Mr. King, from the committee on the Judiciary, to which was referred a resolution on the subject of foreign Bank agencies, reported "A bill to prevent foreign Banking Companies from setting up agencies or transacting business within the limits of this state." Which was read the first time, and

Ordered to a second reading. And On motion of Mr. Wright of Marion,

The rule requiring bills to be read on three several days, was dispensed with, and said bill

Was read a second time, and

On motion of Mr. King,

.Committed to a committee of the Whole House.

On motion of Mr. Noland,

The resolution making the Bank Bill the special order for this evening session, was dispensed with.

Mr. King from the committee on the Judiciary, reported

"A bill to establish Judicial Districts and Circuits, and prescribe the times and places of holding Courts."

Which was read the first time, and

Ordered to a second reading.

Mr. Young, from the joint committee on enrolled bills, reported That said committee had presented to the Governor for his approval, bills of the following titles:

"An act to authorise the State Treasurer to receive the surplus revenue."

"An act to provide for fixing the permanent Seat of Justice in the county of Van Buren."

"An act to establish an Academy in the town of Union."

"An act to establish the counties of Caldwell and Daviess." "An act for surveying and marking out a State Road from Paris in Monroe county, to the mouth of the Des Moines river."

"An act amendatory to an act, approved the 7th of March, 1835, concerning strays," and

"An act for the relief of Anderson Martin, late Collector of Ray county."

On motion of Mr. Simmons,

The House resolved itself into a committee of the Whole, on the orders of the day,

Mr. Emmons in the chair, and

After spending some time therein rose, and

Their chairman reported,

That the committee have had under consideration,

"A bill supplementary to an act concerning Patrols" and have agreed to the same with an amendment.

"A bill supplementary to the several Laws establishing Justices Courts, and defining the powers and duties of Justices and Constables," and agreed to the same without amendment.

"An amendment to the tenth section of the third article of the State Constitution," and have agreed to the same with an amendment, and

"A joint resolution from the Senate, to allow Collectors six and a fourth cents per hundred words for making out abstracts which they return to the Auditor of Public Accounts," and recommend to the House the indefinite postponement thereof.

The report of the committee in relation to the three first mentioned bills was concurred in, and said bills were severally ordered to be engrossed and read a third time, and

On motion of Mr. Emmons,

The remainder of said report

Was ordered to lie upon the table.

The Speaker laid before the House the following communication from the Governor:

"An act to organize the counties of Caldwell and Daviess," and "An act to authorise the State Treasurer to receive the surplus revenue."

The House met pursuant to adjournment.

Mr. Fulkerson from the joint committee on enrolled bills, reported as truly enrolled

"An act respecting Attorney General and Circuit Attorneys, approved January 5th, 1835," and

"An act to legalize the sale of Township School Lands,"

Which were signed by the Speaker, and transmitted to the Senate. Mr. Thornton from the select committee to which was referred a resolution instructing said committee to inquire into the propriety of abolishing that clause of the Constitution, which provides that each county shall have at least one Representative, reported the following resolution."

"Resolved, By the General Assembly of the State of Missouri, two thirds of each House concurring therein, that the following amendment be, and the same is hereby proposed to the Constitution of this

state..

That from and after the year eighteen hundred and

so much of the second section of the third article of the Constitution of this state, as provides that each county shall have one Representative, shall be abolished,"

Which was read the first time, and

Ordered to a second reading.

On motion of Mr. Fort,

Mr. Edwards was added to the Select Committee, appointed to examine the books, papers, &c., in the hands or possession of the Warden of the Penitentiary, or any other person, &c."

"A bill for the relief of the heirs of Daniel Dorin, deceased." "A bill to incorporate the St. Louis Chamber of Commerce," and "A bill to incorporate the Washington county Mining Company." Were severally read a second time, and

Ordered to be engrossed and read a third time.

"A bill to establish Judicial Districts and Circuits, and prescribe the times and places of holding Courts,"

Was read a second time, and

On motion of Mr. Doniphan,

Committed to a committee of the Whole House.

"A bill to appropriate a sum of money for the purpose of completing the road across the Big Swamp, situate on the line between the counties of Cape Girardeau and Scott,

Was read a third time.

Mr. Hunter moved to amend the bill by way of ryder as follows: "Strike out the third section, and all after it, and insert section 3. Said Commissioners after being duly qualified as aforesaid, shall pro

ceed to contract in whole or in part for the completing of the work as provided for in the fourth section of this act, in such manner, and in such portions, as they, or a majority of them, may deem most advisable; due regard being had to the faithful application of the money, and the object to be accomplished.

Section 4. Said Commissioners and all others concerned shall be governed in all things necessary to carry into effect, the objects herein contemplated by the provisions of the above recited act, so far as the same may be applicable to carry the provisions of this act into effect, provided that the said work shall be done as follows, viz: The said road shall be causewayed on the embankment already made with round or split timber at least sixteen feet long, and to be covered with earth a sufficient depth to make a smooth road.

Section 5. This act to take effect and be in force from ́and after its passage."

Which was read the first time.

Mr. Thornton then moved to recommit the bill, and amendment ⚫ to a committee of the Whole House,

Mr. Edwards moved to refer the bill and amendment to a select committee,

Which was agreed to, and

Messrs. Edwards, Hunter and Blythe were appointed that committee.

"A bill to survey and mark out a State Road from Elkhorn by Plattsburg to the Western boundary.”

"An act supplementary to an act concerning Patrol," and "A bill to incorporate the Missouri College,"

Were severally read the third time and passed.

Ordered that the titles of said bills respectively be an act.

Mr. Curle moved to amend said bill by striking out "James Curle" and inserting in lieu thereof "E. V. Warren,"

Which was read a first and second time, and

Mr. Gray moved to amend said bill by striking out the word "Orange" whenever it occurs in the bill, and inserting in lieu thereof "Milam," in honor of Col. Benjamin Milam, who fell at the battle of Alamo in Texas."

Which was read the first time, and Objections being made thereto,

The question was taken on the rejection of the amendment, and Decided in the negative, and the amendment

Was read the second time, and

Mr. Noland called for a division of the question, and

The question was then taken on striking out the word "Orange" and decided in the affirmative.

Mr. Redman moved to amend the amendment by striking out the word "Milan" and all thereafter, and inserting in lieu thereof the word "Livingston" in honor of Edward Livingston,

Which was decided in the affirmative, and

The amendment ordered to be engrossed, and read a third time. Mr. Monroe moved to amend said bill by striking out the word "Jasper" and inserting in lieu thereof "Taney" in honor of Roger B. Taney."
