"A bill to charter the Union Bank of the State of Missouri," and Have made some progress therein, and ask leave to sit again, Which was granted by the House.

SATURDAY MORNING, JANUARY 7, 1837.

THE House met pursuant to adjournment.

Mr. Young from the Joint Committee on enrolled bills, reported as truly enrolled,

"An act to incorporate the Merrimac Academy, and for other purposes."

"An act to establish permanently the Seat of Justice in the county of Benton,"

"An act to incorporate the St. Louis Chamber of Commerce." "An act declaring the present county road from Booneville to Georgetown, a part of the State Road."

"An act for the relief of the Heirs of Daniel Doren, deceased," also,

"A memorial to Congress, on the subject of improving the South Grand river,"

Which were signed by the Speaker of the House, and transmitted to the Senate.

Mr. Thompson, from the Select Committee, to which was referred the petition and remonstrance of sundry citizens of Boone and Callaway counties, praying for and remonstrating against the organization of a new county, reported,

That the committee have had the same under consideration, and ask leave to communicate the following facts:

First. That three hundred and sixty-eight persons, living within the proposed new county, have petioned for the organization of the

same.

Second. That one hundred and sixty-eight persons, living within the said proposed new county, have remonstrated against the organization of said county.

Third. Five hundred persons, residents of Callaway county, and living out of said proposed county, have remonstrated against the organization of said proposed county.

The committee thereon ask leave to report that it is inexpedient to grant the prayer of said petitioners.

Which report was read and concurred in by the House.

Mr. Noland moved to dispense with the resolution, making the

Bank bill the special order of the day after the reception of the first order of business, for the purpose of taking up the resolution relative to the election of Warden of the Penitentiary.

Which was decided in the negative.

Mr. Fort moved to dispense with the same for the purpose of adding Mr. King to the select committee, to which was referred the bill from the Senate regulating fees.

Which was also decided in the negative.
Message from the Senate by Mr. Bowen.

MR. SPEAKER-The Senate have concurred in the passage of a bill from the House of Representatives, entitled

"An act, supplementary to an act, entitled an act, to regulate the sale of the sixteenth sections, and to provide for organizing, regulating, and perpetuating Common Schools," with amendments, in which the concurrence of the House is requested.

The Senate have also passed a bill entitled

"An act to pay Jurors,"

Which is herewith submitted for the action of the House.

On motion of Mr. Davis,

The House resolved itself into a committee of the Whole, on the special order of the day, and after spending some time therein, the committee rose, and their chairman Mr. Hunter, reported,

That the committee had again had under consideration,

"A bill to charter the Union Bank of the State of Missouri," and have agreed to report the bill to the House with sundry amendments; and recommend to the House to refer the bill, with the sundry amendments thereto, to a select committee of five, with instructions and power ro arrange the several amendments adopted by the committee of the Whole, in their proper places in the bill, and alter their phraseology and location, Provided, That the principles of the several amendments, be inserted, and properly arranged; and to that end they may require the engrossing clerk to attend them, and act as such clerk in this matter.

Which report was concurred in by the House,

Whereupon, Messrs. Bowlin, King, Chambers, Davis and Redman were appointed that committee.

The Speaker laid before the House the following communication from the Governor:

MONDAY MORNING, JANUARY 9, 1837.

THE House met pursuant to adjournment.

Mr. Chambers presented the petition of sundry citizens of Pike county, praying for the incorporation of a company for the establishment of a Rail Road from Paynesville to Jackson's Ware-House on the Mississippi river,

The reading of which was dispensed with, and

It was referred to a select committee, composed of Messrs. Chambers, Wright of Marion and Gray.

Mr. Thornton from the select committee to which was referred the petition of George Burckheart and others, reported

"A bill to allow Henry Lasseter and others, compensation for services rendered the state,"

Which was read the first time, and

Ordered to a second reading.

Mr. Bowlin from the select committee to which was referred the petition of the commissioners named in

"An act to incorporate the Marine Insurance Company of St. Lou is," reported

"A bill to amend an act entitled an act, to incorporate the Marine Insurance Company of St. Louis,"

Which was read the first time, and

Ordered to a second reading.

