An Act to enable the Commiflioners for auditing Publick Accounts, and the Commiffioners for the Affairs of Barracks refpectively, to fend and receive Letters and Packets on the Bufinefs of their Offices free of Poftage. [23d June 1808.]

WHEREAS the Commiffioners for auditing the publick Ac

• virtue of their Offices, néceffarily fend and receive many Letters and Packets relating to the publick Service of this Kingdom; and it is therefore expedient to permit fuch Letters and Packets to be fent and received free from the Duty of Poftage;' Be it therefore enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in

this prefent Parliament affembled, and by the Authority of the fame, That all Letters and Packets addreffed to the Commiffioners for auJacketsaddreffe diting the publick Accounts, and all Letters and Packets addressed to the Commiffioners for the Affairs of Barracks refpectively for the Time being, upon any Bufinefs or Affairs relating to the Duties of the Offices of the faid Commiffioners refpectively, fhall be free from the Duty of Poftage; and alfo that all Letters and Packets fent by the Secretary of the Commiflioners for auditing publick Accounts, or by the Secretary of the Commiffioners for the Affairs of Barracks refpectively, or in the Abfence of fuch Secretaries respectively, then by the Chief Clerk of fuch Secretary for the Time being, upon any Bufinefs or Affairs relating to the Duties of the faid Commiffioners refpectively in Manner and Form herein-after directed, fhall be fent free from the faid Duty of Poftage; and all Letters and Packets relating to the Duties of the faid Commiffioners respectively, which fhall be forwarded by the faid refpective Secretaries or their Chief Clerks refpectively as aforefaid, fhall be under Covers, with the Words "Pursuant to Act of Parliament,” and “ Auditor's Office,” if fent from the Office of the Commiffioners for auditing the publick Accounts, and "Barrack Office," if fent from the Office of the Commiffioners for the Affairs of Barracks, printed upon the fame; and the Secretary or fome Chief Clerk in the Office from which fuch Letters and Packets fhall be fent, to be nominated from Time to Time for that Purpose by fuch Commiffioners, or the major Part of them refpectively, in and for each of fuch Offices, and whofe Appointment for that Purpofe fhall be tranfinitted to the Poft Office, fhall write his Name under the fame, and they and each of them are and is hereby ftrictly prohibited from inclofing or fending under fuch Covers any Writing, Paper, or Parcel whatfoever, excepting fuch as relate to the Duties of the faid Commiffioners refpectively.

II. And be it further enacted, That if any fuch Secretary or Clerk as aforefaid refpectively fhall prefume to fend or convey under any of the Covers aforefaid, any Writing, Paper, or Parcel other than those relating to the Duties of fuch Commiffioners refpectively, he shall for every fuch Offence forfeit and pay the Sum of One hundred Pounds, to be recovered with full Cofts of Suit by any Perfon or Perfons by Action of Debt, Bill, Plaint, or Information in any of His Majelty's Courts of Record at Westminster, wherein no Effoign, Privilege, Protection, Wager of Law, or more than One Imparlance fhall be allowed; One Moiety of which Penalty fhall go to the Perfon who fhall fue for the fame, and the other Moiety thereof to and for the Ufe of His Majefty.

CA P. XCI.

An Act for enabling the Commiflioners appointed to examine Accounts of Publick Expenditures in the West Indies, more fpeedily and effectually to inveftigate the faid Accounts.

[23d June 1808.] "Commiffioners appointed under 46 G. 3. c. 80. fhall tranfmit a State"ment of the Accounts examined to the Treafury, who shall tranf"mit them, if approved, to the Auditors of publick Accounts, who "fhall prepare the fame for Declaration. I.-[See 48 G. 3. c. 89. "§ 1.] When it appears that any Perfons ought to account for pub

"lick Money, Stores, or Provifions connected with the publick Ex"penditure in the Weft Indies or South America, Commiflioners shall "tranfmit the Names of fuch Perfons with their Reasons to the "Treafury who fhall require Accounts to be delivered in, &c. § 2." "[See 48 G. 3. c. 89. § 2.]

III. And be it further enacted, That all Accounts of Expenditure of publick Money in the West Indies or South America, as specified in the faid recited Act, which fhall have arifen in part before and in part after the First Day of January One thou fand feven hundred and ninety-three, fhall be examined and proceeded upon by the Commiffioners appointed under the faid recited A&t, who fhall have and they are hereby invested with the fame Powers and Authorities in all Refpects in relation to the Examination of fuch Accounts, and the Accountants and all other Perfons touching the fame, as they would have had and been invefted with under the faid recited Act and this Act, in cafe the faid Accounts had arifen wholly after the First Day of January One thoufand feven hundred and ninety-three. "Commiffioners under recited Act invested with fame Powers as "the Commiffioners for auditing publick Accounts under the Acts "25 G. 3. c. 52.—39 G. 3. c. 83.-45 G. 3. c. 55.—46 G. 3. c. 141. V. And be it further enacted, That all Powers, Authorities, Jurifdictions, Matters and Things, by the faid recited Act or this Act vefted in or required to be done by the Commiffioners appointed under the faid first recited Act of the Forty-fixth Year aforefaid or this Act, are hereby vefted in and fhall and may be executed and done by any Two or more of fuch Commiffioners, or by any One of fuch Commiffioners, in cafe the Number of fuch Commiffioners remaining in England fhall be reduced to One, by the Abfence therefrom of any of the felected Commiffioners; and all Powers, Authorities, Jurifdiétions, Matters and Things, by the faid first recited Act of the Forty-fixth Year aforefaid, or this Act, vefted in or required to be done by any felected Commiffioners, are hereby vested in and fhall and may be executed and done by any One of such selected Commiffioners fingly, in the Abfence of the other of fuch Commisfioners, or by any Perfon appointed to act in the Place and Stead of any felected Commiffioner deceafed or resigning.

