all Times hereafter pay or caufe to be paid to the faid Corporation of Trinity Houfe of Deptford Strond, or to fuch Perfon or Persons as they fhall appoint to receive the fame on their Behalf, the Sum of Three Guineas, in the Month of January yearly, which Payment fhall be accepted by the faid Corporation in lieu and Satisfaction of and for all the ancient and accustomed Duties payable by fuch Pilots to the faid Corporation, under the Provifions of an Act paffed in the Fifth Year of the Reign of George the Second, or any other Statute or Charter whatever, and fhall be applied for the Ufe and Benefit of the Poor of the faid Corporation (after firft defraying thereout the Expences incurred by the faid Corporation) from Time to Time in carrying this A&t into Execution; and in cafe fuch annual Payment fhall not be duly made by the faid Pilots refpectively, it shall be lawful for the faid Corporation to fufpend the Perfons fo making Default from acting as Pilots, until due Payment shall be made of such annual Sums.

V. And be it further enacted, That no Perfon fhall be licensed by the faid Corporation of Trinity Houfe of Deptford Strond, as a Pilot for the Rivers of Thames or Medway, or the Channels leading thereto or therefrom, under the Provifions of this Act, who fhall not have ferved as Mate for Three Years on board a fquare-rigged Veffel, or fhall not have been in the actual Comn.and of a square-rigged Veffel for One Year, or who fhall not have been employed in the Pilot Service of the Corporation of Trinity Houfe of Deptford Strond for Seven Years, or who fhall not have ferved an Apprenticeship of Five Years to fome Pilot Veffel licensed under this Act.

VI. And be it further enacted, That no Perfon fhall be licensed or be allowed to take charge as a Pilot of any Ship or Veffel drawing more than Fourteen Feet Water in the Rivers of Thames or Medway, or any of the Channels thereof, until fuch Perfon fhall have been licenfed, and fhall have acted as a Pilot for Three Years under lawful Authority, on pain of forfeiting Ten Pounds for every fuch Of fence, as well by the Perfon acting as fuch Pilot, as alfo by the Mafter or Commander, or other Perfon having charge of fuch Ship or Veffel, who fhall permit any fuch Perfon to take charge as a Pilot of the fame, contrary to the Provifion aforefaid.

No Perfon fhall be licensed as a Pilot unless qualified as herein specified.

And be it further enacted, That no Perfon fhall, from and after the First Day of Odober One thousand eight hundred and eight, take charge of any Ship or Veffel as a Pilot belonging to the Society or Fellowship of Pilots of Dover, Deal, and the Ifle of Thanet, commonly called Cinque Port Pilots, before he fhall be examined by the Mafter and Two Wardens, or by Four Wardens of the faid Society or Fellowship for the Time being, touching his Abilities, and fhall be approved and admitted into the Society or Fellowship of the Trinity Houfe of Dover, Deal, and the Isle of Thanet, at a Court of Loadmanage, holden by the Lord Warden of the Cinque Ports, for the Time being, or his Deputy, and the Commiffioners for Loadmanage for the Time being; and if any Perfon fhall prefume to act as a Pilot belonging to the faid Society or Fellowship, without having been fo examined, approved, and admitted as aforefaid, every fuch Perfon fhall for the First Offence forfeit Ten Pounds, for the Second Twenty Pounds, and for every other Offence Forty Pounds, VIII. of Dover, Deal, and the Ifle of Thanet, as fhall be appointed from Time to Time, to examine into the Skill and Ability of any Perfon on his being first admitted as a Pilot into the faid Society or Fellowfhip, fhall take the Oath marked (C.) in the Schedule hereunto annexed, to be administered to him by the Register of the Court of Loadmanage, who is hereby authorized to adminifter fuch Oath.

