of, and fhall pay all Sums for Pilotage outwards, due to the Pilot or Pilots who fhall have piloted fuch Ships or Veffels, on Proof being made within Fourteen Days after fuch Pilotage fhall have been performed, on the Oath of fuch Pilot before any Justice of the Peace, that the fame has not been paid by the Captain of fuch Ship or Veffel; and in fuch Cafe the Sums of Money fo due for Pilotage fhall be recoverable in like Manner as any Penalty under the Sum of Ten Pounds may be recovered by virtue of this Act; and fuch Confignees or Agents of Foreign Ships or Veffels are hereby authorifed and empowered to retain in their Hands refpectively, out of any Monies which they may have received for or on account of fuch Foreign Ship or Veffel, or the Owner or Own ers thereof, so much as fhall be fufficient to pay and difcharge such Pilotage outwards, and any Expences attending the fame. LV. And be it further enacted, That the Mafter of every Ship or Veffel which fhall be piloted or conducted by any other than a duly licenfed Pilot, within any Limits for which Pilots have been or fhall be appointed by any lawful Authority, fhall forfeit Double the Amount of the Sum which would have been demandable for the Pilotage of fuch Ship or Veffel, together with Five Pounds for every Fifty Tons Burthen of fuch Ship or Veffel; Provided always, that nothing in this Act fhall extend to fubject to Penalties any Matter of any Ship or Veffel who shall act himself as Pilot in paffing up and down the English Channel, or elsewhere in paffing by any Part of the Coaft of England, in the Course of any Voyage, or within the Limits of the Port or Place to which his Ship belongs, not being a Port or Place in relation to which Provifion hath heretofore been made by any Ac or Acts of Parliament, or by any Charter or Charters for the Appointment of Pilots, or who fhall employ any Perfon as a Pilot, or who thall act himself as fuch for the Conduct of his Ship or Veffel, in any Cafe where and fo long as a duly qualified Pilot fhall not offer Affiftance or make a Signal for that Purpose: Provided alfo, that this A&t shall not extend or be construed to extend to hinder any Perfous from affifting any Ship or Veffel in Diftrefs at any Time or Place, nor fhall fubject fuch Perfons, or any Master of any Ship or Veffel employing fuch Perfons, to the Penalties of this Act, in refpect of fuch Ailiftance given during the Distress of fuch Ship or Veffel, or in confequence thereof, or under any Circumftances which shall have rendered it neceffary for fuch Mafter to avail himself of the best Affiftance which at the Time could be procured; any Thing herein contained to the contrary thereof in anywife notwithstanding.

LVI. And be it further enacted, That every Perfon having the Command or Charge for the Time being of any Ship or Veffel, who shall report, or be privy or confenting to any other Perfon's reporting to any Pilot taking the Charge of fuch Ship or Veffel, a falfe
