To amend the 11th section of the bill by way of ryder, by adding thereto, "Provided, That if any town, or the inhabitants thereof, situated within forty miles of said rail road, desire a lateral road to the town they inhabit, and notify the company of the fact, and the company fail to commence, within five years, any other company incorporated for that purpose, shall have power to build said lateral rail road, and join the same to said main rail road, hereby authorized to be built-provided the said company establishing the lateral shall have no privileges on the main stem, except the transportation of their produce like other individuals,"

Mr. Edwards moved,

To amend the same section by way of ryder, by inserting the following, after the ryder offered by Mr. Wright of Marion,

"Provided further, That said President and Directors, shall not enter upon any lands, or cut, quarry, dig, take or carry away therefrom any woods, stone, gravel, or earth, without first making application to the owner of said lands, or materials, and tendering to him a reasonable compensation therefor, except lands owned by the United States."

To amend the bill by way of ryder, to come in at the end of the ryder offered by Mr. Price, by adding

Provided, That said laterals shall not exceed twenty five miles in length, except a lateral rail road from Brunswick, at the mouth of Grand river, in Chariton county.

Mr Speaker moved to consider the

"Bill to incorporate the St. Louis and Fayette rail road Company," As engrossed, and that the bill be read a third time.

Mr. Fort moved

To recommit said bill to the committee on Internal Improvements, with instructions to amend the bill so as to cause the company to make a survey of the road from St. Charles to the best ground north of the mouth of Grand river, with a view to the future extension of the route to some point on the Missouri river, said route to pass through each intermediate county seat, if found on actual survey to be practicable at a reasonable expense, and if not so practicable, as near thereto as may be, when the company shall construct to each town as aforesaid, such laterals as may be necessary, the company

thereby to be incorporated to construct only that of the western route from St. Louis, that shall be between the intersection with the Marion city rail road and St. Louis.

Which motion was, at the request of Mr. Fort, decided by ayes and nays in the negative. Ayes 20-nays 48.

A message from the Senate by Mr. Bowen.

MR. SPEAKER-The Senate have passed a bill from the House entitled,

"An act for the relief of the clerk of Carroll county."

Which is herewith returned.

There have been introduced into the Senate,

"A bill supplementary to an act to organize the counties of Livingston, Macon, Taney and Linn." And

"A bill to amend an act to organize the county of Audrain.” The first of which has passed the Senate and is herewith submitted for the action of the House. The Senate have rejected. "A bill to pay judges and clerks of elections."

On motion of Mr. Fort

The House passed over the previous orders and resolved itself into a committee of the Whole, and after spending some time therein rose and Mr. Fort their chairman reported, that the committee had had under consideration,

"A bill to establish judicial districts and circuits, and prescribe the times and places of holding courts," and

Had made some progress therein, and ask leave to sit again,

SIR-Being instructed by my constituents to vote for a Bank, and as that Charter contains provisions, in my opinion, contrary to the Constitution of this State, you will therefore receive herewith my resignation as a member of the present General Assembly, from the county of Lafayette.

Mr. Coalter, presented the petition of sundry citizens of the town and county of St. Charles, praying for the incorporation of a company, to make a rail road from St. Charles to the Mississippi river, Which was read, and

On his motion referred to a select committee, Whereupon Messrs. Coalter, Watts, and Wright of Marion were appointed that committee.

Mr. Noland presented the petition of S. J. Boggs and others, praying for the incorporation of a company to make a rail road from Livingston by Independence, and form thence to Jefferson city, and On his motion

The reading of the same was dispensed with, and

It was referred to the committee on Internal Improvements.

Mr. Thomas from the committee on elections, to which was referred a resolution directing an inquiry into the expediency of allowing the Judges of the county courts to keep the polls open for a longer period than at first ordered, provided it appeared that that period was insufficient to receive the votes, and to allow compensation to Judges and Clerks of elections, Also,

A resolution directing an inquiry into the expediency of authori zing the Judges of elections to qualify each other. Also,

A resolution directing an inquiry into the effect produced in the city of St. Louis, by the present method of voting at General elections, reported.
