IV. Provided always, and be it enacted, That in cafe the Whole Number of Men allowed to enlist from any Regiment, Battalion, or Corps, in any One Year, under the Provifions of the faid recited Act of the Forty-fixth Year, fhall have actually declared their Intention of enlifting under the faid recited Act, within the first or any fubfequent Period of Three Days to be appointed as aforefaid, it fhall not be lawful for the Commanding Officer to appoint any further or other fuch Period for fuch Enliftment; and that nothing in this Act contained fhall extend to authorize the difcharging from any Regiment, Battalion, or Corps of the faid Militia any greater Number of Men than in the Proportion of Fifteen Men for every Company in any One Year, pursuant to the Provifions of the faid recited A&t.

V. Provided alfo, and be it enacted, That it fhall not be lawful for any Commiffioned Officer or Noncommiffioned Officer of or belonging to any Regiment of the Line, or the Royal Marines, which fhall be authorized or directed to receive Volunteers from any Regiment, Corps, or Battalion of the faid Militia, to be within Ten Miles of the Quarters of fuch Regiment, Corps, or Battalion of Militia at any Time during the refpective Periods to be appointed for the Volunteering from fuch Regiment, Corps, or Battalion of Militia, in Manner aforcfaid.

VI. Provided alfo, and be it enacted, That in cafe the whole Number of Men allowed to be difcharged in any One Year under the Provifions of the faid recited A&t of the Forty-fixth Year, and this Act, from any Regiment, Battalion, or Corps of Militia, fhall not have voluntarily declared their Intention of enlifting into His Majefty's Regular Forces or Royal Marines for General Service within the faid Six feveral and refpective Periods of Three Days to be appointed for fuch enlifting, in Manner herein-before mentioned, after the Twenty-fourth Day of July in any Year, and before the Twentyfourth Day of February in the Year following, it shall and may be lawful for the Lord Lieutenant or other Chief Governor or Governors of Ireland for the Time being, by any Order to be fignified by his or their Chief Secretary to the Commanding Officer of fuch Regiment, Battalion, or Corps, to appoint a further and final Period of Ten Days for fuch Enliftment, between fuch Twenty-fourth Day of February and the Twenty-fourth Day of March then next enfuing; and during the faid Period of Ten Days fo to be appointed, it fhall be lawful for any Private Militia Man in fuch Regiment, Battalion, or Corps, voluntarily to enlift for General Service under the Regulations of the faid recited A&t of the Forty-fixth Year, and this Act; and during fuch Period of Ten Days it fhall be lawful for any Officer or Officers of fuch Regiment as fhall be appointed purfuant to the faid Act of the Forty-fixth Year aforefaid, to receive Volunteers from the faid Regiment, Battalion, or Corps of Militia, to attend at the Place of Volunteering, and to receive and enlift fuch Men as shall volunteer accordingly; any Thing in this Act contained to the contrary notwithstanding.

VII. And be it further enacted, That all the Powers, Provifions, Aft extended to Claufes, Regulations, Reftrictions, and Directions, mentioned and

An Act to make more effectual Provifion for the building
and rebuilding of Churches, Chapels, and Glebe Houses,
and for the Purchase of Glebe Lands, Glebe Houfes, and
Impropriations, in Ireland.

W for the building and rebuilding of Churches in Ireland; and

HEREAS it is expedient to make more effectual Provifions

for providing the Means of Refidence for the Clergy on their ref'pective Benefices;' be it therefore enacted by the King's most Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this present Parliament affembled, and by the Authority of the fame, That all and every Sum and Sums of Money and Securities for Money which at the Time of paffing of this Act are or fhall be, or which at any Time after the paffing of this Act fhall come into or be in the Hands, Power, Cuftody, Poffeffion, or Difpofal of the Trustees and Commiffioners of First Fruits in Ireland for the Time being, under or by virtue of any Grant of the Crown, Letters Patent, Grant or Act of Parliament, or otherwise howfoever, and all Intereft, Dividends, Profits, and Proceeds thereof (fave and except only the Funds and Property bequeathed by the Will of Doctor Hugh Boulter, formerly Lord Archbishop of Armagh, to be difpofed of in buying Glebes or augmenting Livings, and which, in and by an Act made in the Parliament of Ireland in the Twenty-ninth Year of the Reign of his late Majefty King George the Second, intituled, An Ad for amending and making more effectual the Laws relating to First Fruits, and for the better Regulation and Management of the charitable Bequest of Doctor Hugh Boulter, late Archbishop of Armagh, for augmenting the Maintenance of Poor Clergy, were vefted in the Trustees and Commiffioners of First Fruits for the Purposes in the faid Act mentioned; and alfo fave and except the Funds and Property bequeathed to the faid Truftees and Commiffioners by Doctor Robinfon, formerly Lord Archbishop of Armagh, and the Interest, Dividends, and Proceeds of the faid Bequefts refpectively; and alfo fave and except fuch other Funds and Property as may hereafter be bequeathed to or vefted in the faid Trustees and Commiffioners for any fpecial Purposes) fhall be and the fame are hereby declared to be applicable, and fhall and may from Time to Time be applied by the faid Trustees and Commiffioners in and towards the building and rebuilding of Churches and Chapels in Ireland, as well as in and towards the purchafing of Glebes and Impropriations, and building or purchafing Glebe Houses, and other Purposes to which the fame may by Law be applicable at the Time of the paffing of this Act, and the Application by the faid Truftees and Commiffioners of the faid Monies, Securities and Funds, and of the Intereft, Profits and Proceeds thereof, or any Part thereof, in and towards the building and rebuilding of Churches and Chapels in Manner directed by this Act, 48 Geo. or any other A&t or Acts in force in Ireland, shall be as good, valid and effectual, to all Intents and Purposes whatfoever, as if the Application of the fame had been originally fo directed at the Time when the faid Monies, Securities and Funds were placed in the Trust or under the Controul or Management of the said Trustees and Com. miffioners; any Thing in any Act or Acts in force in Ireland, or any Law, Ufage, Custom, Grant, Matter or Thing to the contrary notwithstanding.