An Act to repeal fo much of an Act, made in the Forty-seventh
Year of His prefent Majefty, for charging the Sum of Twelve
Millions two hundred thousand Pounds, raised for the Ser-
vice of Great Britain for the Year One thoufand eight hun-

granted to His Majefty, during the Continuance of the pre-

King James the First, as relates to the Penalties on Shooting
at Hares; and alfo to repeal an Act of the Third Year of
King George the First, relating to Gamekeepers.

[23d June 1808.] WHEREAS an A&t was paffed in the Second Year (com. monly called the First Year) of the Reign of King James the Firft, intituled, An Act for the better Execution of the Intent and Meaning of former Statutes made against shooting in Guns, and for the Prefervation of the Game of Pheafants and Partridges, and againf the deftroying of Hares with Hare Pipes, and tracing Hares in the Snow; whereby it was amongst other Things enacted, That every Perfon which fhould fhoot at, kill, or deftroy, with any Gun, Crofs Bow, Stone Bow, or Long Bow, any Hare, fhould be fubject to the Penalties therein mentioned: And whereas it is expedient that the faid Provifion fhould be repealed: And whereas it is alfo expedient that a certain other Act, paffed in the Third Year of His late Majesty King George the First, intituled, An Act to explain and amend several Laws therein mentioned for the better Prefervation of the Game, fhould be repealed; and that other Provifions fhould be made relating to the Appointment of Gamekeepers;' Be it therefore enacted by the King's moft Excellent Majefty, by and fo far as relates to with the Advice and Confent of the Lords Spiritual and Temporal, Hares; and and Commons, in this present Parliament affembled, and by the Authority of the fame, That the faid Provifion of the faid recited A& of the Second of James the Firft, and the faid recited A&t of the Third of George the Firft, fhall be and the fame are hereby repealed. II. And be it further enacted, That it shall be lawful for Lord or Lady of any Manor to appoint and depute any Perfon whatever, whether acting as a Gamekeeper to any other Perfon or not, or whether retained and paid for as the Male Servant of any other Person or not, or whether a qualified Perfon or not, to be a Gamekeeper to any fuch Manor, with Authority to fuch Perfon as Gamekeeper to kill Game within the fame for his own Ufe, or for the Ufe of any other Perfon or Perfons whatever, to be specified in fuch Appointment or Deputation, whether qualified or not; and no Perfon fo appointed Gamekeeper as aforefaid and empowered to kill Game for his own Ufe, or for the Ufe of any other Perfon fo fpecified as aforefaid, and not killing any Game for the Ufe of the Lord or Lady of the Manor for which fuch Deputation fhall be given, fhall be deemed or taken to be, or entered or paid for as the Gamekeeper or Male Servant of the Lord or Lady making fuch Appointment or giving fuch Deputation as aforefaid; any Thing in any Act or Acts of Parliament to the contrary notwithstanding.

An Act for repealing fo much of an Act made in the Parliament of Scotland, in the Fourth Seffion of the First Parliament of Queen Anne, intituled, Act for preferving the Game, as relates to the Shooting of Hares. [23d June 1808.] WHEREAS by an Act of the Scottish Parliament, paffed in the Fourth Seffion of the First Parliament of Her Majefty Queen Anne, intituled, Ad for preferving the Game, it is among other Things enacted, That no Perfon whatsoever fhall fhoot Hares under the Penalty of Twenty Pounds Scots: And whereas it is expedient that the fame fhould be in fo far repealed: May it therefore please Your Majefty that it may be enacted;' and be it enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That fo much of the said in part recited Act, as relates to the Shooting of Hares, fhall be and the fame is hereby repealed.

WHEREAS the Practice of confining fuch Lunatics and other

infane Perfons as are chargeable to their refpective Parishes in Gaols, Houfes of Correction, Poor Houses, and Houses of Induftry, is highly dangerous and inconvénient: And whereas it is expedient that further Provifion fhould be made for the Care and • Maintenance of fuch Perfons, and for the erecting proper Houses for their Reception, and alfo for erecting additional Buildings adjoining or contiguous thereto for the Reception of other Lunatics: And whereas it is also expedient that further Provifion fhould be made for the Cuftody of infane Perfons who fhall commit criminal Offences;' be it therefore enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That it fhall and may be lawful for the Justices of the Peace in and for every County within England and Wales, at their respective General Quarter Seffions of the Peace, or any Adjournment of the fame, or the major Part of fuch Juftices. then and there affembled, to direct Notice to be given in fome publick Newspaper or Newspapers circulated in or near fuch County, of
