or Non-commiffioned Officer or private Man belonging to any Regi- Soldiers. ment in the Army, Artillery, Militia, Divifion of Marines, or Corps of Engineers; or any Perfon inrolled and actually ferving in any Volunteer Corps or Body of Men affociated for the Defence of any Volunteers. City, Town, or Place, and for maintaining publick Tranquillity and good Order within the fame, whether of Infantry or Cavalry, which now are or hereafter fhall be raised; provided that every fuch Perfon inrolled and ferving as aforefaid, fo claiming to be exempted, fhall make fuch Return as by this Act is directed*, with refpect to the Claim of Exemptions; provided, that every fuch Claim fhall be proved by the Certificate of the Commanding Officer of the Corps, in the Form in the Schedule to this Act annexed, marked (N.), and according to the Regulations of this Act in other Cafes of Exemption by fuch Volunteers.

III. Ány Clergyman who fhall not be poffeffed of an Annual In- Clergymen, &c. come of 100%. or upwards, whether arifing from Ecclefiaftical Preferment or otherwife; or any Preacher or Preachers of any Congregation of Diffenters, or any Perfon diffenting from the Church of England, in Holy Orders, or pretended Holy Orders, who now is or at any Time hereafter fhall be entitled to the Benefit of the Statute made in the First Year of the Reign of the late King William and Queen Mary, intituled, An Act for exempting Their Majefties' 1 W. & M. Proteftant Subjects diffenting from the Church of England from the ft. 1. c. 18. 'Penalties of certain Laws;' or of the Statute made in the Nineteenth Year of the Reign of His prefent Majefty, intituled, An Act for 'the further Relief of Proteftant Diffenting Minifters and School'masters ;' or of the Statute made in the Thirty-firft Year of the Reign of His prefent Majefty, intituled, An Act to relieve, upon 'Conditions and under Reftrictions, the Perfons therein defcribed, 'from certain Penalties and Disabilities to which Papifts, or Perfons profeffing the Popish Religion, are by Law fubject,' and who fhall not be poffeffed of an Annual Income of 100/. or upwards, how. ever arifing; and the Income arifing from any Benefice or Benefices fhall be estimated on the Average Amount thereof, computed on the Period of Seven Years next preceding that on which fich Exemption fhall be claimed.

By every fuch Perfon not chargeable for any fuch Coach.

The faid Duties to be paid by every Perfon having used or caused to be used any Armorial Bearing or Enfign, by whatever Name the fame is or fhall be called, within the Year preceding the Term for which the Affeffment ought to be made, and to extend to every Perfon who within the faid Period fhall have been poffeffed of, or fhall have kept or had any Coach or other Carriage chargeable with the Duty by this Act, or any Seal, Plate, or other Article, on which Carriage, Seal, Plate, or other Article, any Armorial Bearing or Enfign is or fhall have been, during the faid Period, painted, engraved, marked, or affixed, and whether fuch Armorial Bearing or Enfign fhall be registered in the College of Arms or not.

EXEMPTIONS from the faid Duties as fet forth in

Schedule (K.)

Any of the Royal Family; or any Person who fhall, by Right of Office or by Appointment, have worn or ufed any of the Arms or Infignia worn or ufed by the Royal Family, or ufed in any City, Borough, or Town Corporate, in that Part of Great Britain before defcribed.

SCHEDULE (L.)

A SCHEDULE of the Duties made payable in respect of

killing GAME.

Upon every Person who fhall ufe any Dog, Gun, Net, £. d.
or other Engine, for the Purpose of taking or killing
any Game whatever, or any Woodcock, Snipe,
Quail, or Landrail, or any Conies, in any Part of
Great Britain :

If fuch Perfon fhall be a Servant to any Perfon duly
charged in refpect of fuch Servant to the Duties
granted on Servants by this Act, and fhall ufe any
Dog, Gun, Net, or other Engine, for any of the
Purposes before mentioned, upon any Manor or Roy-
alty in England, Wales, or Berwick-upon-Tweed,
or upon any Lands in Scotland, by virtue of any
Deputation or Appointment, duly registered or en-
tered as Game-keeper thereto, there fhall be charged
the Annual Sum of

And if fuch Pe.fon as laft aforefaid fhall not be a Ser-
vant for whom the faid Duties on Servants fhall be
charged, there fhall be charged the Annual Sum of

EXCEPTIONS to the above Duties.

