Mr. Gray presented the petition of Joseph J. Benning, and others of Lewis county, residents of township 67 and range 7 west, praying authority to sell certain school lands, therein described, which

Mr. Caldwell presented the petitions of sundry citizens of the counties of Ralls and Monroe, in relation to the navigation of Salt River for steam boats up to the forks of the same at Florida, by means of dams and locks, praying the incorporation of a company with all necessary powers and privileges to enable the company to effect that object, and that the state extend such assistance as may seem just and proper, which were

Mr. Cravens of Pettis from the committee on Claims, to which was referred the petition of James B. McHenry, praying additional compensation for making the fence around the Governor's House, reported that in the opinion of said committee, the petitioner has been fully compensated and that said committee ask to be discharged from the further consideration of said petition.

Which was done by the House.

Mr. Bay from the committee on the Penitentiary to which was referred the resolutiou directing an inquiry into the propriety of leassing the same, reported that the said committee believe the leasing of the Penitentiary, at present to be inexpedient and ask to be discharged from the further consideration of the subject.

The question then being upon agreeing to the report of the committee, was at the request of Mr. Fort, decided by ayes and nays, in the affirmative-ayes 39-nays-34

Mr. Monroe submitted the following resolution:

Resolved, that the committee on the militia inquire into the expediency of so amending, the third section of the second article of the militia law of this state, as to give captains and subaltern officers a voice in the election of Major Generals and Brigadier Generals; also into the expediency of so amending the 6th section of said article as to impose a penalty on any person who shall refuse to accept and qualify to his commission. Also to inquire into the expediency of amending the 15, 16, 17, 18, and 19th sections of said article so as to alter the mode of giving notice of elections. Also that said committee inquire into the propriety of so amending the 21 and 22 sections of the 2nd article, as to require that the result of elections for captains and subaltern officers, be communicated to the officer ordering the election, and he to the commander in chief.

Mr. Noland moved,

To amend said resolution by striking out the words "captains and subalterns," in the first clause thereof, and insert in lieu thereof "the qualified voters of the militia."

Which amendment was agreed to, and the resolution as amended was adopted.

Mr. Thomas presented the petition of John Ruland, clerk of the circuit court of St. Louis county, praying for the restoration to clerks of the fee formerly allowed them, for search of the files and records, which,

Was referred to the committee on the Judiciary.

Mr. Hunter presented the joint petitition of Samuel Stephens and Ma ga et Stephens his wife, praying a divorce from the bonds of matrimony contracted between them, which was read, and

The following resolution was adopted.

Resolved, By the House of Representatives, the Senate concurring therein, that the two Houses will on Wednesday the 21st instant, at three o'clock, P. M. meet in the House of Representatives, for the purpose of electing a Warden of the Penitentiary.

Mr. Fulkerson from the joint committee on enrolled bills, reported That said committee had presented to the Governor for his approval the following bills, to-wit:

"An act for the relief of Joseph McCarty."

"An act amendatory to an act entitled, an act to restrain intercourse with Indians."

And

"A joint resolution making the interest of the three per cent fund applicable to the allowance to Andrew Ramsay."

On motion of Mr. Morris,

The following resolution was adopted.

Resolved, That the committee of Ways and Means inquire into the expediency of so amending the revenue law, as that hereafter no sheriff or collector of the revenue shall be permitted to return any person as a delinquent who has any property of any kind, out of which the taxes due, by such person, may be made; but that it shall be the duty of such sheriff or collector to levy on and sell any property of any kind, which may be found, and make the taxes out of the same: and that they have leave to report by bill or otherwise. A message from the Senate by Mr. Brown.

MR. SPEAKER-The amendments made by the House of Repre sentatives to "a bill to authorize James A. Crump and others to keep a ferry at the City of Jefferson," have been concurred in by the Senate.

Mr. Monroe moved,

That the House pass over the previous orders of the day, and resolve itself into a committee of the Whole House, which was negatived.

Mr. Snyder pursuant to notice, leave being given, introduced "A bill to establish a state road,"

Which was read a first time and ordered to a second reading. Mr. Fulkerson from the joint committee on Enrolled Bills, reported as truly enrolled,

"An act to incorporate the Central Fire Company of the City of St. Louis."

"An act to survey and mark the northern boundary line of the state."

"An act supplemental of an act entitled, an act concerning evidence."

"An act to regulate proceedings upon writs of mandamus." And "A resolution to authorize the Auditor to draw his warrant in favor of James Arnold, for fourteen dollars and four cents."

Which bills were signed by the Speaker and taken to the Senate for the signature of the President of the Senate.

The House met pursuant to adjournment.

Mr. Fulkerson from the joint committee on Enrolled Bills, reported that said committee had examined and found truly enrolled, a bill entitled,

"An act to authorize James A. Crump and others to keep a ferry at the City of Jefferson,"

Which was signed by the Speaker of the House and taken to the Senate for the signature of the President.
