V. That any merchant of the fubjects of the King of Great Britain, &c. dying in Tripoly or its territories, his goods or monies fhall not be feized by the Baffa, Aga, or any other minifter, but remain with the English conful.

VI. That the fubjects of the King of Great Britain, &c. that do at prefent, or fhall at any time hereafter, inhabit in the city and kingdom of Tripoly, fhall have free liberty, when they please, to transport themfelves, with their families and children, although born in the country.

VII. That the conful, or any other of the fubjects of the King of Great Britain, &c. in matter of difference, fhall not be liable unto any other judgment but that of the Dey.

VIII. That the fubjects of his faid Majefty, in difference among themselves, fhall be fubject to no determination but that of the conful.

IX. That the conful, or any other of the subjects of his faid Majefty, be not liable to pay the debts of any fubject of his faid Majefty, unlefs obliged under his hand for the fame.

X. That in cafe any of his faid Majefty's fubjects fhall happen to ftrike a Turk or a Moor, if he be taken, let him be punished; but if he efcape, nothing shall be faid to the English conful, or any other of his Majefty's fubjects, upon that account.

XI. That in cafe any flave in the kingdom of Tripoly, of any nation whatsoever, shall make his escape, and get on board any fhip belonging to his faid Majefty, the conful fhall not be liable to pay his ranfom, unless timely notice hath been given him to give order that no fuch be entertained; and then, if it appear that any flave hath gotten away, the faid conful is to pay

XII. That no merchant, nor other fubject of his faid Majefty's, being a paffenger in or unto any port, fhall be molested or meddled with.

XIII. That the English conful, that lives in Tripoly, be allowed a place to pray in, and no man to do him, or any of his faid Majefty's fubjects, any wrong or injury, in word or deed, whatfoever.

XIV. That if any fhip of war of his faid Majesty's fhall come into Tripoly, or other the ports of that government, with any prize, they may fell or difpofe of it at their pleasure, without being molefted by any; and that they be not obliged to pay cuftoms in any fort: and if the said ships of war fhall want provifions, victuals, or any other thing, they may freely buy it at the rate in the market.

XV. That no fhipwreck belonging to his faid Majefty, or any of his fubjects, on the coaft belonging to Tripoly, fhall become prize; and that neither the goods be forfeited nor the men made flaves, but the people of Tripoly shall do their best endeavours to fave them and their goods.

That if any grievances happen on either fide, it fhall not be lawful to break the peace until fatisfaction be denied.

That in all other particulars, not mentioned in thefe articles, the regulation fhall be according to the general capitulation with the Grand Signior.

WE,

WE, Ofman Baffa, do declare, that the abovesaid capitulations and articles of peace are of us approved, and we confirm, and we ratify their worth and tenor. In witness of the truth, we hereunto apply our accuftomed feal.

Articles of Peace and Commerce between the most Serene and Mighty Prince Charles the Second, by the Grace of God, King of Great Britain, France, and Ireland, Defender of the Chriftian Faith, &c. and the most Illuftrious Lords, the Bashaw, Dey, Aga, Divan, and Governors of the City and Kingdom of Tripoly; concluded by Sir John Narbrough, Knight, Admiral of his Majefty's Fleet in the - Mediterranean Seas, the First Day of May, 1676.

I. IN the first place, it is agreed and concluded, that from this day, and for ever forward, there be a true, firm, and inviolable peace between the most Serene King of Great Britain, France, and Ireland, Defender of the Christian faith, &c. and the most Illuftrious Lords the Bashaw, Dey, Aga, Divan, and Governors of the city and kingdom of Tripoly, in Barbary, and between all the dominions and fubjects of either fide; and that the ships or other veffels, and the subjects and people, of both fides, fhall not henceforth do to each other any harm, offence, or injury, either in word or deed, but fhall treat one another with all poffible refpect and friendship.

II. That any of the fhips or other veffels belonging to the faid King of Great Britain, or to any of his Majefty's fubjects, may fafely come to the port of Tripoly, or to any other port or place of that kingdom, or dominions thereunto belonging, freely, to buy and fell,

without the least disturbance, paying the usual customs as in former times hath been paid for fuch goods as they fell and the goods they fell not, they shall have free liberty to carry on board their own fhips, without paying any duties for the fame; and when they please they fhall freely depart from thence, without any ftop, hinderance, or moleftation whatsoever.

III. That all fhips and other veffels, as well those belonging to the faid King of Great Britain, or to any of his Majefty's fubjects, as alfo thofe belonging to the kingdom or people of Tripoly, fhall freely pafs the feas, and traffic where they pleafe, without any fearch, 'hinderance, or molestation from each other; and that all perfons or paffengers, of what country foever, and all monies, goods, merchandizes, and moveables, to whatfoever people or nation belonging, being on board of any the faid fhips or veffels, fhall be wholly free, and shall not be stopped, taken, or plundered, nor receive any harm or damage whatsoever from either party.

IV. That the Tripoly fhips of war, or other veffels thereunto belonging, meeting with any merchants ships or other veffels of the King of Great Britain's fubjects, not being in any of the feas appertaining to his Majefty's dominions, may fend on board one fingle boat, with but two fitters, befides the ordinary crew of rowers; and no more but the two fitters to enter any of the faid merchants fhips, or any other veffels, without the exprefs leave from the commander of every fuch fhip or veffel; and then, upon producing unto them a pass under the hand and feal of the lord high admiral of England, the faid boat shall presently depart, and the merchants fhip or fhips, veffel or veffels, fhall proceed freely on her or their voyage: and although the commander or commanders of the faid merchant fhip or fhips, veffel or veffels, produce no pafs from the lord high admiral of England, yet, if the major part of the faid fhips or veffels company be fubjects to the faid King of Great Britain, the faid boat

fhall presently depart, and the merchant fhip or fhips, veffel or veffels, fhall proceed freely on her or their voyage. And if any of the faid fhips of war or other veffels of his faid Majefty, meeting with any fhip or fhips, veffel or veffels, belonging to Tripoly, if the commander or commanders of any fuch fhip or fhips, veffel or veffels, fhall produce a pass firmed by the chief governors of Tripoly, and a certificate from the English conful living there, or if they have no fuch pafs or certificate, yet if the major part of their fhips company or companies be Turks, Moors, or flaves belonging to Tripoly, then the faid Tripoly fhip or fhips, veffel or veffels, fhall proceed freely.

V. That no commander or other perfon of any fhip or veffel of Tripoly, fhall take out of any fhip or veffel of his faid Majefty's fubjects, any perfon or perfons whatsoever, to carry them any where to be examined, or upon any other pretence; nor fhall ufe any torture or violence unto any perfon, of what nation or quality foever, being on board any fhip or veffel of his Majefty's fubjects, upon any pretence whatfo

ever.

VI. That no fhipwreck belonging to the faid King of Great Britain, or to any of his Majefty's fubjects, upon any part of the coaft belonging to Tripoly, fhall be made or become prize; and that neither the goods thereof fhall be feized, nor the men made flaves; but that all the fubjects of Tripoly fhall do their best endeavours to fave the faid men and their goods.

VII. That no fhip or any other vessel of Tripoly fhall have permiffion to be delivered up, or to go to any other place in enmity with the faid King of Great Britain, to be made ufe of as corfairs or fea-rovers against his faid Majefty's fubjects.

VIII. That none of the fhips or other fmaller veffels of Tripoly fhall remain cruifing near his Majef
