MARQUETTE COUNTY.

In the matter of the application of certain freeholders of the townships of Turin and Wells to have certain territory detached from the township of Turin and added to the township of Wells, and certain other territory detached from the township of Wells and added to the township of Turin.

WHEREAS, Application has been duly made to the board of supervisors of the county of Marquette, Michigan, by:

All of whom are freeholders and twelve of whom reside in each of the townships to be affected thereby, to have certain territory detached from the township of Turin and added to the township of Wells, and certain other territory detached from the township of Wells and added to the township of Turin, and the said board of supervisors having been furnished with a map of all the townships to be affected thereby; and it appearing to said board by due proof that notice in writing of such intended application, signed by at least twelve freeholders of each of the townships to be affected thereby, has been duly posted up and published in the manner and for the time required by law; and it also appearing to said board upon consideration thereof that the said application ought to be granted; therefore

It is resolved, ordered and determined by the said board of supervisors of the county of Marquette, Michigan, That the following described territory, to-wit: All that part of township forty-three (43) north, range twenty-five (25) west, lying east of the Escanaba river, particularly described as section one (1); section two (2); east half and lots one (1), two (2), three (3) and four (4) of section three (3); east half of northeast quarter, northwest quarter of northeast quarter, northeast quarter of southeast quarter and lots one (1), two (2), three (3), and five (5) of section ten (10); north half, north half of southwest quarter, southeast quarter, and lots one (1), two (2), three (3) of section eleven (11); all of section twelve (12); north half, southeast quarter, and lots one (1) and two (2), of section thirteen (13); northeast quarter of northeast quarter and lots one (1) and

quarter line to the east line of said section thirty (30), said town and range; thence north along the east line of section thirty (30), and nineteen (19), said town and range to the intersection of the center line of Vineyard avenue; thence west along the center line of said Vineyard avenue sixty (60) rods, thence south parallel with said east line of section nineteen to the center line of Empire avenue, thence west on the center line of Empire avenue to the west line of Agard avenue; thence south on the west line of Agard avenue to the center line of Weld street, thence west on the center line of Weld street to the west line of Union avenue; thence north on the west line of Union avenue to the center line of Empire avenue, thence west on the center line of Empire avenue to the place of beginning; said lands being located in sections nineteen (19) and thirty (30), town four (4) south, range eighteen (18) west, Berrien county, Michigan, and

It is further ordered, That the boundaries of said city of Benton Harbor be changed to be as follows, to-wit:

Commencing at the center of the St. Joseph river at a point where the south line of section twenty-four (24) town four (4) south, range nineteen (19) west, would if extended west intersect said river, the same being in Berrien county, Michigan; thence east along the south line of said section twenty-four (24) to the southeast corner of said section; thence south along the west line of section thirty (30) town four (4) south, range eighteen (18) west, the same being the center line of Colfax avenue, to the intersection of the east and west quarter line of section thirty (30) said town and range; thence east along said, quarter line to the east line of said section thirty (30), thence north along the east line of sections thirty (30) and nineteen (19) and eighteen (18) said town and range, to the east terminus of the east and west quarter line of said section eighteen (18), thence west along the east and west quarter line of section eighteen (18) town four (4) south, range eighteen (18) west to a point 1320 feet west of the east line of said section eighteen (18), thence north one thousand three hundred twenty feet; thence west to the center of the Paw Paw river; thence westerly and southerly along the center of said Paw Paw river to a point fifty feet north of the north line of the Paw Paw river, also known as the Ship Canal; thence westerly parallel to and fifty feet north of the north bank of the said Paw Paw river, also known as the Ship Canal to the center of the St. Joseph river; thence southerly along the center of the St. Joseph river passing through the center of the draw pier of the Highway Bridge, to the place of beginning.

I hereby certify that the above and foregoing is a true copy of a resolution and order passed and adopted by the board of supervisors of Berrien county, Michigan, on the 14th day of April, 1909.

In the matter of the alteration of the corporate limits of the city of Benton Harbor.

At a regular session of the board of supervisors held at the court house in the city of St. Joseph, Michigan, on the 14th day of April, A. D. 1909.

WHEREAS, The city council of the city of Benton Harbor in said county has filed with this board a petition praying that certain lands situate in the township of Benton in said county may be taken in said city of Benton Harbor and made part thereof, and it

Appearing that said petition contains a metes and bounds description of the premises proposed to be added to said city which is companied by a map of said lands and sets forth the reasons for the proposed change and contains a copy of the resolution of the city council in relation thereto and is certified to by the city clerk under the official seal of said city, and it further

Appearing that before said petition was presented to the board of supervisors, notice was given by the city clerk of the time and place when said petition would be presented for consideration by publishing the same in the News-Palladium, a newspaper published in the city of Benton Harbor, for three weeks immediately preceding the presentation of said petition, which notice contains a description of the premises proposed to be taken in such city, be it therefore

Resolved, And it is hereby ordered, That the lands described in the aforesaid petition, now located in the township of Benton be transferred to the city of Benton Harbor and a change of boundaries of said city is ordered to include the following described property:

Commencing at the southwest corner of section nineteen (19), township four (4) south, range eighteen (18) west, Berrien county, Michigan, thence south along the west line of section thirty (30), town four (4) south, range eighteen (18) west the same being the center line of Colfax avenue, to the intersection of the east and west quarter line of section thirty (30), said town and range thence east along said

BERRIEN COUNTY:

In the matter of the incorporation of the village of Hilltop.

October 13, 1908.

Moved by Mr. Daigneau, supported by Mr. Farmer, that the prayer of the petitioners in the matter of the petition for the incorporation of the village of Hilltop be granted.

Yea and nay vote being called for with the following result: Aye 28, two not voting and two absent.

Moved by Mr. Farmer, supported by Mr. Stemm, that the following resolution be accepted and adopted. Motion carried.

WHEREAS, Heretofore a petition has been filed by more than thirty legal voters residing within the territory described in said petition, setting forth that said territory is wholly located within the township of St. Joseph, county of Berrien and State of Michigan, and that no part thereof is included in an incorporated village, and that said territory has an area exceeding one square mile and has a resident population of more than three hundred persons, and which said petition prays that this board of supervisors of Berrien county, Michigan, make an order directing that said territory in said petition be an incorporated village by the name of Hilltop, and that such other proceedings be had as are in accordance with law; and

WHEREAS, The persons making such application caused an accurate census to be taken of the resident population of the territory described in said petition, which census was taken within sixty days before the time of presenting said petition and has heretofore been filed with said petition as is required by law; and

WHEREAS, The persons making application by said petition have heretofore caused a notice of their intention to present such petition to this board of supervisors on the 12th day of October, 1908, which notice states that the petitioners would apply upon said date to this board of supervisors for an order incorporating such territory as a village and describing the said territory, and in all things complied with the requirements of law as to such notice, and which notice the said petitioners caused to be duly published in accordance with law, and to be posted with the territory described in said petition; proof of which publication and posting of such notice are annexed to the said petition; and

WHEREAS, The said petition with said census and the affidavit verifying the same, and with a copy of the said notice with an affidavit of the posting, and an affidavit of the publication of the said notice all annexed to the said petition which has been heretofore filed with the clerk of the said county of Berrien upon the 10th day of October, 1908, and said petition was presented at the time specified in said notice for hearing before said board of supervisors; and the board of supervisors having heard all parties who appeared and asked to be heard in relation to the said petition and after hearing the said parties this board.
