fity and Condition foever, who are fick or wounded, as well in the Hofpitals of the faid Town, as in the private Houfes of the Burghers, publick Houses, and others, fhall be tranfported to Valenciennes, or Douay, with the Phyficians, Surgeons, Apothecaries, and other Perfons appointed to take care of them; and, That the Allies fhall give them Boats, and other fufficient Carriages, with the neceffary Guards and Pafports, to be conducted thither in fafety; as alfo the Servants and Equipages of the faid Sick and Wounded, fix Days after the figning of the faid Capitulation, and by the shortest Way. Granted, at the Charge of the Befieged, upon Condition the Number and Quality be fet down, who shall share the Fate of the Garrison of the Citadel; and if any Deferters be found among the Sick and Wounded, they shall be feiz'd.

V. That the faid Sick and Wounded, who are not in a Condition to be tranfported, shall remain in the faid Town, in the fame Lodgings they are now in, till they are perfectly cured; and Provifions and Medicines fhall be furnish'd them at the Expence of the Allies, according to their Character; and after their Cure, they fhall be furnifh'd with Pafports and Carriages, to be tranfported to Valenciennes or Douay, in fafety, and by the shortest Way. Granted at the Expence of the Befieged, according to the Tenour of the foregoing Article.

VI. That no Officer, fick, wounded, or otherwife, fhall be arrested for Debt, or under any other pretence whatever; but that Security for the Payment fhall be given to fuch as fhall make appear, that any thing is lawfully their Due. Granted, upon Condition that the Creditors are fatisfied with their Security.

VII. That all the Contracts and Engagements made between the French and the Burghers of the faid Town, fhall be faithfully executed on both Sides, according to their Form and Tenour; as well as thofe which shall have been entred into with the Magiftrates of the faid Town. Granted, so far as it concerns private Perfons.

VIII. That the Horfes and Equipages of the Of ficers commanding in the Place, and of the Troops of the Garrifon, Commiffaries of War, Engineers, Officers of Artillery, Directors, Commiffaries of Provifions,

Provifions, and all others, fhall be conducted to Valenciennes, or Douay, in fafety, with a Guard, one Day before the Garrifon goes into the Citadel, and by the shortest Way. And the faid Equipages fhall not be rifled, nor arrefted, under any Pretence; nor any Damage done to the fame, nor to those that shall conduct them. That the Marshalfey, compos'd of the Lieutenants, Provoft of Merchants, an Exempt, and Ten Archers fhall be allow'd the space of fix Months, to go out of the Town, as was granted to thofe of Lifle. Granted for the Equipages to go out the Same Day that the Garrison fball go into the Citadel, and fix Days for the Marshalfey, confifting of a Lieutenant, Provost, Exempt, and Ten Archers.

IX. That the Officers of the State-Major of the faid Town, be permitted to retire to Valenciennes, or Douay, with their Families, Effects, and Equipages, for which the neceffary Carriages thall be furnish'd them at their own Expence, to tranfport all that belongs to them, with a Guard or Pafport, to conduct them in fafety, and by the shortest Way. Granted.

X. That it fhall be permitted to fend back to Valenciennes or Douay, the Companies of Invalids that are in the Citadel, and the Troops of Dragoons of Bourieres, with Arms and Baggage, their Horfes and Equipages. Refus'd.

XI. That all the Wives, Children, and Families of the Officers, Soldiers, and others of the Troops of France, of what Quality and Character foever, may also retire with their Effects, to Valenciennes, or Douay, whither they fhall be conducted with a fufficient Guard, by the shortest Way. Granted.

XII. That none of the Officers of the Garrison, of what Character foever, nor the Troops, fhall be molefted, or call'd to account for Endamaging, Burning, or Demolishing the Suburbs, and the Infide of the Town. Granted, if there be no previous Engagement.

XIII. That the Horfes which have been taken in the War, and bought by the Officers and Burghers, fhall not be taken from them. Granted.

XIV. That the Prifoners made during the Siege, fhall be reftor'd on both Sides, Man for Man, and Character

Character for Character. All the Prisoners taken by the Garrifon, fhall be reftor'd; and, in return, all fuck as have been taken from the Town, during the Siege, shall likewife be reftor'd.

XV. That the Hoftages given on both Sides, for the fecurity of the Execution of the prefent Capitulation, fhall be reciprocally fent back, after the entire Execution of the fame. Granted.

XVI. That Monfieur Bermont, Commiflary of War, fhall remain with the Sick and Wounded, to take care of them, and fee them conducted to Valenciennes, or Douay, with their Equipages, with Pafports, or a Guard, to go thither in fafety, and by the shortest Way. Granted.