1. The taking of Woodcocks and Snipes with Nets or Springes. 2. The taking or destroying of Conies in Warrens, or in any inclofed Ground whatever, or by any Perfon in Lands in his or her Occupation, either by himself or herself, or by his or her Direction or Command.

RULES for charging the faid laft-mentioned Duties. I.-Every Perfon who intends to ufe or fhall ufe at any Time after the Thirtieth Day of June One thoufand eight hundred and eight, any Dog, Gun, Net, or other Engine for any of the Purpofes mentioned in the Schedule to this Act annexed, marked (L.) fhall, before he shall fo ufe the fame in any Year, pay or caufe to be paid in each Year unto the Collectors of the Duties mentioned or referred to in the other Schedules of this Act, for the Parish, Ward, or Place, where he fhall refide, if in England, or to the Collector of the Cefs, or his Deputy, for the Shire, Couuty, Borough, or Place where he fhall refide, if in Scotland, or one of them refpectively as aforefaid for the Time being, the Duty hereby made payable, and shall obtain a Certificate thereof in the Manner herein directed; which Certificate fhall continue in force until and upon the Fifth Day of April next after the Time of iffuing the fame, and no longer.

Duty for ufing Dogs, Gun, &c. fhall be paid to Collectors of

Affeffed Taxes annually.

(N.) II.—V.

II.-Every Collector on Application to him made by any Perfon refiding within the Limits of his Collection, and on Payment to fuch Collector of the Duty hereby made payable, fhall give a Receipt for the fame, which Receipt fhall be figned by fuch Collector, and made out conformable to fuch of the Forms for Certificates in the Schedule See Schedule to this Act annexed, as the Cafe may require; and every fuch Receipt fhall be a Charge on the Parish or Place for which fuch Collector fhall be appointed for the Sum therein expreffed, in like Manner and to the like Effect as if the faid Sum had been previously affeffed and levied by fuch Collector under the Warrant of the Commiffioners acting in the Execution of this Act; for which Receipt the faid Collector fhall be entitled to demand and receive from fuch Perfon, the Sum of One Shilling over and above the faid Duty, and no more, which His Fee 10. Sum fhall be deemed the Compenfation to fuch Collector for his Pains and Care in executing this Act; and the Duty fo received shall be paid to the Receiver General or his Deputy, at his or their next Receipt of Duties, in full and without Deduction; provided that the Receipts given for the Duties contained in this Schedule fhall not be liable to any Stamp Duty whatever.

III.-Every fuch Receipt being delivered to the Clerk of the Commiffioners acting for the District where the Perfon aforefaid fhall refide, fhall be exchanged for a Certificate made out in one of the Forms in the Schedule to this A&t annexed, marked (N.) cor- Commiffiouers, refponding with fuch Receipt, which Certificate the faid Clerk is hereby required, on Demand, to make out and deliver gratis to fuch Perfon in Exchange for the said Receipt.

How Collectors

Taxes; and the faid Books, together with the faid Receipts, being exhibited to the Commiffioners acting in the Execution of this Act for the District, and examined by them, shall be a fufficient Authority to them from Time to Time to cause an Affeffment to be made on the feveral Perfons mentioned in fuch Receipts in the refpective Sums paid by them, which Affeffments fhall be of the like Force and Effect, in all refpects, and fhall be as binding on the feveral Collectors and others acting in the Execution of this Act, and on the feveral Parishes and Places for which fuch Collectors fhall have been refpectively appointed, as any Affeffment to be made by the faid Commiffioners refpectively under the Regulations of the faid Acts under which they act as Commiffioners; and the faid Commiffioners shall return Duplicates thereof to the Receiver General, and to the Commiffioners for the Affairs of Taxes, in the Manner directed by the faid Acts.

V. The Commiffioners for the Affairs of Taxes fhall caufe a fufficient Number of Receipts to be diftributed amongst the feveral Clerks, and by them to the feveral Collectors in their refpective Diftricts, and the faid Clerks refpectively fhall be accountable to the faid Commiffioners for the Affairs of Taxes for the fame; and the feveral Collectors fhall be accountable to the refpective Clerks for the fame; and the faid Commiffioners for the Affairs of Taxes fhall alfo caufe a fufficient Number of Forms to be used for Certificates, according to the Forms fpecified in the Schedule to this Act annexed, marked (N.) to be diftributed to the respective Clerks in like Manner.