Mr. McGunnegle pursuant to notice, leave being given, introduced "A bill to incorporate the St. Louis Insurance Company," Which was read the first time, and

Ordered to a second reading.

On motion of Mr. Price,

"Resolved, That so soon as the select committee to which was referred the Bank bill, and amendments thereto, have arranged and engrossed the same; they cause the same to be printed as by them arranged and digested."

Mr. Smith of Clinton, gave notice, that on to-morrow he would ask leave to introduce a resolution, requesting Congress to establish a new land district in th Northwestern part of this State, and to establish the Land Office at Plattsburg in Clinton county.

Mr. Holliday gave notice that on Wednesday next, he would ask leave to introduce,

"A bill providing for a state road from Palmyra in Marion county by Oakdale and Shelbyville, in Shelby county, by Centreville in Macon county, to Huntsville in Randolph county,

Mr. Chambers gave notice, that on Thursday next, he would ask leave to introduce,

"A bill to provide for the establishing, and better reparing the roads in the county of Pike.

Mr. Clark gave notice that on Monday next, he would ask leave to introduce,

"A bill to incorporate the stockholders of the St. Louis Theatre." On motion of Mr. Gray.

The rule requiring one day's notice of the introduction of a bill was dispensed with, and leave being given he introduced

"A memorial to Congress relative to the improvement of the navigation of the Des Moines river,"

Which was read the first time and ordered to a second reading. On motion of Mr. Bowlin,

Resolved That the committee on the Judiciary be instructed to inquire into the propriety of

First, Of establishing a list of fees for master commissioners in Chancery.

Second-Of so amending the law respecting Chancery practice as to prescribe a method of making decrees nisi absolute, where the party has been served with process, and that they report by bill or otherwise.

On motion of Mr. McGunnegle.

Resolved That the committee on the Judiciary be instructed to inquire into the expediency of increasing the allowance to Sheriffs. for transporting convicts to the Penitentiary.

Mr. Bay, pursuant to notice, leave being given introduced,

"A bill to amend an act entitled an act to establish a state road from the city of St. Louis, to the city of Jefferson, by the way of Manchester and Union,"

Which was read the first time, and ordered to a second reading. On motion of Mr. King,

Resolved That the Select Committee, to which was referred the Bank bill, be authorized to so alter, an amendment adopted to said. bill, in reference to the Branch, to be established at this session, so as to make the President and Directors on behalf of the State, to be appointed by the same authority as are the President and Dircetors, on behalf of the State of the Mother Bank.

On motion of Mr. Bowlin,

"A bill to incorporate the Farmer's and Mechanics' Insurance Company of St. Louis,"

"A memorial to Congress on the subject of an additional superintendency of Indian affairs," and

"A bill for the relief of John More,"

Were severally read a second time, and Ordered to be engrossed and read a third time.

"A bill to organize the county of Barbour,"

Was read a second time, and committed to a committee of the Whole House.

"A bill to incorporate the Rocheport rail road company," and "A bill to incorporate the Louisiana and Columbia rail road company,"

Were each read a third time and passed.

Ordered that their titles respectively be "an act."

"A bill to incorporate the St. Louis and Bellvieu mineral rail road company,"

"A bill to incorporate the town of St. Charles," and

"A bill to incorporate the St. Louis Hotel company of the city of St. Louis,"

Were severally considered as engrossed, and read a third time and passed.

Ordered that their titles respectively be "an act."

"A bill to incorporate the Marion City and Missouri rail road Company" was read a third time.

Mr. Wright of Marion, moved to amend the 14th section by way of ryder, by adding thereto the following:

"Provided, Also, that this section shall not be so construed as to authorize the said company, to take said materials until they shall have been paid for, or until the money for the same, shall have been tendered,"

Which was read the first and second time,

Engrossed and read a third time.

'Mr. Alexander moved,

To amend said bill by way of ryder, by striking out the 14th section,

Which was read the first and second time, and

The question then being shall the ryder be engrossed and read a third time.

Was at the request of Mr. Alexander, decided by ayes and nays. in the negative. Ayes 18.-nays 47.