XVII. That the Director, of the Pofts, his Commiffioners, Family, and Effects, may also retire to Donay, or Valenciennes, with Pafports or a Guard, to go thither in fafety, and by the shortest Way. Granted.

XVIII. That all the Effects belonging to the Officers of the State-Major, Commiffaries of War, Treafurer, and others in Office, who fhall remain in the Town, or go into the Citadel, fhall remain in fafety in the faid Town, to the end thar they may be withdrawn, and be fent out in a Month after the furrender of the Citadel. Granted, a Month after the figning of this Capitulation.

XIX. That all the Effects belonging to Monfieur Defeaux, and Monfieur de Cloy, Undertakers of the Furniture, as well for the Hofpitals, as for the Caferns, (hall belong to them, with all the Utenfils that they have hitherto let to his Majefty. Granted,

XX. That the Cows, Sheep, and other Things neceffary for the Subfiftence of the Sick and Wounded in the Hospitals, which fhall be left the Undertakers, under the Direction of the Commiffary propos'd, fhall be preferv'd to the faid Undertakers, for the Occafions of the King's Troops that are fick and wounded. Granted.

XXI. That all the Burghers, and Inhabitants of the faid Town, as well French as others, of both Sexes, of what Quality and Condition foever, may continue to live therein, or go out in 3 Months, with their Families and Effects, in order to retire whither they please; nor fhall any wrong be done 'ein, whe

ther they have been concern'd in Commerce, or in any other Employs whatfoever; for which purpose, the neceffary Safeguards and Pafports fhall be given them gratis. Granted, and limited to fix Weeks.

XXII. As foon as the Capitulation fhall be fign'd, it fhall be permitted to fend an Officer Express to the Marefchal de Villars, to give him an Account thereof; and a Pafport fhall be given the faid Officer, as well for his Journey to the Marefchal de Villars, as for his Return to the Citadel of Tournay. Granted for to morrow the 30th, and that he return the 1st of Auguft.

ARTICLES on the Part of the ALLIES.

HOftages, or other Sureties, fhall be left in the Town, for the Payment of the Debts which have been contracted there on the account of his Moft Chriftian Majefty; and the faid Hoftages fhall tarry till full Payment be made; as alfo for the Corn, Cattle, and other Things which they have taken in the Town and flat Country. A Commissary of War fhall be left as Hoftage.

The Keys of the Magazines of Provisions and Ammunition fhall be deliver'd up to fuch as fhall be commiffion'd to receive 'em, and all the Mines that may be there, fhall be faithfully difcover'd to them. This fhall be faithfully executed; and 'tis convenient, that no more than Two or Three Perfons be pointed for that End, to avoid the confusion of a greater Number. And this Article shall be put in Execution the 31st of July, at Noon.

As it has been granted, That fuch as are willing to retire from Tournay into France, may do fo; 'tis demanded, on the other hand, That fuch of the Inhabitants of Tournay, as have Effects or Actions in France, may withdraw them, without any Hindrance or Obftruction; but, on the contrary, that all poffible Affiftance and Relief be given them. Granted, provided they make appear, that the Effects or Actions do lawfully belong to them.

The Capitulation with the Magiftrates being a Matter of Time, the fame fhall be examin'd and fettl'd hereafter.

1. A Letter from the Duke of Marlborough, to Mr. Secretary Boyle.

From the Camp at Blaregnies, September 11. N. S. 'AS foon as I had dispatch'd my Letter to you,

on Saturday from Havre, we were alarmed

with the Enemies marching to attack the Prince C of Heffe, upon which the whole Army was imme'diately put in motion; but it was next Day at

Noon before all the Troops could come up. In the Morning they fent out a Detachment of Four 'hundred Horfe, to obferve our March, which the

Head of the Prince of Heffe's Troops attacked, ' and took the Colonel who commanded them, with 'the Lieutenant Colonel, and feveral other Officers, and about fifty Prifoners. Upon notice of our Army's lying on this fide the Hayne, the Enemy ftretched out their Line from Queivrain to the Right, which they continued to do the next Day, and Yefterday they poffeffed themselves of the Wood of Dour and Blangies, where they immediately began to intrench. This Motion of the Enemy kept our Army for two Nights under their < Arms; and in the Evening, as foon as the twenty < one Battalions and four Squadrons we were expecting from Tournay, were come within reach, it was refolved to attack them, and the neceffary Difpofitions being made, we accordingly began at
