Mr. Monroe moved to lay the bill on the table,

Which was decided in the negative.

Mr. Wright of Marion moved to amend the 14th section of the bill, by way of ryder, to come in after the words "Public road," insert the words "now established or hereafter to be established." Also, at the end of the section, add the words, "Provided that when it shall be necessary to pass through the land of any individual it shall also be their duty, to provide for such an individual proper wagon ways across the said rail road,"

Which was read the first and second time.

Mr. Fulkerson moved that the House adjourn, which was negatived.

The ryder was then considered as engrossed, and read the third time.

Mr. Noland then moved to amend the 16th section of the bill by way of ryder, by striking out the word "ten" in the 4th line, and insert "for the first five years, eight cents, and six and one fourth cents thereafter, during the continuance of the charter." After the word "then," in the fifth line, strike out "twelve and a half" and insert the word "ten."

Which was read the first time and rejected.

Mr. Hunter moved to amend said bill by way of ryder, as fol- . lows, in the 13th section, 14th line, strike out the words, "of the company," and insert the words, "or person superintending such labor,” which was agreed to, and the bill as amended then passed.

A message from the Senate by Mr. Brown.

MR. SPEAKER-There has been introduced into the Senate, "A bill to legalize the acts of the county Courts, Commissioners of county seats and Commissioners of county buildings," and

"A bill to incorporate the the Mine a Lamott and Mississippi rail road company.

The Senate have passed,

"A bill to amend an act, to provide for the recovery of debts by attachment," and

Bills from the House of Representatives, entitled,

"An act to incorporate the Missouri College." And

"An act to define the boundary of Shannon county" with amendments to each, in which the concurrence of the House is requested. The Senate have receded from their disagreement to the amend-. ments made by the House, to

"A bill to organize new counties therein named."

The Senate have passed,

"A memorial to Congress from the 'House of Representatives on the subject of pre-emptions to the settlers on and adjoining French and Spanish grants.

Mr. Fulkerson, from the joint committee on enrolled bills, reported:

That said committee had presented to the Governor for his approval, bills entitled

"An act, amendatory of an act, entitled an act for taking the cen

sus."

"An act to establish an Academy in the town of Paris, Monroe county."

"An act respecting Chancery Practice."

"An act supplementary to an act, entitled an act to provide for surveying and marking out certain State Roads, approved March the 7th, 1835," and

"A joint resolution to provide for levying, assessing and collecting

the revenue."

Mr. Fulkerson from the same committee reported,

That said committee had examined and found truly enrolled

"An act to attach certain Territory to the counties of Clay and Clinton, for civil and military purposes,"

Which was signed by the Speaker of the House, and transmitted to the Senate.

"An act, to amend an act to provide for the recovery of debts by attachment,"

Was read the first time, and

Ordered to a second reading.

The amendments made by the Senate to a bill entitled

"An act, to incorporate the Missouri College,"

Were read and concurred in by the House.

On motion of Mr. Monroe,

The resolution making the Bank bill the special order for evening sessions, was dispensed with, and

On his motion,

The House resolved itself into a committee of the Whole.

Mr. Thornton in the chair, and

After spending some time therein, rose, and their chairman reported,

That the committee have had under consideration,

"A bill to prevent foreign Banking Companies from setting up agencies, or transacting banking business within the limits of this state," and have agreed to the same with sundry amendments, Which report was agreed to by the House, and

Said bill ordered to be engrossed, and read a third time.

WEDNESDAY MORNING, JANUARY 4, 1837.

The House met pursuant to adjournment.

Mr. Cravens of Pettis, presented the petition of sundry citizens of the county of Pettis, praying the establishment of a State Road from the City of Jefferson to the town of Independence, the reading of which, was on his motion dispensed with, and the petition was referred to the select committee to which was referred other petitions on the same subject.

Mr. Caldwell presented the petition of Chapel Carstarphen, praying an extension of the law twelve months longer, for him to complete the erection of a mill dam across Salt River,

Which was read, and

On his motion,

Referred to a Select Committee.

Whereupon, Messrs. Caldwell, Holliday and Kelly, were appointed that committee.

Mr. Edwards from the committee on Ways and Means, to which was referred a resolution, instructing said committee to inquire into the expediency of allowing persons pay for services in returning pollbooks of elections to the clerk's offices, reported

"A bill supplementary to the act, to regulate Elections."

Which was read the first time, and

Ordered to a second reading.

Mr. Edwards from the same committee, to which was referred a resolution, requiring the committee to inquire into the expediency of building fire proof offices, for the State Treasurer, Auditor of Public Accounts, and Secretary of State, reported,

"That it would be expedient in case an appropriation was made for building a State House, to connect said offices therewith, and to make them fire proof; and that if no appropriation should be made for building a State House, it would then be expedient to erect fire proof offices for the said officers seperate, and apart from the State House." Which was read and concurred in by the House.

Mr. Cravens of Pettis, from the committee on claims, to which was referred the petition of James H. Birch, relative to the Journals of the session of '30 and '31, and for money by him advanced for transporting Journals from Fayette to St. Louis, reported

"A bill for the relief of James H. Birch,"

Which was read the first time, and

Ordered to a second reading.

Mr. Fulkerson from the Select Committee to which was referred the petition of Martin Warren, praying for a divorce, reported "A bill, to divorce Martin Warren and Ruth his wife, from the bonds of matrimony."

Which was read the first time, and

Ordered to a second reading.

Mr. Hunter from the Select Committee, to which was referred "A bill, to appropriate a sum of money, for the purpose of completing the road across the Big Swamp, situate on the line between the counties of Cape Girardeau and Scott," reported a substitute for the bill,

Which was read and concurred in by the House.

Mr. Fort moved to amend the bill by way of ryder, by striking out the words "any money in the Treasury not otherwise appropri ated," and insert "out of the three per cent. fund, hereafter to accrue to the counties of Scott and Cape Girardeau, after distribution is made by the Treasurer and Auditor of Public Accounts, and before the same is transmitted to the counties.

Which was read the first time.

Objections being made thereto by Mr. Hunter. The question was put, "shall the ryder be rejected," Which was at the request of Mr. Fort,

Mr. Monroe moved to amend the bill by way of ryder, by striking out the words "any money in the Treasury not otherwise appropriated," and inserting in lieu thereof, the following, "out of the three per cent. fund that may hereafter accrue to the state before distribution,"

Mr. Fulkerson moved to amend the ryder by striking out the word "hereafter" before the word "accrue" and striking out all after the word "accrue" and insert in lieu thereof, "after the next apportion

ment.

Mr. Hancock moved to amend the ryder, as follows, by adding "except that portion of the fund which has accrued, or shall hereafter accrue to the counties of Greene and "Taney," which was rejected.

Mr. Price moved to amend the bill by way of ryder, by adding the following as an additional section; "There is hereby appropriated five huudred dollars out of any money in the Treasury not otherwise appropriated, to be applied for the improvement of the state road from the bridge on the West side of the town of Keytesville to the Hill, a distance of about one mile from the town, which sum shall be applied under the direction of rhe Chariton county Court,

Which was read the first time, and rejected.

The question then being, shall the bill together with the amend ments pass?
