who fhall fit to hear, try, or determine any Complaint or Information for any Offence against any Act or Acts in force in Ireland relating to the Revenues, Matters, and Things under the Manage ment of the Commiffioners of Customs and Port Duties, or of the Commiffioners of Inland Excife and Taxes, fhall begin the Trial thereof on the Day of which Notice fhall be firft given for proceeding thereon, which Day fhall be within Thirty Days after the Complaint or Information fhall have been made, and such Court fhall forthwith proceed upon fuch Trial, and fhall not adjourn until a Witness fhall have been examined, without the Confent of both Parties, or upon good and fufficient Caufe, to be affigned upon Oath by One of the Parties, or his or their Agent or Solicitor, or unless upon fome good and fufficient Caufe to be affigned upon Oath by One or more of the Commiffioners or Sub-Commiffioners fitting upon fuch Trial, if any Adjournment fhall be defired and applied for by him or them; and every fuch Adjournment and Confent and Caufe upon Oath fhall be entered in the Proceedings of the Court, and be made Part of the Tranfmifs,

III. And be it further enacted, That it fhall not be lawful for the Commiffioners or Sub-Commiffioners to adjourn any Trial as aforefaid, except from Day to Day, Sundays, Good Friday, Chriftmas Day, and the King's Birth-Day only excepted, unlefs by fuch Confent, or fuch Caufe upon Oath fo entered, any Law, Cuftom, or Ufage to the contrary notwithstanding.

IV. And be it further enacted, That in cafe the Trial of Complaint or Information fhall not be proceeded upon within the Time herein-before provided, or be adjourned without fuch Confent or good and fufficient Caufe upon Oath, the Complaint or Information fhall be difcharged, and no new Complaint or Information shall be received or entertained for the fame Offence. And be it further enacted, That every and any Perfon who by Perfons being Law is, or by any Act or Acts in force in Ireland is declared or competent Witneffes before enabled to be, a competent Witness before the Commiffioners of Commiffioners of Customs and Port Duties, or the Commiflioners of Inland Excife Customs and and Taxes in Ireland refpectively, or before their Sub-Commiffion- Excife thall be ers refpectively, or before any Court or Judge of Affize, or other likewife comPerfon or Perfons, upon any Enquiry, Proceedings, or Trial touching or concerning any Matters or Things relating to the Revenues under the Management of the faid Commiflioners refpectively, or touching or concerning any Offence committed under any Act or Acts for collecting or fecuring the faid Revenues or any of them, or touching or concerning the Matters contained in any Information for any fuch Offence, shall be, and any and every fuch Perfon is hereby declared to be a competent Witnefs before any Juftice of Peace or Magistrate in Ireland, upon any Information, Inquiry, Proceedings, or Trial touching and concerning all or any fuch Matters and Things refpectively within the Jurifdiction of fuch Justice of Peace or Magiftrate; and the Evidence of fuch Perfon fhall be received accordingly by fuch Juftice of Peace or Magiftrate, on fuch Information, Inquiry, Proceedings, and Trial refpectively.

VI. And whereas it is by the faid recited Act of the Forty- 46 G. 3. c. 87. fixth Year, for regulating the Collection of the Duties on Goods, § 95. • Wares, and Merchandize imported into, or exported from Ireland, enacted, that it shall not be lawful to import any Tobacco at any

Port or Place in Ireland, fave and except the Ports in the faid recited A&t mentioned,' be it enacted, That from and after the paffing of this Act it fhall and may be lawful to import Tobacco into Ireland at the Port of Sligo; and that the Importer thereof at the faid Port fhall be entitled to have the fame lodged in a Warehoufe, and to take any Benefit in refpect of warehoufing and bonding the fame, under and by virtue of any Act or Acts in force in Ireland, in like Manner as may be done with refpect to Tobacco imported at any of the Ports mentioned in the faid recited Act of the Forty-fixth Year, and as if the faid Port of Sligo had been mentioned and specified in the faid recited Act.

VII. And be it further enacted, That from and after the paffing of this Act it fhall and may be lawful for the Lord Lieutenant, or other Chief Governor or Governors of Ireland for the Time being, by and with the Advice and Confent of His Majefty's Privy Council of Ireland, to permit the Importation into Ireland of Tobacco, Spirits, Teas, Wines, or Coffee, at fuch Ports or Places as the faid Lord Lieutenant, or other Chief Governor or Governors, and Privy Council of Ireland, fhall think fit, under and fubject to fuch Regulations and Restrictions in other Refpects as Tobacco, Spirits, Teas, Wines, or Coffee may by Law be imported into Ireland; provided it shall be made to appear, that fuch Port is, with respect to the Trade and Commerce carried on therein, and from the Nature of its Situation, a Port at which it would be just and reasonable to permit such Importation.