II. And be it further enacted, That fo much and fuch Parts of any Act or Acts in force at the Time of the paffing of this Act, as limits and reftrains the Application of any Grant or Appropriation by Parliament of any Sum or Sums of Money granted to the faid Trustees and Commiffioners of First Fruits for the building new Churches and rebuilding old Churches in fuch Parishes wherein no publick Service has been performed for Twenty Years last past, fhall be and the fame is and are hereby repealed, fo far as relates to Churches or Chapels, for the building or rebuilding whereof any Advance by Loan fhall be made under the Provifions of this A&t; and from and after the paffing of this Act it fhall and may be lawful for the faid Truftees and Commiflioners to appropriate all Sum and Sums of Money in their Hands to the building and rebuilding fhall be advanced fuch Churches and Chapels as well in Parishes where publick Service fhall have been performed in the Courfe of Twenty Years preceding the Time of the feveral Grants and Appropriations aforefaid as in any other Parish whatsoever; any Thing in the faid Acts or any of them to the contrary notwithflanding.

III. And be it further enacted, that whenever, under any Act or Acts in force in Ireland, fuch Measures fhall have been had and taken concerning the erecting of any new Church or Chapel, or the rebuilding of any Church or Chapel in any Parish or Place in Ireland, fo that fuch Erection or Rebuilding may by Law be proceeded upon, and an Application in Writing fhall be made to the faid Truftees and Commiffioners of the First Fruits in Ireland, by the Ordinary of the Diocefe, or by the Minifter and Churchwardens of the Parish or Place in which it thall be propofed and intended that any fuch Church or Chapel fhall be erected or rebuilt, or by any Two Proteftant Inhabitants of fuch Parish or Place, accompanied by a Plan and Eftimate of the Expence of fuch propofed Erection or Rebuilding approved by the Ordinary of the Diocefe, it shall and may be lawful for the faid Truttees and Commiffioners from Time to Time, and by fuch Inftalments and Proportions as the said Trustees and Commiffioners fhall think proper, to advance to the Perfons fo applying, out of the Monies and Funds intrufted to the Care of the faid Trustees and Commiffioners, the Whole or any Part of fuch Sum or Sums of Money as according to fuch Plan and Eftimate the faid Trustees and Commiffioners fhall think fit and proper to be applied in the Erection or Rebuilding of any fuch Church or Chapel refpectively, in Manner herein-after mentioned.

IV. And be it further enacted, That it fhall and may be lawful for the faid Trustees and Commiffioners (if they fhall think fit) to due Application require from the Party or Parties fo applying good and fufficient Security by the Bond of the faid Parties, or by the Bond or Bonds of One or more Surety or Sureties, or other Perfon or Perfons, in fufficient Penalties for the due Application of the Money fo to be

advanced, or for refunding to the faid Truftees and Commiffioners foment of the much thereof as fhall not be actually expended in fuch Erection or Rebuilding within Two Years after fuch Money fhall have been advanced; or if the faid Truftees and Commiflioners fhall not think it fit or neceffary to require fuch Security, it fhall be lawful for the faid Trustees and Commiffioners to advance fuch Sum or Sums of Money without fuch Security; and if the faid Trustees and Commiffioners fhall be of Opinion that it is fitting and expedient that any Sum or Sums of Money fo to be advanced, or any Part thereof, fhould be advanced by way of Loan to, and fhould be repaid by the Parish or Place in which fuch Church or Chapel fo erected or rebuilt fhall be erected or fituate, then and in fuch Cafe it fhall and may be lawful for the faid Trustees and Commiffioners to require and take fuch Security by Bond for the repaying of such Sum or Sums of Money fo advanced, or fuch Part or Proportion thereof as shall be expreffed in fuch Bond or Security, in Manner and at the Times following; (that is to fay) Six Pounds per Centum of the Sum fo advanced (or fuch Part thereof as shall be to be repaid as aforefaid) on the First Day of July next after the Expiration of One Year from the Day on which fuch Sum or Sums fhall be fo advanced, or within Twenty-one Days next after; Six Pounds per Centum more of fuch Sum on the First Day of July in every fucceeding Year (or within Twenty-one Days after), until Ninety-fix Pounds per Centum of the Sum fo advanced (or fuch Part thereof as fhall be to be repaid as aforefaid) fhall be repaid; and the remaining Four Pounds per Centum of fuch Sum on the First Day of July (or within Twenty-one Days after) in the Year fucceeding that in which the last Instalment of Six Pounds per Centum fhall have been paid as before mentioned: Provided always, that no Intereft fhall be paid for or upon any Sum fo advanced by the faid Trufees and Commiffioners under this Act, or for or upon any Part thereof, unless the Payment of the said Inftalments fhall be deferred beyond the Days and Times on which they fhall have feverally become due: Provided alfo, that no Sum of Money fhall be advanced otherwife than by way of Loan according to the Provifions of this Act, towards the building or rebuilding of a Church in any Parish wherein Divine Service fhall have been performed within Twenty Years then laft paft; fave and except towards building Chapels of Eafe in fuch Parishes where they may be built under an Act paffed in the Parliament of Ireland in the Sixth Year of His late Majefty King George the First, intituled, An A for the better Maintenance of Curates within the Church of Ireland; and by an Act made in the Parliament of Ireland in the First Year of his late Majefty King George the Second, for explaining and amending the fame; for the Erection of which Chapels the faid Truftees are hereby empowered to advance Money as they may for erecting any other Churches by this Act.

