HOUSE OF REPRESENTATIVES.

Second Annual Session of the fifth Legislative Assembly, begun and held at Madison the seat of government of said Territory on the seventh day of February, in the year of our Lord one thousand eight hundred and forty eight.

At 12 o'clock M., the House was called to order by La Fayette Kellogg, the chief clerk, and the roll having been called, the following nammembers appeared and took their seats, to wit:

From the counties of Brown, Calumet, Manitowoc, Fond du Lac, Winnebago, Marquette, and Portage,-Messrs. G. W. Featherstonhaugh, and Moses Gibson.

From the counties of Dane, Green, and Sauk, Messrs. E. T. Gardner, Alexander Botkin, and John W. Stewart.

From the counties of Crawford, Chippewa, La Pointe and St. Croix. Henry Jackson.

From the county of Grant,-Messrs. Noah H. Virgin and D. R. Burt.

From the counties of Iowa La Fayette and Richland,—Messrs. Timothy Burns, M. M. Cothren, and Chas. Pole.

From the counties of Jefferson and Dodge,-Messrs. Levi P. Drake and Horace D. Patch.

From the county of Milwaukee,-Messrs. Isaac P. Walker, James Holliday and Asa Kinney.

From the county of Rock,-Messrs. Daniel C. Babcock and G. H. Williston.

From the county of Racine, Messrs. G. F. Newell and Dudley Cass.

From the county of Walworth,-Messrs. Eleazer Wakeley and George Walworth.

From the counties of Washington, and Sheboygan,-Mr. B. F.

Mooers.

From the county of Waukesha,-Messrs. George Reed and L. Martin.

On motion of Mr. Gardner, Timothy Burns was appointed speaker pro. tem.

Mr. Martin moved that the house now proceed to the election of a speaker for the present session;

Which was agreed to.

Messrs. Holliday and Gardner were appointed tellers, to receive and canvass the votes.

And the votes having been taken and counted, the tellers reported that the whole number of votes cast for the said office was twenty-five, necessary to a choice thirteen, of which

No person having received a majority of all the votes cast, the speaker declared that no choice had been made.

On motion, the house proceeded to a second ballot.

And the votes having been taken and counted, the tellers reported that the whole number of votes cast for the said office was twenty-five, necessary to a choice thirteen, of which

And the votes having been taken and counted, the tellers reported that the whole number of votes cast for the said office were twenty five, necessary to a choice thirteen, of which

Timothy Burns, having received a majority of all the votes cast, was declared by the speaker, (Mr. Holliday in the chair,) duly elected

Speaker of the House of Representatives for the present session.
On motion of Mr. Kinney,

Messrs. Kinney and Botkin were appointed a committee to conduct the speaker elect to the chair.

The Speaker having taken the chair,

Returned his thanks to the house, for the honor conferred on

Mr. Mooers moved that the house now proceed to the election of officers pro tem.

Which was agreed to.

On motion of Mr. Cothren,

L. F. Kellogg was appointed chief clerk pro tem.

On motion of Mr. Kinney,

H. G. Abbey was appointed assistant clerk pro tem.

On motion of Mr. Martin,

Nicholas Powers was appointed sergeant-at-arms pro tem.

On motion of Mr. Botkin,

B. H. Britton was appointed messenger pro tem.

On motion of Mr. Virgin,

William Riley was appointed fireman pro tem.

On motion of Mr. Mooers,

Messrs. Mooers and Botkin were appointed a committee on the part of the house, to act in conjunction with a similar committee on the part of the council, to wait on His Excellency the Governor, and inform him that the two houses are temporarily organized and ready to receive any communication he may have to make to them.

On motion of Mr. Wakeley,

Ordered, That the rules of the house of representatives of the special session, be adopted for the government of this house, until others are prepared and adopted.

Mr. Reed offered the following resolution, which was adopted, to wit:

"Resolved, (the council concurring) That the standing joint rules of the two houses, of the last session, be adopted as the joint rules of the two houses for the present session, until others are prepared and adopted."

A message from the council by their secretary.

"Mr. Speaker-I am directed to inform you that the council have now organized pro tem., and are ready to proceed to business, and that