VIII. And, for the more effectually carrying into Execution the feveral Acts for regulating Licenfes for the Sale of Spirituous Liquors by Retail, and for difcouraging the immoderate Ufe of Spirituous Liquors in Ireland,' be it enacted, That in cafe any certify to Juftice Perfon who, under and by virtue of an Act made in the Fortyfeventh Year of His prefent Majefty's Reign, intituled, An Act to make further Regulations with refped to Licences for the Sale of Spirituous and ather Liquors by Retail in Ireland, fhall have been or fhall be appointed an Overfeer of Perfons licenfed for the Sale of Spirituous and other Liquors, within any Parish in Ireland, fhall certify under His Hand and Seal, to any Juftice of the Peace for the County, County of a Town, or City, in which which fuch Parish fhall be fituate, that Perfons were entertained in the House of any Perfon fo licensed between the Hours of Twelve at Night and Seven in the Morning, on any Day of the Week except Sunday, or at any Time whatever on a Sunday, fuch Juftice fhall thereupon fummon the Party accufed, and unlefs the Party fummoned fhall make it appear to the Satisfaction of fuch Juftice of the Peace, that the Perfons found in fuch House were Inmates of the House where they were fo found, fuch, Certificate fhall be conclufive Evidence to fubject the Perfons licenfed for the Sale of Spirituous Liquors to a Penalty of Forty Shillings, British Currency, for the First Offence, and for the Second Offence to the Sum of Five Pounds, Briti Currency; and in Default of Payment of fuch Penalty, fuch Juftice of the Peace may iffue his Warrant for the Diftrefs and Sale of the Goods of the Perfou on whom fuch Penalty fhall be impofed. Recited Acts may be altered or repealed this Seffion. § 9."

IV. And be it further enacted, That no Duty fhall be charged on the Sale by Auction of any Goods, Wares, Merchandize, or Effects whatever imported into Ireland by Way of Merchandize, and fo fold at the Port of Inportation by or for the Account of the original Importer or Confignee thereof, to whom the fame were configned, and by whom they were entered at the Custom Houfe, fo as fuch Sale be the firft Sale thereof after the Importation of the fame; nor upon the Sale by Auction of any Cattle, Live Stock or Dead Stock, or unmanufactured Produce of Land, fo as fuch Sale be made for the Account of the Owner of fuch Land, or for the Account of the Perfon oecupying fuch Laud, and whilft fuch Cattle, Live or Dead Stock, or unmanufactured Produce continues on the Land producing the fame; nor upon the Sale by Auction of any Goods, Wares, Goods fold by Merchandize, or Effects fold by Order of the Commiffioners of Cuf toms and Port Duties, or by Order of the Commiffioners of Inland Excife and Taxes, or by Order of the Commiffioners of Stamp Duties, or by Order of the Board of Ordnance in Ireland refpectively; any Thing in the faid recited Acts of the Forty-feventh Year aforefaid, or either of them, to the contrary in anywife notwithstanding.

V. And be it further enacted, That in all Cafes where the real Owner of any Eftate, Goods, or Effects, put up to Sale by way of Auction in Ireland, fhall become the Purchafer by Means of his own Bidding or the Bidding of any Perfon on his Behalf or for his Ufe at fuch Sale without Fraud or Collufion, then and in fuch Cafe it shall and may be lawful for the Examinator of Auction Duty in Dublin, or the Collector of Excife, in the District in which fuch Sale shall be held, and they are refpectively authorized and empowered to make an Allowance to the Owner of fuch Eitates, Goods, or Effects, of the Duties arifing under any Act or Acts in force in Ireland, upon fuch Bidding or Sale; provided that Notice in Writing figned by the Owner and the Perfon intended to be the Bidder, that fuch Bidder is appointed by or on the Behalf of fuch Owner, to bid at the Sale for the Ufe and Behoof of fuch Owner, fhall have been given to the Auctioneer before fuch Bidding, and that the Delivery of fuch Notice fhall be verified by the Oath of fuch Auctioneer, as alfo the Fairnefs and Reality of the Tranfaction to the best of his Knowledge and Belief.

VI. And be it further enacted, That nothing in the faid Act contained fhall extend to prevent any Sheriff or Sheriffs from employing fuch Perfon or Perfons as he or they fhall think proper, to fell by Auction any Elate, Goods, or Effects feized for the Benefit of any

Order of Board of Customs, Excife, or Ordnance.