V. And be it further enacted, That whenever Security fhall be taken by the faid Trustees and Commiffioners for the Repayment of any Sum or Sums of Money fo advanced, or any Part thereof, by fuch Inftalments of Six Pounds per Centum and Four Pounds per Centum as aforefaid, the Parish or Place in which the Church or Chapel fo erected or rebuilt fhall be fituate, and which fhall by Law be bound to the Repair of fuch Church or Chapel, fhall be required and bound to repay the faid feveral Sums of Money, for the Repayment of

which fuch Security fhall have been given as aforefaid by the faid feveral annual Inftalments of Six Pounds and Four Pounds per Centum in Manner aforefaid; and that the Amount of the faid annual Instalments or Sum or Sums of Money fhall be from Time to Time affeffed, applotted, levied and raised in fuch Parish or Place in fuch Manner, and with all fuch Powers and Remedies for the affeffing, applotting, raifing and levying of the fame in all Refpects, as is or are provided for the affeffing, applotting, raising and levying of any Sum or Sums of Money, Rate, Parish Cefs or Tax, for repairing, building, or rebuilding of any Church or Chapel, or other neceffary Charges belonging to fuch Church or Chapel, under or by virtue of any Act or Acts in force in Ireland at the Time of the paffing of this Act; and that all Churchwardens and Veftries fhall have the like Power to affefs all Parishes and Places, and to applot and levy fuch Affeffments and be accountable for the fame, and to do all Matters and Things for the affeffing, applotting, raifing and levying of fuch annual Inftalments or Sums of Money fo to be payable as aforefaid in all refpects whatsoever, as they now have refpectively, touching or concerning any Rate or Rates, Sum or Sums of Money, Parish Čefs or Tax, for the repairing, building, or rebuilding of any Church or Chapel, or any other neceffary Charge belonging to fuch Church or Chapel, under or by virtue of any fuch Act or Acts as aforefaid.

VI. And whereas by an Act paffed in the Forty-third Year of His prefent Majefty's Reign, intituled, An Act for granting to His Majefly the Sum of Fifty thousand Pounds for building Glebe Houses in Ireland', it is enacted, that by or out of fuch Monies as fhall at any Time or Times be or remain in the Receipt of the Exchequer of Ireland of the Confolidated Fund, there fhall and may be iffued by the Order of the Lord Lieutenant or other Chief Governor or Governors of Ireland as he or they fhall think fit, from Time to Time, free of Intereft, any Sum or Sums of Money not exceeding Fifty thousand Pounds Irish Currency, to the faid Trustees and Commiffioners of the faid First Fruits, to be by them applied as in the faid Act is mentioned: And whereas by an Act made in the Forty-feventh Year of His prefent Majefty's Reign, the faid recited Act of the Forty-third Year was altered and amended: And whereas no Part of the faid Sum of Fifty thoufand Pounds has yet been iffued, and it is expedient to amend the faid Acts;' be it therefore enacted, That fo much and fuch Parts of the faid Acts, or either of them, as direct the Manner of iffuing the faid Sum of Fifty thoufand Pounds, and the Conditions of advancing the fame, fhall be and the fame is and are hereby repealed.

VII. And be it further enacted, That whenever and fo often as the faid Trustees and Commiffioners of the First Fruits in Ireland fhall certify by Writing under the Hand and Seal of the Treasurer of the faid Trustees and Commiffioners, to the Lord High Treafurer, or the Commiffioners for executing the Office of Lord High Treafurer of Ireland, that they the faid Trustees and Commiffioners have thought it fitting and expedient that a Sum of Money should be advanced, fpecifying the Amount thereof, for the erecting or rebuilding of any Church or Chapel, fpecifying the Parish or Place in which fuch Church or Chapel is to be erected or is fituate,or for the Building, Erection, or the Purchafe of a Glebe House and Offices,