IX. And be it further enacted, That from and after the First Day of October One thoufand eight hundred and eight, the refpective Rates or Prices herein-after enumerated in the Table marked (B.) in the Schedule to this Act annexed, may be lawfully demanded and received by any Pilot licenfed by the Society or Fellowship of Pilots of Dover, Deal, and the Ifle of Thanet, for the conducting of any Ship or Veffel from Place to Place, as expreffed in the faid Table; and that no greater Rates or Prices, or other Reward or Emolument fhall, under any Pretence whatever, be received than fuch Rates or Prices.

X. And be it further enacted, That a proper and fufficient Number of Pilots of the Cinque Ports, not lefs than Eighteen at any one Time, and in Succeffion from Time to Time, without Intermiffion or any unneceffary Delay, fhall, at all feasonable Times by Day and Night, conftantly ply at Sea, or be afloat between the South Foreland and Dungeness, to take charge of Ships and Veffels coming from the Weftward, and proper Signals fhall be established, to be made at and from Signal Houfes now erected, or which may be erected on commanding Situations near to Dover, to give Notice of Fleets of Veffels coming from the Weftward; and upon the making of any Signals, giving Notice of the Approach of any Fleet from the Weftward, all Cinque Port Pilots not on Duty at the Time, fhall, according to fuch Rules and Regulations as to Number, Rotation, or otherwife as fhall be made in that Behalf, forthwith prepare to go afloat, and shall go off in fufficient Time to fall in with fuch Ships and Veffels, on pain of forfeiting, in cafe of Neglect herein, for the First Offence the Sum of Twenty Pounds, and for the Second the Offender fhall be fufpended from acting as a Pilot for Twelve Months, and for the Third Offence fhall forfeit his Licence to act as fuch Pilot, and shall be rendered thereby incapable of acting thereafter as a Pilot.

XI. And be it further enacted, That the Master or other Person having the Command of any Ship or Veffel coming from the Weftward not having ward, and bound to any Place in the Rivers of Thames or Medway, not having a duly qualified Cinque Port Pilot on board, fhall, on the Arrival of fuch Ship or Veffel off Dungeness, and until the fhall have paffed the Buoy of the Brake, or a Line to be drawn from Sandown Castle to the faid Buoy, (unless in the mean Time she shall have received a proper Cinque Port Pilot on board) difplay and keep flying the ufual Signal for a Pilot to come on board; and if any duly qua lified Cinque Port Pilot fhall be within hail, or approaching and within Half a Mile, with the proper diftinguishing Flag or Vane flying in his Veffel or Boat, the Mafter or other Perfon having the Command of fuch Ship or Veffel fhall, by heaving to in proper Time or by all practicable Means, confiftently with the Safety of the Ship or Veffel, facilitate fuch Pilot getting on board, and fhall give the Charge of piloting of his Ship or Veffel to fuch Cinque Port Pilot; and every Perfon commanding any fuch Ship or Veffel, who fhall decline to

take any fuch Cinque Port Pilot on board, or to give fuch Charge of his Ship or Veffel to fuch Pilot, or who fhall not heave to, or otherwife facilitate fuch Pilot coming on board as aforesaid, shall be subject to the Penalties by this Act impofed for neglecting or declining to take on board a Pilot, and for navigating his Veffel without a Pilot, contrary to the Provifions of this Act: Provided always, that if any Ship or Veffel bound to the Rivers Thames or Medway, fhall anchor any where in the Downs between the South Foreland and a Line drawn from Sandown Castle and the South Buoy of the Brake, having any licensed Pilot other than a Cinque Port Pilot on board, it fhall be lawful for a Cinque Port Pilot to repair on board the fame, at any Time before fuch Ship or Veffel fhall have been at an Anchor One Hour, with the Signal for a Pilot flying, and to take Charge of her up the faid Rivers, but not otherwise.