Creditor in Execution of any Judgment, although fuch Perfon fhall not be a licensed Auctioneer; and that upon any Sale made by such Sheriff or Sheriffs, or the Perfon employed by him or them, it fhall not be neceffary to give any previous Notice of fuch Sale at the Office of Examinator of Auction Duty in Dublin, or at the Office of the Collector of Excife: Provided always, that the Sheriff or Sheriffs under whofe Authority fuch Sale fhall be made fhall be liable to and charged and chargeable with the full Auction Duty on all Goods and Effects fold at fuch Sale; and a Return or Account of fuch Sale, and Payment of the Duty thereon, fhall be made by or on the Part of the faid Sheriff or Sheriffs, or by the Perfon employed by him or them, in like Manner as is directed by the faid recited Act for fecuring the Collection of the Duties on Auctions in Ireland, with refpect to Sales by Auctioneers under that Act.

VII. And be it further enacted, That nothing in the faid recited Act for fecuring the Collection of the Duty on Auctions contained fhall extend or be conftrued to extend to prevent any Person whatever from acting as an Auctioneer in the Sale of any Goods, Wares, Merchandize, or Effects in refpect of the Sale whereof, or of the Purchafe Money arifing wherefrom, no Auction Duty is made payable under and by virtue of any Act or Acts in force in Ireland, or which by this Act or any A&t or Acts in force in Ireland are exempted from the Payment of the Duty on Auctions; and that no Perfon fo acting as Auctioneer in fuch Sale, nor any Perfon or Perfons employed by any Sheriff or Sheriffs acting in any Sale by virtue of this Act as aforefaid, fhall be required to take out any Licence for fo doing, nor fhall any fuch Perfon be fubject or liable to any Penalty or Forfeiture under the faid recited Act for fecuring the Collection of the Duty on Auctions in refpect of fuch Sale, of any fuch Goods, Wares, Merchandize, or Effects, nor on Account of fuch Perfons not having taken out a Licence pursuant to the Directions of the faid Act; any Thing in the faid recited A&t or any other Act to the contrary notwithstanding.

Services of Volunteers from the Militia of Ireland.

[18th June 1808.] W (THEREAS by an Act made in the Forty-fixth Year of His prefent Majefty's Reign, intituled, An Ad to enable His Majefty to accept the Services of Volunteers from the Militia of Ireland, under certain Refrictions; it was enacted, That within Twelve Calendar Months after the Twenty-fourth Day of July in every Year, while the faid Militia fhould be augmented under the Provifions of an Act made in the Forty-fourth Year of His prefent Majefty's Reign, intituled, An Ad for empowering His Majefly to dire the Augmentation of His Militia Forces in Ireland, to an Ex • tent therein limited, it fhould be lawful for His Majefty from Time to Time to direct Regiments of the Line, or of the Royal Marines, to receive Volunteers from the Militia Forces of Ireland, and that it fhould be lawful for the Private Men in the faid Militia

Act, fubject to the Regulations and Restrictions in the faid Act mentioned: And whereas it is expedient that Provision should be 'made for more effectually carrying the faid Act into Execution 'from Time to Time;' be it therefore enacted by the King's most Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the faine, That fo much and fuch Part of the faid recited Act as confines the Time of fuch enlifting in each Year to the Period of Ten Days next enfuing the Time when the Terms of fuch enlifting fhall be explained and made known to his Men by the Commanding Officer of any Regiment, Battalion, or Corps of Militia, purfuant to Directions received by him for fuch enlifting, or to the further Period of Ten Days next fucceeding fuch first mentioned Ten Days, fhall be and the fame is and are hereby repealed.

II. And be it further enacted, That whenever, at any Time after the Twenty-fourth Day of July in any Year, the Commanding Officer of any Regiment, Battalion, or Corps of the Militia of Ireland fhall have received His Majefty's Directions with refpect to fuch Volunteering as aforefaid, fignified in Manner in the faid recited A&t of the Forty-fixth Year mentioned, and fhall have explained to the Private Men of fuch Regiment, Battalion, or Corps, the Form of Enlifting in fuch Manner as in and by the faid recited Act is ordered and directed, it fhall be lawful for the faid Commanding Officer, and he is hereby authorized, empowered, and required to appoint a Period of Three fucceffive Days, during which fuch Enliftment fhall take place; and in cafe the whole Number of Men allowed to enlift from fuch Regiment, Battalion, or Corps, in any One Year, in-purfuance of the Provifions of the faid recited Act of the Forty-fixth Year, fhall not voluntarily declare their Intention of enlifting within fuch Space of Three Days, then to appoint a further Period of Three Days for fuch enlifting; and fo in like Manner to appoint Six fuch Periods of Three Days each if neceffary, during which fuch Enliftment fhall take place under the faid recited Acts: Provided always, that Ten Days Notice fhall from Time to Time be given by the Commanding Officer to the Regiment, Battalion, or Corps, of the feveral Days or Periods fo to be appointed for enlifting, previous to each fuch Period; and that there fhall be an Interval of Fourteen Days at leaft between each fuch Period of Three Days; and that all the faid feveral Periods of Three Days fhall be between the Twenty-fourth Day of Auguft in each Year, and the Twenty-fourth Day of February in the Year following.
