I. Sa Majesté le Roi des Belges accède, tant pour que pour ses héritiers et successeurs, au Traité pour la Suppression de la Traite des Nègres d'Afrique, signé à Londres le 20 Décembre, 1841, par les Plenipotentiaires de la Grande Bretagne, d'Autriche, de France, de Prusse, et de Russie, lequel a été ensuite dûment ratifié par Leurs Majestés la Reine du Royaume Uni de la Grande Bretagne et d'Irlande, l'Empereur d'Autriche, le Roi de Prusse, et l'Empereur de toutes les Russies; l'Accession de Sa dite Majesté le Roi des Belges étant néanmoins sujette à certaine modification de l'Article IX du Traité susdit, laquelle modification a été relatée dans le Protocole de la Conférence tenue à Londres le 3 Octobre, 1845, entre les Plénipotentiaires de la Grande Bretagne, d'Autriche, de Prusse, et de Russie. Et Sa Majesté le Roi des Belges s'engage à remplir fidèlement toutes les obligations résultant des dits Traité et Protocole (desquelles pièces des copies imprimées se trouvent annexées au présent Traité), de la même manière que si elle avait été Partie Contractante au dit Traité. Et Leurs Majestés la Reine du Royaume Uni de la Grande Bretagne et d'Irlande, l'Empereur d'Autriche, Roi de Hongrie et de Bohême, le Roi de Prusse, et l'Empereur de toutes les Russies, acceptent formellement l'Accession de Sa Majesté le Roi des Belges. II. Tous les navires Belges qui seront arrêtés aux stations d'Amérique ou d'Afrique, comme se livrant à la Traite des Nègres, seront conduits dans le port d'Anvers ou d'Ostende, pour y être procédé contre les armateurs, le capitaine, et les gens de l'équipage, conformément aux lois en vigueur en Belgique. Cependant, si lors de l'arrestation il y a des esclaves trouvés à bord, ceux-ci seront préalablement déposés dans le port où le bâtiment aurait dù être conduit, s'il avait navigué sous le pavillon du croiseur qui en aura fait la capture. III. Le présent Traité sera ratifié, et les ratifications en seront échangées à Londres, dans le délai de 3 mois à partir de la date du dit Traité, et plus tôt si faire se peut. Who, after having communicated to each other their respective Full-powers, found in good and due form, have agreed upon and concluded the following Articles: Art. I. His Majesty the King of the Belgians accedes, for himself, his heirs and successors, to the Treaty for the Suppression of the African Slave Trade, which was signed at London on the 20th of December, 1841, by the Plenipotentiaries of Great Britain, Austria, France, Prussia, and Russia, and which was afterwards duly ratified by Their Majesties the Queen of the United Kingdom of Great Britain and Ireland, the Emperor of Austria, the King of Prussia, and the Emperor of all the Russias; the Accession of His said Majesty the King of the Belgians being, however, subject to a certain modification of Article IX of the Treaty aforesaid, which modification was recorded in the Protocol of a Conference held at London on the 3rd of October, 1845, between the Plenipotentiaries of Great Britain, Austria, Prussia, and Russia. And His Majesty the King of the Belgians engages faithfully to fulfil all the obligations resulting from the said Treaty and Protocol (printed copies of which are annexed to the present Treaty), in the same manner as if he had been a Contracting Party thereto. And their Majesties the Queen of the United Kingdom of Great Britain and Ireland, the Emperor of Austria, King of Hungary and Bohemia, the King of Prussia, and the Emperor of all the Russias, formally accept the Accession of His Majesty the King of the Belgians. II. All Belgian vessels which shall be detained on the American or African stations, as having been engaged in the Slave Trade, shall be carried either to the port of Antwerp, or to the port of Ostend, in order that proceedings may there be instituted, according to the laws in force in Belgium against the owners, the captain, and the persons composing the crew. If, however, at the time of detention, any slaves should be found on board, such slaves shall, in the first instance, be conveyed to the port to which the vessel would have been carried, if she had been sailing under the flag of the cruizer by which she was captured. III. The present Treaty shall be ratified, and the ratifications thereof shall be exchanged at London, not later than the expiration of 3 months from the date thereof, and sooner if it can be done. |