XII. And whereas, great Convenience to Trade will arife by putting an End to the prefent prevailing Usage of Cinque Port Pilots quitting Ships or Veffels at Gravefend, or elfewhere in the Thames or Medway, at their Difcretion be it therefore enacted, That from and after the Expiration of Twelve Months next after the paffing of this Act, if any Cinque Port Pilot, taking Charge of any Ship or Veffel into the Thames or Medway, fhall quit fuch Ship or Veffel at Gravefend, or in any other Part of the Thames, or in any Part of the Medway, before fuch Ship or Veffel fhall have arrived at the Place to which fuch Ship or Veffel is bound in the faid Rivers Thames or Medway respectively, without the Confent of the Captain or other Perfon having the Command thereof, unless fome other duly qualified Pilot fhall, with fuch Confent, come on board, and fhall take the Charge and Conduct of fuch Ship or Veffel for the Residue of the Pilotage to be performed, every fuch Pilot fhall forfeit for every fuch Offence all Pay or Reward to which he might be entitled for having conducted or piloted fuch Ship or Veffel into the Rivers Thames or Medway, and shall also be subject to fuch other Penalty or Punishment as by virtue of any of the Provisions of this Act, or of the Rules and Regulations to be established in pursuance hereof, any Pilot fhall be liable to for quitting a Ship or Veffel before the fhall arrive at her Place of Deftination.

XIII. And be it further enacted, That the Lord Warden of the Cinque Ports for the Time being, or his Deputy, with the Affent of the Commiffioners of Loadmanage, and of the Masters and Wardens of the Society or Fellowship of Pilots of Dover, Deal, and the Isle of Thanet, or the major Part of them, at an Affembly commonly called A Court of Loadmanage, to be held by the said Lord Warden or his Deputy, fhall, within Four Calendar Months after the paffing of this Act, proceed to make and fhall make fufficient Rules and Orders for enforcing the due Obfervance of the Provifions of this Act by all Cinque Port Pilots, and for providing for the good Government and Regulation of all fuch Pilots, as well relating to the Services of the faid Pilots in going off to and taking Charge of and conducting and navigating His Majefty's Ships and Veffels, and the Ships and Veffels in His Majesty's Employ, and alfo all Ships and Veffels whatever and wherefoever, within the proper and ufual Limits of fuch Pilots, or wherein they fhall for the Time being act or be, and for effectually fecuring the Performance of all the Duties and Services of fuch Pilots at all Times; which Rules and Regulations when fo made 6 fhall

fhall be forthwith printed and tranfmitted to the Custom House in Londen, that the fame may be seen by all Perfons interested therein; and Copies thereof shall be delivered to every Member of the faid Society, and alfo to every new Member of the faid Society on his Election; and a Copy or Extract thereof fhall be annexed to or indorfed upon the Licence or Warrant of every Pilot belonging to the Cinque Ports, as well thofe already admitted and licensed as all others hereafter to be licensed as fuch Pilots; and it fhall be lawful in fuch Rules and Regulations to establish Penalties and Forfeitures for the enforcing fuch Rules and Regulations and better ordering of the faid Pilots, and for fufpending or depriving any of the faid Pilots for breaking fuch Rules or Orders, or omitting to do any Thing required by the fame to be done, or for acting in anywife contrary to fuch Rules or Orders.

XIV. Provided always, and be it further enacted, That if fuch Rules and Regulations in relation to Cinque Port Pilots fhall not be made and tranfmitted as aforefaid, within Four Calendar Months after the paffing of this Act, or if fuch Rules and Regulations, when made and tranfmitted, fhall appear to be in any material Point erroneous, infufficient, or defective, it fhall be lawful for any Owner of Ships, or other Perfons interested in the Matter of fuch Rules or Regulations. to apply to His Majefty's Moft Honourable Privy Counand diftributed. cil, who fhall thereupon caufe proper and fufficient Rules and Regulations to be drawn up for the Purposes aforefaid, in cafe no fuch Rules and Regulations fhall have been made and tranfmitted as aforefaid, or fhall amend, correct, or enlarge any fuch Rules and Regula tions as fhall have been made and tranfmitted; which Rules and Regulations fo made or fo amended, corrected and enlarged, shall be diftributed, published, and made ufe of in fuch Manner as His Majefty's faid Privy Council fhall in that Behalf appoint and direct, and the fame fhall take Effect from fuch Time as in the faid Rules or Regulations fhall be expreffed in regard to the Commencement thereof.