VI.-In any Diftrict wherein no Clerk fhall be appointed to act in the Execution of the faid Acts, the Surveyor of the fame District fhall execute the Duty of fuch Clerk in all Matters and Things herein required to be done by fuch Clerk, and in every fuch Cafe the Certificates herein required fhall and may be iffued by fuch Surveyor, according to the Directions of this Act; and in every Place for shall be charged which One Collector only fhall be appointed, who fhall be chargeable with Duty, to the Duty contained in this Schedule, an Acknowledgement in Writing under the Hand of fuch Collector, that he is chargeable with the faid Duty, and delivered to fuch Clerk or Surveyor refpecively as aforefaid, fhall be a fufficient Authority for fuch Clerk or Surveyor to iffue a Certificate to fuch Collector, and to make an Affeffment of the faid Duty upon fuch Collector as in other Cafes

VII. Every Mafter or Mittrefs charged or liable to be charged to the Duties on Servants mentioned in the faid Schedule marked (C.) No. 1. annexed to this Act, in refpect of any Gamekeeper, whether fuch Perfon fhall have been deputed or appointed by fuch Master or Mistress, or by any other Perfon or Perfons, and every Person granting a Deputation or Appointment to the Servant of any other Perfon, who fhall be duly charged to the faid Duty on Servants, in refpect of fuch Servant, whether as Gamekeeper, or in any. other Capacity, with Power and Authority to ufe any Dog, Gun, Net, or other Engine, for any of the Purpofes mentioned in this Schedule, fhall be at liberty to obtain a Receipt and Certificate on behalf of fuch Servant, on Payment of the Duty for the fame, in the Manner before

before directed; and fuch Receipt and Certificate fhall be a fufficient Authority to affefs the Mafter or Miftrefs or Perfon granting fuch Deputation or Appointment, and obtaining fuch Receipt and Certificate as aforefaid; and the Certificate to be iffued thereupon, fhall be deemed and conftrued to exempt the Servant or Servants named therein, during his or their Continuance in the fame Capacity and Service; and alfo to exempt any Servant or Servants of the fame Mafter or Mistress who fhall fucceed to the Deputation or Appointment of the fame Manor or Royalty, or Lands, within the Year for which the Duty fhall be fo affeffed for and during the Remainder of fuch Year; and no fuch Servant in whofe Behalf a Receipt and Certificate hath been duly obtained as aforefaid, fhall be required to ob tain a Certificate for himself, nor be liable to the Duty hereby granted, nor to any Penalty by reason of not obtaining a Certificate in his own Name, or for not paying the faid Duty: Provided always, that every Certificate granted under this Act to any Perfon acting under any Deputation or Appointment, fhall, upon the Revocation of fuch Deputation or Appointment, be from thenceforth void and of no further Effect, as to the Perfon therein deputed or appointed; provided, that if any Lord or Lady of any Manor in England, Wales, or Berwickupon-Tweed, or Proprietor of Lands in Scotland, fhall, on the Revocation of any Deputation or Appointment by virtue of which a Certificate hath been granted for any Year, make a new Deputation or Appointment within the fame Year, to any Perfon in his or her Service, or in the Service of the same Master or Mistress who shall have been charged, as well to the Duties on Servants as to the Game Duties granted by this Act, it fhall be lawful for the Clerk to the Commiffioners of the Diftrict, and every fuch Clerk is hereby required in fuch Cafe to renew the Certificate for the Remainder of that Year, in behalf of the Perfon fo newly appointed, without any Duty or Fee, by endorfing on fuch Certificate the Name and Place of Abode of the Perfon to whom fuch laft-mentioned Deputation or Appointment had been granted, and declaring the fame to be a renewed Certificate, free of Duty or Fee.

VIII. Neither the Affeffment of the Duty hereby impofed, nor the Payment thereof, nor the Certificate delivered, nor any Thing herein contained or done in pursuance of this Act, fhall authorize or enable any Perfon to use any Dog, Gun, Net or other Engine, for any of the Purposes mentioned in this Schedule, at any Time or Times, or in any Manner prohibited by any Law in force at and immediately before the paffing of this Act, nor unless fuch Perfon fhall be duly qualified fo to do, under and by virtue of the Laws in being; and all Penalties and Forfeitures, Actions and Suits, fhall and may be profecuted and maintained for fuch Offences as if this Act had not been made.

IX.-No Affeffment or Certificate under this Act, or Payment of the Duty hereby impofed, by or for any Perfon acting under a Deputation or Appointment, fhall be received in Evidence, or be available in Law or Equity, in any Suit or Profecution under this Act, where Proof fhall be given of ufing any Dog, Gun, Net, or other Engine for any of the Purpofes mentioned in this Schedule, out of
