Mr. Young announced the attendance of Nathaniel C. Mitchell, the member elected from the county of Lafayette, to fill the vacancy occasioned by the resignation of William McCausland, who appeared, produced his credentials, was qualified and took his seat.

On motion of Mr. Speaker,

"A bill to incorporate the Osage Smelting and mining company," Was taken up and read a third time.

Mr. Thomas moved

To amend the bill by way of ryder, as follows, to come in after the 14th line in the 2nd section.

"And provided further that whenever the said rail roads are made, they shall be so constructed as to leave a free passage for all other roads state or county, to cross the same as is provided for in the "act incorporating the Southern rail road company," passed at this session of the General Assembly, strike out the words water privileges' in the fouth line of the section."

On motion of Mr. Cravens of Pettis,

A resolution in relation to guardians and minors, submitted by him, was taken up and adopted.

Mr. Price from the select committee, to whom was referred the petition of sundry citizens of Chariton county, praying to attach a part of Chariton county, to the county of Howard, reported, that it is inexpedient, in the opinion of said committee, to grant the prayer of said petitioners.

Mr. Morris, from the same committee, submitted the following counter report,

Which was ordered to be spread upon the journal.

The undersigned are of opinion, that the petitioners aforesaid, do labor under serious inconveniencies and disadvantages, from being attached to Chariton county, which would not be the case, if they were annexed to Howard county; and we are of opinion that it is right and just in all cases to grant the prayer of any portion of the people, when it may be done without doing material injury to other persons, this being the case in the opinion of the undersigned, we are fully satisfied, that right and justice require the annexation as prayed for by the petioners.

To amend the first section 10th and 11th lines, by striking out the words "common jail of the county," and inserting "state Penitentia

To amend the first section by striking out "one dollar for each wolf so killed or taken," and inserting "one dollar for each wolf killed or taken over four months old, and fifty cents for each wolf killed or taken of four months old or under, the age to be ascertained by the oath of the party as near as may be, when presented to the Justice." Which was read and rejected.