XV. And whereas under the Provisions of an A&t paffed in the Third Year of His late Majefty King George the First, The Num❝ber of Pilots of the Cinque Ports was to be One hundred and twenty at the least, and it has been found by Experience, that the faid Number is inadequate to the increased Trade and Navigation of this Kingdom; be it therefore enacted, That within Four Months after the paffing of this Act, the Number of Cinque Port Pilots fhall be increafed to One hundred and forty at the leaft; to which Number of One hundred and forty, Twenty more fhall be added, whenever fuch further Addition fhall be directed to be made by an Order of His Majesty's Privy Council, upon Application made to His Majefty in Council for that Purpose by the Corporation of Trinity Houle of Deptford Strond; and that a further Addition of Twenty Cinque Port Pilots fhall be made to the Number above-mentioned, increafing the whole Number to One hundred and eighty, by the like Authority, whenever fuch laft-mentioned Addition fhall be applied for by the Corporation of the Trinity House of Deptford Strond to His Majefty in Council.

XVI. And be it further enacted, That whenever the increased Numbers of the faid Pilots fhall refpectively take place as herein-before provided, the Numbers fo increased fhall from thenceforth be kept up from Time to Time by the Appointment of Pilots in Succeffion,

XVII. ' And whereas certain Harbours near the Downs have become much frequented as Places of Safety, and Ships and Veffels lying in or failing through the Downs are oftentimes compelled to run for thofe Harbours, and it is therefore neceffary to make Provifion for the Pilotage of fuch Harbours;' be it therefore enacted, That all Pilots, whofe Licences or Warrants fhall authorize them to pilot Ships or Veffels from any Place to the Weitward up to London Bridge, hall qualify themselves, and fhall be examined as to their Qualification and Ability to conduct any Ship or Veffel into and out of Ramfgate Harbour, and the Harbours of Dover, Sandwich, and Margate, and fhall be obliged to pilot any Ships or Veffels into and out of the faid Harbours; and if any fuch Pilot shall refufe to take charge of or conduct any Ship or Veffel into or out of any of the said Harbours, fuch Pilot fhall forfeit all Pay and Reward to which he might otherwise be entitled for the Pilotage of any fuch Ship or Veffel, and fhall be fubject to fuch Fine or other Punishment as fhall be established in that Behalf by the Rules and Regulations of the Corporation or Society to which fuch Pilot fhall belong.

XVIII. Provided always, and be it further enacted, That every licensed Pilot who fhall take charge of and conduct any Ship or Veffel into or out of Ramfgate Harbour, or into or out of Dover, Sandwich, or Margate, fhall be entitled to and fhall receive for fuch Pilotage at and after the Rate of Five Shillings for every Foot of the Draught of Water of the Ship or Veffel fo piloted and conducted by him into or out of any fuch Harbour, if fach Ship or Veffel fhall have been fo piloted and conducted into or out of the fame in moderate Weather; but if under any Circumftances of Diftrefs, then fuch Pilot fhall be entitled to fuch further Sum of Money, to be calculated according to the Extent and Circumftances of fuch Diftrefs, as the Commiffioners of Salvage established under the Lord Warden of the Cinque Ports shall upon Application either of the Pilot, or Owner, or Mafter of any fuch Ship or Veffel, upon enquiring into all fuch Circumftances direct; and fuch Commiffioners fhall and they are hereby required upon any fuch Application made, to enquire into all fuch Circumftances, and to determine the Amount of the Sum fo to be paid for the Pilotage of any fuch Ship or Veffel into the faid Harbours refpectively, without any Fee or Reward for fo doing.

XIX. Provided always, That on the Arrival of any Ship or Veffel, and as foon as the fhall be moored in any of the faid Harbours, it fhall be lawful for the Pilot to demand the Pilotage due to him as aforefaid, and to quit the Ship forthwith.

XX. And be it further enacted, That it fhall be lawful for the faid Corporation of Trinity Houfe of Deptford Strond, and they are hereby required to appoint from Time to Time (as often and for
